AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF
THE CITY OF ALLEN, AS HERETOFORE AMENDED, SO AS TO
ESTABLISH PERMANENT ZONING, TO -WIT: "PD" PLANNED
DEVELOPMENT NO. 14, ON THE FOLLOWING -DESCRIBED TRACT OF
LAND: APPROXIMATELY 1.8298 ACRES OF LAND, MORE OR LESS,
OUT OF THE LEWIS WETSEL SURVEY, ABSTRACT NO. 978, COLLIN
COUNTY, TEXAS; PROVIDING FOR USE REGULATIONS; PROVIDING
FOR A SITE PLAN; PROVIDING FOR A PENALTY OF FINE NOT TO SUM
OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE;
PROVIDING FOR A SEVERABIIJTY CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the City Zoning Commission of the City of Allen, and the governing
body of the City of Allen, in compliance with the laws of the State of Texas and the
ordinances of the City of Allen, have given the requisite notices by publication and
otherwise, and after holding due hearings and affording a full and fair hearing to all the
property owners generally and to all persons interested and situated in the affected
area and in the vicinity thereof, and in the exercise of its legislative discretion, have
concluded that the Comprehensive Zoning Ordinance should be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Allen,
Texas, as heretofore amended, be and the same is hereby amended by amending the
Zoning Map of the City of Allen to give the following -described tract of land the
following zoning classification, to -wit: That the area be and the same is hereby zoned
as "PD" Planned Development No. 14:
See Exhibit "A" attached hereto and made a part hereof for all purposes.
SECTION 2. That the Use Regulations described as Exhibit "B" and attached
hereto and made a part hereof for all purposes shall be the governing regulations for PD
Ordinance No. 465-10-83 - Page 1

(Planned Development) No. 14.
SECTION 3. That the Site Plan approved and described as Exhibit "C"
attached hereto and made a part hereof for all purposes shall be adhered to in its
entirety for the purposes of development of PD (Planned Development) No. 14.
SECTION 4. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance shall be, and the same are hereby, repealed; provided,
however, all other provisions of said ordinances not in conflict herewith shall remain in
full force and effect.
SECTION 5. That the property described in Exhibit "A" attached hereto shall
be used in the manner and for the purposes provided for as approved by the attachment
of Exhibits "B" and "C".
SECTION 6. That any person, firm or corporation violating any of the
provisions or terms of this ordinance shall be subject to the same penalty as provided
for in the Comprehensive Zoning Ordinance of the City of Allen, as heretofore
amended, and upon conviction shall be punished by a fine not to exceed the sum of Two
Hundred Dollars ($200.00) for each offense.
SECTION 7. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance
are severable, and if any phrase, clause, sentence or section of this ordinance shall be
declared unconstitutional or invalid by any judgment or decree of a court of competent
jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining
phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby delcares it would have passed the remaining portions even though it had known
the affected parts would be held unconstitutional.
SECTION 8. That this ordinance shall take effect immediately from and
after its passage and publication in accordance with the provisions of the Charter of the
City of Allen, and it is accordingly so ordained.

SITUATED in the State of Texas, County of Collin in the Lewis
Wetsel Survey, Abstract No. 978, and being more particularly
described as follows:
BEGINNING at an iron rod marking the intersection of the
westerly line of State Highway No. 5 with the west line of
said Lewis Wetsel Survey;
THENCE with the west line of said Lewis Wetsel Survey,
N 0°16158" E, a distance of 682.74 feet to an iron rod
marking the southwest corner of a parcel conveyed and re-
corded in Deed Volume 1273, Page 230 of the Collin County
Deed Records;
THENCE with the south line of said parcel, S 89°50'34"E, a
distance of 233.49 feet to an iron rod on the westerly line
of State Highway No. 5;
THENCE with the westerly line of State Highway No. 5, S 19109'
00" W, a distance of 722.05 feet to the place of beginning
and containing 1.8298 acres of land.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the Allen City Council will
conduct, at their Regular Meeting on Thursday, October 6, 1983,
at 7:30 p.m. in the Council Chambers of the Allen Municipal
Annex, One Butler Circle, Allen, Texas, a Public Hearing to
consider a request for permanent zoning and Site Plan Approval
to coincide with Annexation on 1.829 acres out of the Lewis
Wetsel Survey, Abstract No. 978. This property is further
described as fronting the west side of Highway 5 and extending
approximately from the intersection of Thoreau Lane to north
of High Meadow intersections.
This annexation and zoning request has been submitted
by Robert Pittman, a representative for the Exchange Group,
Inc., to permanently zone the 1.829 acre tract to PD (Planned
Development to include Office Showroom) zoning.
Anyone wishing to speak FOR or AGAINST this request is
invited to attend this Public Hearing and voice their opinion.

REQUESTED USE REGULATIONS
FOR A PLANNED DEVELOPMENT PROJECT
CONSISTING OF APPROXIMATELY 1.8 ACRES
TO BE ANNEXED BY THE CITY OF ALLEN, TEXAS
1. Purpose. This Project is to be an office showroom
complex consisting of approximately 21,000 square feet
of building space. The Project will be multi -tenant in
nature and will be leased by a variety of businesses
which wi 11 conduct their activities within the building
space itself. All business will be of a non-polluting
nature and will not include heavy manufacturing, storage
facilities or any a e s t h e t i c a I y unpleasant or
unacceptable activities. The activities contemplated
for this Project wi I1, thus, be compatible with
surrounding development, whenever such development
occurs in whatever form such development ultimately
takes.
2. General Use Regulations. The proposed Project will
not allow outside storage or outside sales activity of
any kind. The Project will not allow overnight parking
of vehicles, except where specifically stated in the
Specific Use Regulations that follow, and, under no
c rcumstances, will allow storage or parking of
inoperable vehicles for more than twenty-four (24)
hours. The Project will include large, conveniently
located, common rubbish receptacles and wi 11 not allow
the co 1 1 ect ion or dumping of rubbish of any nature by
any tenant or other person at any place on the Project,
other than i n the proper receptacles. The Project wi l l
prohibit businesses of any kind which may produce or
emit any noxious or toxic substances, whether solid,
liquid or gaseous in nature; will prohibit businesses i n,
which business activities would create noise levelsf'
audible to other tenants within the Project and to
surrounding developments. No free standing signs will
be allowed on the premises. All signs i ndent i fy i ng the
tenants of the project will be metallic and will be
attached to the masonry veneer of the f r on t wa 1 1 o f t he"
buidling as shown in the site plan and elevation
drawings submitted herewith.

3. Specific Use Regulations.
a) Office - professional administrative offices where
services are provided only, and no chattels or goods
are offered for sale on the premises, including
mu 1 t i -tenant suits; additionally, office which serve
an administrative, financial and clerical support
for businesses utilizing showroom or warehouse space
or operations.
b) Office Showroom/Warehouse - retail and wholesale
sale and display of goods and services of a
commercial nature - such space to be used primarily
for selection of non -inventoried goods and services.
Overnight parking will be limited to two (2) spaces
per 1,500 square feet of leased space.
c) Electronics Products Manufacturing - wholesale and
retail sales of goods and services relating to
electrical and electronic systems and machines,
149 including assembly of high technology, electronic
equipment compatible with, relating to, or used by
the electronics industry now existing and operating
in the city of Allen. This item will be allowed
under specific use permits only.
