AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, CREATING
THE LIBRARY COLLECTONS ACQUISITION FUND; REQUIRING A
GENERAL PLAN FOR ITS EXPENDITURE; AND PROVIDING FOR ITS
ACCOUNTANCY.
WHEREAS, on January 20, 1979, qualified voters in the City did adopt a City
Charter
establishing
the City
of Allen as a
Home
Rule City,
which
according to
Vernon's
Texas Civil
Statutes
Article 1175(3)
allows
the City "to
hold
by gift, deed,
devise, or otherwise any character of property, including any charitable or trust fund";
and,
WHEREAS, the same City Charter establishes in its own Article III, Section C a
Library Department to administer a free public library within the City, and a Library
Board to provide supervisory guidance to all library functions; and,
WHEREAS, the City Council of the City of Allen did pass Ordinance No.
418-11-82 establishing the duties and responsibilities of the Library Board, to include
the solicitation of gifts and donations to the Library subject to the approval of the City
Council; and,
WHEREAS, the 1985 Capital Improvements Bond Program approved by the voters
of the City of Allen included $2.5 million to construct and equip a new library facility;
and,
WHEREAS, the Allen Public Library Board aspires to raise $1.0 million in
donations from private sources for the expansion of the Library's collections of books,
periodicals and other holdings; and,
WHEREAS, these collections are desirable for the edification and well-being of
Allen residents of all ages; and,
WHEREAS, the Library Board wishes to assure potential donors that City
officials and employees will be compelled to spend their gifts strictly for library
purposes;

NOW, THEREFORE, IN CONSIDERATION OF THESE RECITALS, THE
CONTENT OF WHICH IS INCORPORATED HEREIN, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT:
SECTION 1. Establishment of
Trust
Fund. There is hereby
created an
expendable trust fund known as the
Library
Collections Acquisition Fund
which shall
hold money donated to the fund from private sources for the expressed purpose of
purchasing library materials.
SECTION 2. Spending Authority. The Library Board shall recommend to the
City Council a general plan for the expenditure of donations to the Fund. Approval of
this plan by the Council shall constitute prior authorization for the Library Director to
purchase library materials. No expenditure of these funds shall be made except in
compliance with the adopted plan, unless amendment to the plan is recommended by the
Library Board and approved by the City Council.
SECTION 3. Accounting. The City Finance Director shall receive all donations
to the Fund as with all other City money, but shall account for the Fund separately
from all other funds so that all donations will be shown as expenditures for library
materials. The Finance Director will prepare such a report for the Library Board on a
quarterly basis. Interest shall accrue to the Fund at a rate equal to that earned by
other funds through City investments.
