AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, CREATING A NEW ADMINISTRATIVE DEPARTMENT TO BE
KNOWN AS THE DEPARTMENT OF COMMUNITY DEVELOPMENT
CONSISTENT WITH SECTIONS 3.05 AND 3.06 OF THE CITY CHARTER;
CREATING A POSITION TO BE KNOWN AS DIRECTOR OF THE
DEPARTMENT OF COMMUNITY DEVELOPMENT; COMBINING CERTAIN
ONGOING FUNCTIONS OF THE CITY WITHIN THE DEPARTMENT OF
COMMUNITY DEVELOPMENT; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 3.05 (F) of the Allen City Charter empowers the City Council
to establish by Ordinance such additional administrative departments as it deems
necessary and to assign or transfer duties of any department to another department not
in conflict with the provisions of the Charter; and,
WHEREAS, Section 3.06 provides that a position known as Director shall head
each of the administrative departments of the City; and,
WHEREAS, the City Manager has reviewed the administrative departments of
the City and is of the opinion that a need does exist to combine the administration of
certain departments and certain other functions into one department to be known as the
Department of Community Development; and,
WHEREAS, consistent with the City Charter it will be necessary that the new
department be headed by a chief administrative officer to be known as the Director of
Community Development; and,
WHEREAS, it is necessary that the Director of Community Development shall be
the chief administrative officer of the Code Enforcement Department, the Planning and
Zoning Administrative function, the Street Services Department, and other such
functions or services as may be designated by the City Manager, consistent with the
City Charter; and,
WHEREAS, in the interest of efficient administration of the City functions in
providing services to the citizens of Allen in a cost effective manner, it is appropriate
and necessary that the reorganization of the services and functions cited above be
approved.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS:
SECTION 1. In accordance with Sections 3.05 and 3.06 of the City Charter,
the City Council hereby establishes a new administrative department to be known as
the Department of Community Development.
SECTION 2. There is hereby created a position entitled "Director of the
Department of Community Development" who shall be the chief administrative officer
of the Code Enforcement Department, the Planning and Zoning Administrative
Function, the Street Services Department, and other services or functions as may be
designated by the City Manager.
SECTION 3. The Director of the Department of Community Development
shall, with the approval of the City Manager, appoint and remove the employees of the
departments and functions under his jurisdiction. The Director of the Community
Development Department shall be appointed by the City Manager with the approval of
the City Council.
SECTION 4. The Director of Community Development shall have the
authority to act for or in lieu of, or in the absence of the Chief Code Enforcement
Officials as set out in the adopted Building, Mechanical, Plumbing and Electrical Codes,
in addition to those positions designated in the ordinances pertaining to Zoning
Administration, and any other official title assigned by the City Manager, all in
accordance with the provisions of the Allen City Charter.
SECTION 5. This ordinance will take effect after publication.
