AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO.
366-10-81 OF THE CITY OF ALLEN, AS HERETOFORE AMENDED, SO
AS TO ESTABLISH PERMANENT ZONING, TO -WIT: TMPD" PLANNED
DEVELOPMENT NO. 24, ON THE FOLLOWING -DESCRIBED TRACT OF
LAND: APPROXIMATELY 144.98 ACRES OF LAND, MORE OR LESS,
OUT OF THE JONATHAN PHILLIPS SURVEY, ABSTRACT NO. 719, AND
THE G. W. ESTES SURVEY, ABSTRACT NO. 301, COLLIN COUNTY,
TEXAS; PROVIDING FOR USE REGULATIONS; PROVIDING FOR A
CONCEPT LAND USE PLAN; PROVIDING FOR A PENALTY OF FINE
NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00)
FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the City Zoning Commission of the City of Allen, and the governing
body of the City of Allen, in compliance with the laws of the State of Texas and the
ordinances of the City of Allen, have given the requisite notices by publication and
otherwise, and after holding due hearings and affording a full and fair hearing to all the
property owners generally and to all persons interested and situated in the affected
area and in the vicinity thereof, and in the exercise of its legislative discretion, have
concluded that Comprehensive Zoning Ordinance No. 366-10-81 should be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS:
SECTION 1. That Comprehensive Zoning Ordinance No. 366-10-81 of the
City of Allen, Texas, as heretofore amended, be and the same is hereby amended by
amending the Zoning Map of the City of Allen to give the following tract of land the
following zoning classification, to -wit: That the area be and the same is hereby zoned
as "PD" Planned Development No. 24.
See Exhibit "A" attached hereto and made a part hereof for all purposes.
SECTION 2. That the Use Regulations attached hereto as Exhibit "B" and
Ordinance No. 514 - 6 - 8 4 - Page 1
made a part hereof for all purposes shall be the governing regulations for PD (Planned
Development) No. 24.
SECTION 3. That the Concept Land Use Plan attached hereto as Exhibit "C"
and made a part hereof for all purposes shall be adhered to in its entirety for purposes
of development of PD (Planned Development) No. 24.
SECTION 4. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance shall be, and the same are hereby, repealed; provided,
however, all other provisions of said ordinances not in conflict herewith shall remain in
full force and effect.
SECTION 5. That the property described in Exhibit "A" attached hereto shall
be used in the manner and for the purposes provided for as approved by the attachment
of Exhibits "B" and "C".
SECTION 6. That any person, firm or corporation violating any of the
provisions or terms of this ordinance shall be subject to the same penalty as provided
for in Comprehensive Zoning Ordinance No. 366-10-81 of the City of Allen, as
heretofore amended, and upon conviction shall be punished by a fine not to exceed the
sum of One Thousand Dollars ($1,000.00) for each offense.
SECTION 7. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance
are severable, and if any phrase, clause, sentence or section of this ordinance shall be
declared unconstitutional or invalid by any judgment or decree of a court of competent
jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining
phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby delcares it would have passed the remaining portions even though it had known
the affected parts would be held unconstitutional.
SECTION 8. That this ordinance shall take effect immediately from and
after its passage and publication in accordance with the provisions of the Charter of the
City of Allen, and it is accordingly so ordained.

described in a deed from Roy G. Roberts, Trustee, to Trustees,
E-Systems, Inc. Pool Trust, dated May 12, 1982, recorded in
Volume 1508, Page 730; and, a part of the 1.6791 acres of land

NORTHPOINT
LAND USE REGULATIONS
May 25, 1984
PROPERTY DESCRIPTION:
145 ACRE TRACT ADJACENT TO NEW SHOPPING MALL AT SOUTHWEST CORNER
OF U.S. HIGHWAY 75 AND STATE HIGHWAY 121
A. GENERAL REGULATIONS APPLYING TO THE ENTIRE 145 ACRE TRACT:
1. Five percent of the gross area of this tract shall be maintained in
permanent, landscaped open space.
2. There shall be a continuous thirty
foot wide
(30'-011)
greenbelt along
all street right-of-ways of seventy
feet or more located within and/or
adjacent to this development. No
buildings,
parking,
storage or
similar use shall be allowed in the
required
greenbelt
area. Parking
will be allowed in required front yard
areas
which occur adjacent to
the 301-011 wide greenbelts.
All required greenbelt areas shall be counted as part of the required
five percent landscaped open space as described in Item No. 1 of the
General Regulations.
When a building setback or required greenbelt greater than thirty
feet wide occurs on this tract, then this 30'-0" wide greenbelt shall
be included in and NOT IN ADDITION TO the greater requirement.
3. There shall be a continuous one -hundred foot wide (1001-011) greenbelt
maintained in permanent, landscaped open space along the property
line adjacent to the right-of-way of both State Highway 121 and U.S.
Highway 75. No buildings, parking, storage or similar use shall be
allowed in the required greenbelt area.
B. REGULATIONS FOR SPECIFIC SITES:
SITE A - MULTI -STORY OFFICE AND HOTEL USE - ± 24.6 ACRES
1. PURPOSE: This district is intended for multi -story office uses not
dependent upon retail trade or retail traffic for their operation and
for hotel and motel uses. This district is designed to permit the
location of offices of any profession, trade, or service near their
clients and minimize the effect upon residential and commercial areas.

2. USE REGULATIONS:
a. PERMITTED USES:
(1) Office buildings.
(2) Professional offices where only services are provided and
chattels or goods are not offered for sale on the premises.
Permitted uses include but are not limited to doctors,
dentists, attorneys, architects, engineers, insurance, or
real estate
(3) Advertising agencies.
(4) Clinics - medical, dental, chiropractic, optometric, podiatric,
etc.
(5) Duplicating centers, mainling services, stenographic offices.
(6) Employment offices.
(7) Health service.
(8) Public or denominational school.
(9) Public park or playground.
(10) Utility business office.
(11) Securities and commodities - brokers, dealers, underwriters,
and exchange offices.
(12) Travel agent.
(13) Banks and financial institutions.
(14) Hotels or motels.
(15) Retail 'sale of food, beverages and other convenience items
- or services as part of the operation of a hotel or motel
facility.
(16) Accessory building or uses customarily incident to any of
the above uses.
(17) The incidental retail sale of food, beverages, and other
convenience items or services - is permitted to the occupants,
employees, or guest of offices, as long as these items are
not advertised and offered for sale to the general public.
(18) Uses similar to the above-mentioned permitted uses, provided
activities conducted observe the requirements of all City
ordinances.
b. SPECIFIC USE PERMITS - Such uses as may be permitted under
the provisions of section 2.06, Specific Use Permit.

3. HEIGHT REGULATIONS: The maximum height for the main - buildings
shall be fifteen (15) stories.
4. AREA REGULATIONS:
a. SIZE OF YARDS:
(1) FRONT YARDS:
aa. There shall be a minimum front yard of not less than
thirty feet adjacent to any street right-of-way or to
the greenbelt along Highway 121. Any building or
portion of a building greater than 30 feet in height
must be set back from streets an additional one foot
for each one foot above such limit with a maximum
setback of 150 feet regardless of the height of the
building. -
bb. Lots having double frontage shall provide the required
setback from both streets.
cc. Buildings located along the Highway 121 greenbelt shall
have a maximum setback from the greenbelt of 75 feet
regardless of the building. -
(2) SIDE YARDS:
aa. There shall be a minimum side yard for each side of
the lot or tract on which any single building or building
complex is constructed of ten feet provided that any
building or portion of a building greater than thirty
feet in height must be set back from any side street,
alley, or "R" District 1 foot for each 1. foot above such
limit with a maximum setback of 100 feet regardless of
the height of the building.
bb. On corner lots the required front yard setback shall
be provided on both streets and such required yard
may not be used for parking purposes except in
accordance with GENERAL REGULATIONS, No. 2.
(3) REAR YARDS: No rear yard is required, except that a
rear yard of not less than fifty (50) feet in depth shall be
provided upon that portion of a lot abutting or across a
rear street from an "R" District.
(4) LOT COVERAGE: In no case shall more than fifty percent
of the total lot area be covered by the combined area of
the main buildings and accessory buildings.
(5) FLOOR AREA RATIO: The ratio of total floor areas of all
buildings to total land area shall be a maximum of 1:1.
(6) BUILDING REGULATIONS:
aa. Type of Materials - All main building exteriors shall be
constructed of stone, brick, tiles, cement, concrete, or
similar materials.

SITE B - RETAIL AND HOTEL USE - ± 10.4 ACRES
1. PURPOSE: This district is intended for low rise, medium intensity
concentration of shopping and related commercial activity along with
low rise
or high rise office buildings, hotels and motels.

3. HEIGHT REGULATIONS: The maximum height for main buildings
shall be fifteen -(15). stories.
4. AREA REGULATIONS:

not less than fifteen (15) feet in width shall be provided
on the side of a lot adjoining a side street, alley, or
"R" District.
bb. For buildings over 301-011 in height:
1.1 Buildings greater than thirty (30) feet in height
must be set back from any side street, alley, or
"R" District one foot for each one foot above such
limit with a maximum setback of 100 feet regardless
of the height of the building.
cc. On corner lots the required front yard setback shall be
provided on both streets and such required yard may
not be used for parking purposes except in accordance
with GENERAL REGULATIONS, No. 2.
(3) REAR YARDS: No rear yard is required except that not
less than twenty-five (25) feet in depth shall be provided
for buildings up to 30'-0" in height and not less than fifty
(50) feet in depth shall be provided for buildings over
30'-0" in height on that portion of a lot abutting or across
a rear street or alley from an "R" District.
(4) LOT COVERAGE: In no case shall more than fifty percent
of the total lot area be covered by the combined area of the
main buildings and accessory buildings.

(5) FLOOR AREA RATIO:
aa. For buildings up to forty-five (45) feet in height
the ratio of total floor area of all buildings to total
land area shall be a maximum of 1:1.25.
bb. For buildings from 451-011 in height the F.A.R. shall
be 1:1.
(6) BUILDING REGULATIONS:
aa. Type of Materials - All main building exteriors shall be
constructed of stone, brick, tiles, cement, concrete, or
similar materials.

SITE C - SHOPPING CENTER USE - ± 37 ACRES
1. PURPOSE: This district is intended to provide for medium -intensity
concentrations
of shopping and related office and commercial activities
characteristic of the trend of urban development to the decentralization
of retail
business facilities.
2. USE REGULATIONS:
a. PERMITTED USES:

4. AREA REGULATIONS:
a. SIZE OF YARDS:
(1) FRONT YARD: There shall be a front yard having a minimum
depth of twenty-five (25) feet. No parking, storage, or
similar use shall be allowed within 100 feet of any "R" District.
(2) SIDE YARD: A side yard of not less than fifteen (15) feet
in width shall be provided on the side of a lot adjoining a
side street, alley, or "R" District".
(3) REAR YARD: No rear yard is required except that a rear
yard not less than twenty-five (25) feet in depth shall be
provided on that portion of a lot abutting or across a rear
street or alley from an "R" District.
5. LOT COVERAGE: In no case shall more than fifty percent of the total
lot area be covered by the combined area of the main buildings and
accessory buildings.
6. FLOOR AREA RATIO: The ratio of total floor area of all buildings to
total land area shall be a maximum of 1:1.25.
7. BUILDING REGULATIONS:
a. Type of Materials - All main building exteriors shall be constructed
of stone, brick, tiles, cement, concrete, or similar materials.

1. PURPOSE: This district is intended for the development of an industrial
park which will include facilities for light distribution, processing and
manufacturing. The regulations in this district are intended to preserve
a light industrial nature, particularly with regard to architectural
aesthetics, noise, odor, dust and other noxious conditions.
2. USE REGULATIONS:
a. PERMITTED USES:
(1") Office buildings.
(2) Electronics products manufacturer.
(3) Apparel or related manufacturer.
(4) Light fabrication and assembly, per City of Allen ordinance
No. 3.01 (0), 2., C; and per City of Allen performance
standards.
(5) Printing establishments.
(6) Distribution center (no outside storage) .
(7) Uses similar to the above listed uses provided activities
conducted observe the, requirements of all City ordinances.
(8) Such uses as may be permitted under the provisions of
section 2.06, Specific Use Permit.
3. HEIGHT REGULATIONS: The maximum height for the main building
shall be 3 standard stories but shall not exceed forty-five (45) feet
in height provided that any building or portion thereof may be erected
above said limit if setback from all street lines and required yard lines
is one (1) foot for each one (1) foot of its height above said limit.
In no event, however, shall any building exceed thirty (30) feet in
height when located within two hundred ( 200) feet of any property
zoned for residential purposes.
4. AREA REGULATIONS:
a. SIZE OF YARDS:
(1) FRONT YARD:
aa. There shall be a minimum front yard having a depth of
not less than one hundred (100) feet adjacent to any
street with a right-of-way of one hundred (100) feet
or more.
bb. There shall be a minimum front yard having a depth of
-not less thanfifty (50) feet adjacent to any street with
a right-of-way less than one hundred (100) feet provided
that any building or portion of a building greater than

forty-five (45) feet in height must be set back from the
property line one (1) foot for each one (1) foot above
such limit with a maximum setback of two hundred ( 200)
feet regardless of the height of the building.
cc. Lots having double frontage shall provide the required
setback from both streets.
dd . There shall be a continuous thirty foot wide (301-011)
greenbelt along all street right-of-ways of seventy feet
or more located within and/or adjacent to this development.
No buildings, parking, storage or similar use shall be
allowed in the required greenbelt area. Parking will
be allowed in required front yard areas which occur
adjacent to the 301-011 wide greenbelts.
(2) SIDE YARDS: There shall be a minimum side yard for each
side of the tract or lot on which any single building or
buildings complex is constructed of twenty-five (25) feet
provided that any building or portion of a building greater
than forty-five (45) feet in height must be set back from
any side street, alley or "R" District one (1) foot for each
one (1) foot above such limit with a mzximum setback of
one hundred (100) feet regardless of the height of the building.
(3) REAR YARD: There shall be a minimum rear yard of twenty-
five (25) feet except that a rear yard of not less than fifty
(50) feet indepth shall be provided upon that portion of a
lot abutting or across a rear street or alley from a "R"
District, however, any building exceeding forty-five (45)
fee in height must be set back one (1) foot for each one (1)
foot above such limit, with a maximum setback of one hundred
(100) feet regardless of the height of' the building.
5. LOT COVERAGE: No requirement except that required by establishment
of yards or landscape requirements.
6. FLOOR AREA RATIO: The ratio of total floor area of all buildings to
total land area shall be a maximum of 1:1.
7. BUILDING REGULATIONS:

1. PURPOSE: This district is intended for a broad range of office and
light industrial uses primarily involved in high-technology activities.
2. USE REGULATIONS:
a. PERMITTED USES:
(1) Office buildings.
(2) Products manufacturer of high-technology equipment including,
but not limited to computers and components, measuring
instruments, telecommunications, electronic components and
laboratory equipment
(3) Distribution center (no outside storage) .
(4) Light fabrication and assembly, per City of Allen ordinance
No. 3.01 (0), 2., C; and per City of Allen performance
standards.
(5) Printing establishments.
(6) Apparel or related manufacturer.
(7) Uses similar to the above listed uses provided activities
conducted observe the requirements of all City ordinances.
(8) Such uses as may be permitted under the provisions of
section 2.06, Specific Use Permit.
