ORDINANCE NO. 625-8-85
AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, AMENDING PLANNED DEVELOPMENT ZONING ORDINANCE
NO. 367-10-81 AND PLANNED DEVELOPMENT ZONING ORDINANCE
NO. 458-9-83 OF THE CITY OF ALLEN, AS HERETOFORE AMENDED,
SO AS TO CHANGE A 60+ ACRE TRACT OF LAND OUT OF THE JOHN
DAVIS SURVEY, ABSTRACT NO. 225, AND THE J.A. TAYLOR SURVEY,
ABSTRACT NO. 908, COLLIN COUNTY, TEXAS, FROM THE CURRENT
ZONING DISTRICT CLASSIFICATIONS OF PLANNED DEVELOPMENT
NO. 2 AND PLANNED DEVELOPMENT NO. 12, RESPECTIVELY, TO
FLOOD PLAIN - PLANNED DEVELOPMENT NO. 33; PROVIDING FOR A
LAND USE PLAN; PROVIDING FOR LAND USE REGULATIONS AS
ESTABLISHED IN PD NO. 12; PROVIDING FOR A PRELIMINARY SITE
PLAN; PROVIDING FOR A CONCEPT PLAN FOR LANDSCAPE
DEVELOPMENT ON MUSTANG BRANCH; PROVIDING FOR A
LANDSCAPE PLAN; PROVIDING FOR A PENALTY OF FINE NOT TO
EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR
EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the Planning and Zoning Commission of the City of Allen, and the
governing body of the City of Allen, in compliance with the laws of the State of Texas
and the ordinances of the City of Allen, have given the requisite notice by publication
and otherwise and, after holding due hearings and affording a full and fair hearing to all
the property owners, generally, and to all persons interested and situated in the
affected area, and in the vicinity thereof, and in the exercise of its legislative
discretion, have concluded that the Planned Development Zoning Ordinance No.
367-10-81 and Planned Development Zoning Ordinance No. 458-9-83 should be
amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS:
SECTION 1. That the Planned Development Zoning Ordinance No. 367-10-81
and 458-9-83 of the City of Allen, Texas, as heretofore amended, be and the same are
hereby amended by amending the Zoning Map of the City of Allen to give the tracts of

land, described in Exhibit "A" attached hereto and made a part hereof for all purposes,
the following zoning classification, to -wit: Flood Plain - Planned Development No. 33.
SECTION 2. That the Land Use Plan attached hereto as Exhibit "B" and
made a part hereof for all purposes shall be adhered to in its entirety for purposes of
development of Flood Plain - Planned Development No. 33.
SECTION 3. That the Preliminary Site Plan described as Exhibit "C" and
attached hereto and made a part hereof for all purposes shall be the governing
regulations for Flood Plain - Planned Development No. 33.
SECTION 4. That the Land Use Regulations described as Exhibit "D" and
established by PD No. 12 and attached hereto and made a part hereof for all purposes
shall be adhered to in its entirety for purposes or development of Flood Plain - Planned
Development No. 33.
SECTION 5. That the Concept Plan for Landscape Development on Mustang
Branch attached hereto as Exhibit "E" and made a part hereof for all purposes shall be
adhered to in its entirety for purposes of development of Flood Plain - Planned
Development No. 33.
SECTION 6. That the Landscape Plan attached hereto as Exhibit "F" and
made a part hereof for all purposes shall be adhered to in its entirety for purposes of
development of Flood Plain - Planned Development No. 33.
SECTION 7. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance be, and the same are hereby, repealed; provided, however,
all other provisions of said ordinances not in conflict herewith shall remain in full force
and effect.
SECTION 8. That the property described in Exhibit "A" attached hereto shall
be used in the manner and for the purposes provided for as approved by the attachment
of Exhibits "B", "C", "D", "E" and "F".
SECTION 9. That any person, firm, or corporation violating any of the
provisions or terms of this ordinance shall be subject to the same penalty as provided
for in the Planned Development Zoning Ordinance No. 367-10-81 and 458-9-83 of the
Ordinance No. 625-8-85 - Page 2
City of Allen, as heretofore amended, and upon conviction shall be punished by a fine
not to exceed the sum of one thousand dollars ($1,000.00) for each offense.
SECTION 10. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance
are severable, and if any phrase, clause, sentence or section of this ordinance shall be
declared unconstitutional or invalid by any judgment or decree of a court of competent
jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining
phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had known
the affected parts would be held unconstitutional.
SECTION 11. That this ordinance shall take effect immediately from and
after its passage and publication in accordance with the provisions of the Charter of the
City of Allen, and it is accordingly so ordained.

Council Persons:
This booklet has been prepared to assist you in the evaluation of
Carnes Development Company's zoning application.
The Planning Commission has recommended approval of this request as
set forth herein and with the following additions:
1. Tract G must provide rear entry garages.
2. The Garden Office District at the corner of Hillside Lane and F.M.
2170 should be limited to two stories maximum height.
3. Reclamation of the flood plain should include language stating that
the engineering proposal be carried through proper procedures as
outlined by FEMA standards with approval by the engineering rep-
resentatives of the City.
4. Proper screening to be required along Hillside Lane behind Tract
G and along Allen Heights Drive where homes back up to the thor-
oughfare.
5. The developer's portion of Allen Heights Drive should be completed
to Hillside Lane before any C/O is issued for structures in any
tract within this request.
The applicant concurs with these recommendations, except for the word-
ing in item 5 which would require paving of Allen Heights on property
not owned by applicant. Mr. Carnes has a written agreement with the
adjoining property owner which can be initiated by either person to
cause the paving of Allen Heights along the Carne's property line. As
written, the Commission's recommendation further suggests withholding
all Certificates of Occupancy on the property within this request until
the paving of Allen Heights to Hillside is complete.
Mr. Carnes intends to pursue the paving of Allen Heights, but requests
the approval of zoning not tie occupancy to the paving of the thorough-
fare and construction on property not within his ownership.

PURPOSE OF REQUEST
Carnes Development Company is the owner of 56.9 acres and 3.54 acres
of land located in PD -12 and PD -2 respectively. The land in PD -12 is
located south of Main Street and north and west of Allen Heights Drive
except for approximately 10 acres fronting Hillside Lane. The section
of PD -2 purchased by Mr. Carnes is in two tracts and is situated in
the southwest corner of the intersection of Main and Allen Heights and
adjacent to PD -12.
The purpose of this request is to receive approval for revisions to land
use and area delineations for ownership in sections of PD -12 and PD -2.
Once approved, the area of this request can be logically developed for
uses and similar land areas as were set forth in the original PD's.

PD -12
1. Planned Development District 12 was established by Ordinance
458-9-83. A site plan (Exhibit B) and development standards (Ex-
hibit C) were approved as a part of this Ordinance and are con-
tained herein.
This request addresses revisions to the specific sites listed below.
Site designations correspond to those identified on the site plan
with the general development standards summarized for each site.

2. In the above tabular summary, acreage of use for each Site is
shown as ±, or approximate, in the development standards.
3. Use regulations refer to the specific section of the Zoning Ordi-
nance for each of the uses and, as indicated, each District use
regulation has been adopted into the planned development ordi-
nance with the exception of those uses or standards as noted.
4. Open space requirements appeared to have been based on a factor
of .0133 acres per unit. This factor is the resultant from division
of residential acres by the maximum number of dwelling units for
the sites involved in this request. An identical factor for the
total planned development district results using the required 8.89
acres of open space and the 677 permitted dwelling units.

AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TERAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF
THE CITY OF ALLEN, AS HERETOFORE AMENDED, SO AS TO
ESTABLISH PERMANENT ZONING, TO -WIT: "PD" PLANNED
DEVELOPMENT NO.;12, ON A TOTAL OF 145 ACRES OF LAND, MORE
OR LESS, OUT OF THE JOAN DAVIS SURVEY, ABSTRACT NO. 255, AND
THE SIMON BURNS SURVEY, ABSTRACT NO. 92, COLLIN COUNTY,
TERAS, 15 ACRES OF WHICH IS PRESENTLY DELINEATED ON THE

Exhibit "A" attached hereto and made a part hereof for all purposes, 15 acres of which
Is presently delineated on the Official Zoning Map as "LR" Local Retail, to give said
tract of land the following zoning classification, to -wit: That the area be and the same
Is hereby zoned as "PD" Planned Development No. 12.
SECTION 2. That the Preliminary Site Plan and Development Plan approved

as described as Exhibit "B" attached hereto and made a part hereof for all purposes
shall be adhered to In Its entirety for the purposes of development of "PD" Planned
Development No. 12.
SECTON 3. That the Use Regulations described as Exhibit "C" and attached

"PD" Planned Development No. 12.
SECTION 4. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance shall be, and the same are hereby, repealed; provided,
however, all other provisions of said ordinances not In conflict herewith shall remain in
full force and effect.
SECTION 5. That the property described in Exhibit "A" attached hereto shall

that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are
severable, and if any phrase, clause, sentence or section of this ordinance shall be
declared unconstitutional or invalid by any judgment or decree of a court of competent
jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining
phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though It had known
the affected parts would be held unconstitutional.

DEFINITION OF ADDITIONAL USES FOR SITES "B" AND "C":
1. Greenhouse or Plant Nursery: A facility which sells plants and
gardening equipment and supplies in an enclosed building and in
open areas providing that such open areas are completely screened
with a solid fence, approved by the City of Allen and that such
open area conforms with all building setbacks and that such open
area does not exceed 15,000 square feet per establishment.
2. Auto Parts Sales and Repairs: A facility which sells auto parts and
supplies and which repairs autos within an enclosed building. Such
facility to have no auto service bay facing F.M. 2170 (Main Street)
or Allen Heights Drive and to have no open overnight storage of
autos. Such facility to be operated by a nationally recognized
company such as, but not limited to, Firestone, Goodyear, J.C. Penney
or Sears Roebuck and Company.
PD -2
1. Planned Development District 2 was established by Ordinance
367-10-81, and a site plan (Exhibit B) was approved as a part of
this Ordinance. Both are contained herein.
2. This request addresses revisions to Areas shown on the plan as
One and Six. The specified use for these tracts, as shown, was
Tract One - Commercial, containing 1.61 acres, and Tract Six -
Residential, containing 176.53 acres.
3. In May, 1984, Ordinance 510-5-84 was adopted amending PD 2 ap-
proving a site plan for retail use and describing the area of Area
One as 1.505 Acres. Ordinance 510-5-84 and Exhibit D, site plan
are contained herein.
4. The portion of Area Six contained in the original site plan is a
2.035 acre tract immediate south and adjacent to the 1.505 parcel,
both of which lie on the west side of new Allen Heights Drive.

WHEREAS, the City Council of the City of Allen, Texas, is
charged with the responsibility of providing for the public
health, safety, and welfare of the people of the community; and
WHEREAS, planned development areas offer a reasonable method
for a city to provide control over traffic, sewage, water, and
other factors vitally connected to the public health, safety
and welfare; and
WHEREAS, the property described in Exhibit "A" attached her
has been lawfully incorporated into the City of Allen, Collin
County, Texas; and,
WHEREAS, the legal notices required for zoning have been
given in the manner and form set forth by law and public hearings
have been held on the proposed zoning classification;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ALLEN, TEXAS:

Ordinance, Ordinance No. 261 is hereby repealed.
Section 2. That the property described in Exhibit
attached hereto, and made a part hereof for all purposes, is
hereby placed in a planned development area and is zoned according
to the uses as shown on the map and plat attached to this Ordinance
as Exhibit "B", which map and plat is incorporated in this Ordinance
as though written herein.
Section 3. It shall be unlawful for any person, firm or
corporation to make use of said premises in some manner other than
as authorized by this Ordinance, and it shall be unlawful for any
person, firm or corporation to construct on said premises any
building that is not in substantial conformity with the plot plan
attached hereto.

Section 9. Any person, firm or corporation who violates any
provision of this Ordinance shall be deemed guilty of a misdemeanor,
and upon a conviction therefor shall be fined any sum not exceeding
Two hundred Dollars ($200.00); and each and every day that such
violation continues shall be considered a separate offense;
provided, however, that such penal provision shall not preclude a
suit to enjoin such violation or any other legal remedy available
to the City in connection with said violation.
Section 5. The caption of this Ordinance shall be published
at least twice in the official newspaper of the City, stating in
summary the purpose of this Ordinance and the penalty for violation
hereof, and shall be effective immediately upon its passage and
such publication.

SECTION 4. That any person, firm, or corporation violating any of the
provisions of the terms of this ordinance shall be subject to the same penalty as

of Allen and upon conviction shall be punished by a fine not to exceed the sum of

approval In order to permit Its proper development and in order to protect the public

FLOODPLAIN
Mustang Branch flows through the area of request for revision in
PD -12. Most recent study and analysis of the flood plain as it influ-
ences this property is shown on the following page. The flood plain
area shown was determined from a hydrology study performed by the
firm of Don Tipton Engineers, Inc. The limits of flood plain are slight-
ly different than boundaries defined on F.E.M.A. maps.
It is the intent to utilize the present channel alignment for future con-
veyance of storm water in the section shown as the floodway. Land
adjoining either side of the floodway and shown within the floodplain
limits is to be reclaimed by raising the elevation through filling and
compaction.
Engineering plans and supporting documents are being submitted to the
City of Allen for approval of this reclamation process.
ZONING DISTRICT
The zoning district boundaries for PD -12 and PD -2 are combined on the
following page and are shown with the existing floodplain. The total
area within the floodplain in all districts is approximately 21.1 acres.
The relationship of district boundaries in the northwest corner of the
Carnes ownership creates problems for development. The floodplain
limits, as related to site boundaries, further compounds development of
the property as it is currently districted.

REQUESTED ZONING BOUNDARY AND STANDARDS REVISIONS
The proposed zoning boundary revisions to PD -12 and PD -2 are shown
on the following page. As indicated on the zoning plan, a line delin-
eates the division between these two Planned Development Districts.
ZONING BOUNDARIES
The proposed zoning district plan places the larger area of Shopping
Center use on the southeast corner of the major thoroughfare inter-
section and integrates the smaller retail and residential PD -2 tracts into
the overall plan for use of land in PD -12. A major buffer of landscape
materials and berms are to be placed in a 25 foot width along the west
right-of-way of Allen Heights Drive, providing with available parkway,
a total of approximately 35 feet of vegetative screening and lawn area.
South of the Shopping Center District is an Office District use which
will have considerable open space for landscape treatment provided ad-
jacent to Allen Heights Drive.
It is proposed to leave Mustang Branch in its location and fill adjacent
areas to remove them from the floodplain. The Branch generally -sepa-
rates the multi -family use and the retailing function except for the
shopping center use along Main Street. A band of multi -family use is
shown along the east side of the Mustang Branch drainageway. This
area is to be landscaped and utilized for open space area associated
with the multi -family tract.
Frontage along Main Street west of Mustang Branch is shown for Shop-
ping Center use except for the southeast corner of Main Street and
Hillside Lane when Office use is requested. This use provides a 2.2
acre buffer from areas west of Hillside, and as shown on the site plan
an attractive landscape can be placed between the building and curb.
The location of office use and limited driveway access will help to lessen
any traffic interference for this intersection from this site.
The current planned development standards permit a convenience store
and pump island to be located in PD -2 at Main and Allen Heights, and a
service station is permitted in sites B and C of PD -12. In lieu of these
sites, a single site is requested to be permitted in the 5.8 acre Shop-
ping Center tract. This tract is shown on the site plan at the inter-
section of the proposed north -south interior road and Main Street.
Single family zero lot line use is proposed rather than either two family
or attached townhouse use. The single family detached use is con-
sidered to be more appropriate and continues to serve as a buffering
type of residential use between the single family use adjacent to Hillside
and the multi -family district in PD -12. Planned Development standards
requested for approval of the zero lot line tract follows this section.

The difference in total acreage can not be specifically explained, except
that the 60.4 acres is the land area purchased by Carnes Development
Company.
As shown on the previous page, there is no longer area in either at-
tached or two-family units. There is substantial increase in single fam-
ily area for zero lot line/garden home use.
The Shopping Center use has been increased by approximately .4 acres
when the combined existing retailing use is considered to be 21.4 acres.
DWELLING UNITS
The total number of dwelling units permitted in the PD -12 Ordinance is
331. It is proposed under this revision to reduce that maximum by 56
units to 275 units.
The distribution of these 275 units is: (1) 75 lots for zero lot line use,
and (2) 200 multi -family units.
The multi -family units will be placed on 12.0 acres of usable land for a
net density of 16.6 units per acre. However, when the open space
allocation of 3.7 acres is combined with the multi -family use, the ratio
decreases to 12.7 units per acre.

SITE PLAN
The Site Plan for this request is shown on the following page. Zero lot
line/garden home lots are shown west of the north -south collector and
front on cul de sac streets which operate from the collector street..
The multi -family area adjacent to the collector has as an east boundary
the allocated open space and drainageway. As indicated, jogging trails
are located either side of the drainageway and are linked by pedestrian
bridges. It is proposed the open space area have additional treatment
using landscape plant materials and trees and passive recreational facil-
ities such as benches or a shelter. A screening wall is proposed be-
hind the retail area while the office area will have visual access to the
open space. An arcade is provided in the building mass to allow pe-
destrian movement between the retail stores and the open space/multi-
family area.
An access easement will be given through the open space area to allow
public access along the trails between Allen Heights Drive and Main
Street.
The use of the northeast corner of Tract D for convenience store and
gasoline pump island is shown on the site plan.
As indicated on the site plan, a landscape buffer of plant materials and
berms is proposed in the 35 feet adjacent to Allen Heights Drive. This
buffer extends between points A and B as shown on the planned devel-
opment zoning plan and is set forth in more detail herein. Additional
landscape planting and the entry design into the office area provide
further buffering from Allen Heights and the adjoining residential area.
Treatment of the drainageway and adjacent open space shown on the
Site Plan proposes jogging paths either side of the drainageway with
tree plantings and a shelter. This area is principally for passive rec-
reational use and complements both the multi -family use, as well as the
entire planned development district.
