AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, AMENDING PLANNED DEVELOPMENT ZONING ORDINANCE
NO. 507-5-84 TO INCLUDE THE ATTACHMENTS OF EXHIBIT IIE".
AMENDED APPROVED SITE PLAN, AND EXHIBIT "F", AMENDED
APPROVED LAND USE AND AREA REGULATIONS FOR
DEVELOPMENT OF 356.7 ACRES OF LAND OUT OF THE 408.57 ACRE
TRACT LOCATED IN THE G.W. FORD SURVEY, ABSTRACT NO. 328,
AND THE R.C. WHLSENANT SURVEY, ABSTRACT NO. 1012, COLLIN
COUNTY, TEXAS, PRESENTLY DELINEATED ON THE OFFICIAL
ZONING MAP AS PLANNED DEVELOPMENT NO. 22; PROVIDING FOR A
PENALTY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING
FOR PUBLICATION OF THE CAPTION.
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, in compliance with the laws of the State of Texas and the ordinances of
the City of Allen, have given the requisite notices by publication and otherwise; and,
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, have held due hearings and afforded a full and fair hearing to all the
property owners generally and to all persons interested and situated in the affected
area and in thfe vicinity thereof; and,
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, in the exercise of its legislative discretion, have concluded that Planned
Development Zoning Ordinance No. 507-5-84 should be amended to include the
attachments of Exhibit "E", amended approved site plan, and Exhibit TIF", amended
approved land use and area regulations, for development of 356.7 acres of land out of
the 408.57 acre tract located in the G.W. Ford Survey, Abstract No. 328, and the R.C.
Whisenant Survey, Abstract No. 1012, Collin County, Texas, presently delineated on the
Official Zoning Map as Planned Development No. 22.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE THE
CITY OF ALLEN, TEXAS:

SECTION 1. That the Planned Development Zoning Ordinance No. 507-5-84
of the City of Allen is hereby amended to include the attachments of Exhibit "E",
amended approved site plan, and Exhibit "F", amended approved land use and area
regulations, for development of 356.7 acres of land out of the 408.57 acre tract located
in the G.W. Ford Survey, Abstract No. 328, and the R.C. Whisenant Survey, Abstract
No. 1012, Collin County, Texas, presently delineated on the Official Zoning Map as
Planned Development No. 22.
SECTION 2. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance be, and the same are hereby, repealed; provided, however,
all other provisions of said ordinances not in conflict herewith shall remain in full force
and effect.
SECTION 3. That the above-described tract of land shall be used in the
manner and the purposes provided for by the Planned Development Zoning Ordinance
No. 507-5-84 of the City of Allen as amended herein by the approval of attachments of
Exhibits "E" and "FIT.
SECTION 4. That any person, firm or corporation violating any of the
provisions or terms of this ordinance shall be subject to the same penalty as provided
for in the Planned Development Zoning Ordinance No. 507-5-84 of the City of Allen and
upon conviction shall be punished by a fine not to exceed the sum of One Thousand
Dollars ($1,000.00) for each offense.
SECTION 5. That it appears the above-described property requires site plan
approval in order to permit its proper development and, in order to protect the public
interest, comfort, and general welfare of the City of Allen, creates an urgency and an
emergency for the preservation of the public health, safety, and welfare, and requires
that this ordinance shall take effect immediately from and after its passage and the
publication of the caption of said ordinance as the law in such cases provides.

Dear Mr. Petty:
As requested by the Planning & Zoning Commission meeting of
November 26, 1985, the following items have been amended for the
Planned Development request before the City Council of Allen,
Texas:
I. The 0.90 acres dedicated parcel for the future City of Allen
Fire Station shall be labeled and dedicated as a "Community
Facility". This parcel will be deeded to the City of Allen
by the Owners at no land purchase cost to the City of Allen.
II. The areas labeled as "Open Space Floodplain" shall now be
labeled and dedicated as "Open Space Floodplain - Community
Facility" as requested by the City of Allen.
III. The location and alignment of the 60' Collector R.O.W. on
the East side of Tract One, adjacent to Property Owners
Steve Allen, Clarence Carter, Robert Todd, Chris Snodgrass,
Jack Pennington and Wayne E. Lee shall be agreed upon prior
to Final Platting of Tract One.

IV. The City of Allen agrees to reimbursement of their half of
complete roadway development along the common property line
of Ford Middle School Park Area. And, further, the City of
Allen agrees to roadway reimbursement of the Proposed Fire
Station frontage along Bethany road and the Proposed 60'
Collector in Tract One. This reimbursement will come about
after -the Developer has compl-eted -construction and City
acceptance of said roadways has been obtained.
The above-mentioned items should address all Staff and Planning &
Zoning comments. However, if you have any further questions or
anything further is needed at this time, please call us.

The Heritage Park Community is a proposed planned development district (single
family, multi -family, shopping center) as permitted under the land development
regulations of the City of Allen, Temms.
' Zhis document is an amendment to the existing planned development that was
finalized April 16, 1984. Our amendment does not include any changes in the
existing multi -family or shopping center areas. Zhe request is for the purpose
of providing a well planned community with architecturally identified uses.
7he following items represent primary elements of the minor involved.
Zhe details of each request are provided in the submittal package.
I. Elimination of mid density townhouse uses which allows 1000 S.F. m;n;mian
unit size with a maximum of six attached units.
II. Elimination of garden home/patio home uses which allows a minimum of 1200
S.F. unit size uses.
III. Concentration of single family detached uses varying from 1450 to 2000
S.F. minimum house sizes.
IV. Introduction of a rear entry Twin -flex use that provides a single family
character and density transition f rom the multi -family and shopping
center areas.
V. Committment of 1"=100' scale preliminary plat that provides curvelinear
design and addresses to the City of Allen design criteria. This plan
will become part of the zoning documents that are approved.
VI. Planning of roadway committments involving the flood plain areas of
Cottonwood Creek and the proposed park site.
VII. Coamittment of community identity, product design, aesthetic values
created by a union of creative land planning and product design.
VIII. Documents provide the City with restrictive controls for any and all
future users are developers.
IX. Land donation for future fire station location.

This application for revised zoning will reinforce an exemplary development in
the City of Allen. This booklet should provide assistance in your review.

PARCEL DESCRIP'T'ION
1. Ste: This Tract is designated for single family use. The maximum
number of units in this Tract shall not exceed two hundred sixty-eight
(268) .
2. Use ReMlations: A building or premise shall be used only for the
following purposes:
a. Single family residential detached units and accessory buildings and
uses customarily incidental to this use.
b. Churches and church related uses as permitted by a Special Use Permit.
3. Heiabt Reaalations: No buildings shall exceed thirty (30) feet or two and
one-half (2 1/2) stories in height.

(1) There shall be a front yard having a depth of not less than
twenty-five (25) feet.
(2) Side Yard - There shall be a side yard on each side of the lot
having a width of not less than ten percent (10%) of the lot
width. A side yard adjacent to a side street shall not be less
than f if teen (15) feet, even when a side yard is across f ram a
front yard, the side yard shall be fifteen (15) feet.
(3) Rear Yard - There shall be a rear yard having a depth of not less
than f if teen (15) feet.
b. Size of Lot:
(1) Lot Area - No building shall be constructed on any lot less than
eight thousand (8,000) square feet on sixty-eight percent (68%) of
the lots, and nine thousand (9,000) square feet on six percent
(6%) of the lots, and ten thousand (10,000) square feet on
thirteen percent (13%) of the lots, and twelve thousand (12,000)
square feet on thirteen percent (13%) of the lots, such lot shall
have a minimum buildable area of three thousand (3,000) square
feet.
(2) Lot Width - The width of the lot shall be not less than sixty-five
(65) feet at the front street building line, nor shall its average
width be less than sixty-five (65) feet.
(3) Lot Depth - The depth of the lot shall not be less than one
hundred ten (110) feet, except that a corner lot or cul-de-sac lot
may have a depth of less than one hundred ten (110) feet provided
that the minimum depth is no less than ninety (90) feet.

c. Minimum Dwelling size: The minimum floor area of any dwelling
exclusive of garages, breezeways, and porches shall be: (1) six
percent (6%) of units two thousand square feet, and (2) five percent
(5%) of units one thousand, nine hundred (1,900) square feet, and (3)
seventeen percent (17%) of units one thousand, eight hundred (1,800)
square feet, and (4) eighteen percent (18%) of unit one thousand, seven
hundred, fifty (1,750) square feet, and (5) eighteen percent (18%) of
units one thousand, six hundred, fifty (1,650) square feet, and (6)
eighteen percent (18%) of units one thousand, five hundred, fifty,
(1,550) square feet, and (7) eighteen percent (18%) of units one
thousand, four hundred, fifty (1,450) square feet.
d. Lot Coverages: In no case shall more than forty percent (40%) of the
total area be covered by the combined area of the main buildings and
accessory buildings.

a. Type of Materials: All main buildings shall have exterior construction
of a minimum of seventy-five (75%) brick, tiles, cement, concrete,
stone, or similar materials.

1. Sinal: This Tract is designated for single family dwellings on separate
lots under separate ownership. The maximum number of dwelling units in
this Tract shall not exceed one hmuidred, fifty-two (152) .
2. Use Regulations: A building or premise shall be used only for the
following purposes:
a. Two family attached units when developed under standards submitted as
site plan within the documents.
b. Attached -dwelling-units, -provided -that--no -more-than two- (2) -dwelling ---
units are attached in one continuous row or group, and provided that no
dwelling unit is constructed above another dwelling unit.
3. HeightReaalati,ons: No building shall exceed thirty (3 0) feet or two and

thousand, five hundred (3,500) square feet. Such lot shall have a
minimum buildable area of two thousand, two hundred, fifty (2,250)
square feet.
(2) Lot Width - The width of the lot shall not be less than thirty-
five (35) feet at the front street building line.
(3) Lot Depth - The depth of the lot shall not be less than one
hundred (100) feet.
c. Mininum Dwell;na size: The minimum floor area of any dwelling unit
shall be one thousand, one hundred (1,100) square feet, exclusive of
garages, breezeways, and porches.

units one thousand, six hundred, fifty (1,650) square feet, and (6)
fifteen percent (15%) of units one thousand, five hundred, fifty,
(1,550) square feet, and (7) fifteen percent (15%) of units one
thousand, four hundred, fifty (1,450) square feet.

hundred (100) feet.

1. tel: This Tract is designated for single family dwellings on separate
lots under separate ownership. The maximum number of dwelling units in
this Tract shall not exceed ninety-two (92).
2. use Rgoalations: A building or premise shall be used only for the
following purposes:
a. Two family attached units when developed under standards submitted as
site plan within the documents.
b. Attached dwelling units, provided that no more than two (2) dwelling
units are attached in one continuous row or group, and provided that no
dwelling unit is constructed above another dwelling unit.
3. Height Reaalations:_No building shall exceed thirty (30) feet or two and
one-half (2 1/2) stories in height.
a. Size of Yards:
(1) Front Yard - There shall be a front yard having a required depth
of not less than twenty (20) feet. No required parking shall be
allowed within the required front yard.
(2) Side Yard - There shall be a side yard on each side of the twin
plex buildings of not less than four (4) feet. A side yard
adjacent to a side street shall not be less than fifteen (15)
feet, even when a side yard is across from a front yard, the side
yard shall be fifteen (15) feet.
(3) Rear Yard - There shall be a rear yard having a depth of not less
than ten (10) feet.
b. Size of Lot:
(1) Lot Area - No unit shall be constructed on any lot less than three
thousand, five hundred (3,500) square feet. Such lot shall have a
minimum buildable area of two thousand, two hundred, fifty ( 2,250)
square feet.
(2) Lot Width - The width of the lot shall not be less than thirty-
five (35) feet at the front street building line.
(3) Lot Depth - The depth of the lot shall not be less than one
hundred (100) feet.
