"DEFINITIONS"; DEFINING "JUNKED MOTOR VEHICLE" PURSUANT TO THE PROVISIONS OF SECTION 5.01(5), ARTICLE 4477-9a, V.T.C.S.; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Allen, Texas, finds it necessary to amend Ordinance No. 353, and Chapter 9, "Motor Vehicles and Traffic, Article XII, "Abandoned Vehicles, Section 9-321, "Definitions", of the City of Allen Code of Ordinances, so as to conform with the definition of "junked vehicle" as said term was redefined by amendment of Section 5.01(5), Article 4477-9a, V.T.C.S.; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1. The term "Junked motor vehicle", as defined under Section 3 of Ordinance No. 353, and Chapter 9, "Motor Vehicles and Traffic", Article XII, "Abandoned Vehicles", Section 9-321, "Definitions", of the City of Allen Code of Ordinances is hereby amended in the following manner and shall read as follows, to -wit: "Junked motor vehicle": Any motor vehicle as defined in VTCS Article 6701d-11 which: (1) Is inoperative; and (2) Does not have lawfully affixed to it either an unexpired license plate or a valid motor vehicle safety inspection certificate, is wrecked, dismantled, partially dismantled, or discarded, or remains inoperable for a continuous period of more than 45 days. SECTION 2. This ordinance shall be in full force and effect immediately from and after its adoption.
