AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 366-
10-81, OF THE CITY OF ALLEN AS HERETOFORE AMENDED, AND
AMENDING ORDINANCE NO. 458-9-83, AS HERETOFORE AMENDED,
AND BEING DESCRIBED AS "PD" PLANNED DEVELOPMENT NO. 12, TO
ESTABLISH "FP -PD" FLOOD PLAIN -PLANNED DEVELOPMENT ZONING
ON 88.418 ACRES DESCRIBED AS A PORTION OF TRACTS 1, 2, AND 3,
AND ALL OF TRACTS 4 AND 5 IN EXHIBIT "D" ATTACHED HERETO,
AND TO INCLUDE AN ADDITIONAL 14.728 ACRES PRESENTLY ZONED
"A-0" AGRICULTURE -OPEN SPACE, DESCRIBED IN EXHIBIT "D"
ATTACHED HERETO, AND BEING A PORTION OF TRACTS 1, 2, AND 3,
OUT OF THE SIMON BURNS SURVEY, ABSTRACT NO. 92, AND THE
JOHN DAVIS SURVEY, ABSTRACT NO. 255, COLLIN COUNTY, TEXAS;
PROVIDING FOR USE AND AREA REGULATIONS, OPEN SPACE
REGULATIONS, AND A DEVELOPMENT POLICY AS DESCRIBED IN
EXHIBIT "D" ATTACHED HERETO; PROVIDING FOR A PENALTY OF
FINE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS
($19000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY
CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF SAID
ORDINANCE.
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, in compliance with the laws of the State of Texas and the ordinances of
the City of Allen, have given the requisite notice by publication and otherwise; and,
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, have held due hearings and afforded a full and fair hearing to all the
property owners, generally, and to all persons interested and situated in the affected
area, and in the vicinity thereof; and,
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Allen, in the exercise of its legislative discretion, have concluded that Planned
Development Zoning Ordinance No. 458-9-83 should be amended to include the
attachments of Exhibit "D", property description, and approved use and area
regulations, open space regulations and development policy, for development of a
88.418 acre tract of land and 14.728 acre tract of land out of the John Davis Survey,
Abstract No. 225 and Simon Burns Survey, Abstract No. 92, Collin County, Texas,
located east of Allen Heights Drive and south of F.M. 2170, presently delineated on the
Official Zoning Map as PD No. 12.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS:
SECTION 1. That Planned Development Zoning Ordinance No. 458-9-83 of
the City of Allen, Texas, is hereby amended to include the attachments of Exhibit "D",
property description, and approved area regulations, open space regulations and
development policy, for development of a 88.418 acre tract of land and 14.728 acre
tract of land out of the John Davis Survey, Abstract No. 225 and Simon Burns Survey,
Abstract No. 92, Collin County, Texas, located east of Allen Heights Drive and south of
F.M. 2170, presently delineated on the Official Zoning Map as PD. No. 12.
SECTION 2. That all ordinances of the City of Allen in conflict with the
provisions of this ordinance be, and the same are hereby, repealed; provided, however,
all other provisions of said ordinances not in conflict herewith shall remain in full force
and effect.
SECTION 3. That the land use plan described in Exhibit "D" attached hereto
and made a part hereof for all purposes shall be adhered to in its entirety for the
purposes of development of Tracts 1, 2, 3, 4, and 5 as described therein.
SECTION 4. That the use and area regulations, open space regulations, and
development policy as described in Exhibit "D" attached hereto and made a part hereof
for all purposes, shall be the governing regulations for "PD" Planned Development No.
12 on Tracts 1, 2, 3, 4, and 5, defined therein.
SECTION 5. That any person, firm, or corporation violating any of the
provisions or terms of this ordinance shall be subject to the same penalty as provided
for in Planned Development Zoning Ordinance No. 370-10-81 of the City of Allen and
upon conviction shall be punished by a fine not to exceed the sum of $1,000.00 for each
offense.
SECTION 6. That it appears the above-described property requires site plan
approval in order to permit its proper development and, in order to protect the public
interest, comfort, and general welfare of the City of Allen, creates an urgency and an
emergency for the preservation of the public health, safety, and welfare, and requires
that this ordinance shall take effect immediately from and after its passage and the
publication of the caption of said ordinance as the law in such cases provides.

SHADOW INTRODUCTION
LAKES
The Shadow Lakes is a proposed planned development district that was
originally part of a 145 Acre tract of land approved in September of 1983,
further known as planned development No. 12 aspermitted under the land
development regulations of the City of Allen Texas. _
This document is an amendment to the P.D. District incorporating the 14.72
acres of agricultural zoning. Zhe request is for the purpose of incorporating
all concerned properties into a whole. This will stimulate a well planned low
density residential district with small percentage of ancillary zoning and uses
to provide for the key mix to inhance marketable and cohesive community
development.
The following items represent primary elements and highlights of the proposed
zoning request. The details of each element are provided in the submittal
package.
I. Acquiring the 14.72 acres of land to provide for a more balanced
property as an whole. with that acquisition this will eliminate the
potential financial burden to the City of Allen for Development of 1500
lineal feet of frontage of Allen Heights Road at an estimated cost of
$425,000.
II. Providing a innovative and marketable planned development that will be
able to absorb and afford the tremendous infrastructure costs of Allen
Heights Road and that will experience pleasantly paced development and
roof tops. Incorporating flexible planning techniques and product
variation that is sensative to the market in present tense and future
tense.
III. Dedication of open space to the City of Allen with committment for the
developer to improve the open space to provide for a passive park with
a jogging path, benches, and a station excercise -course to be developed
and donated to the City of Allen.
IV. Establishment of roadway design along the open space for the community
as a whole to enjoy.
V. Committment of rear entry product design f or al l ey use and sery ice
only.

VI. Development schedule eosmmittment for the construction of Allen Heights
Drive.
VII. Documents that provide the City with restricted controls for any and
all future users and developers.
VIII. SUMMARY OF REQUEST
1. Allowance of Garden Office uses.
2. . Allowance of approximately 10% variance increase of low density
residential units.
IX. SUMMARY OF PLANNED DEVELOPMENT PROVISIONS
1. Acquisition of Atkinson Parker property to insure a major frontage
of Allen Heights to be constructed by the Developer.
2. Development schedule committment of the development of Allen
Heights Road from the eastern property to Bethany Road, and
development of Hillside Drive fronting our property north of Allen
Heights Drive.
3. Dedication of open space and committment of improvements for
dedication to the City of Allen.
This proposed Planned Development will strengthen Bass Devel%ments continued
committment to quality in the City of Allen, with the Shadow I,--ikes development
being an enormous challenge with the strongest possibity of rewards in final
product for the City of Allen and Bass Development.

The property is located on the South side of Allen Heights
Drive, a major six -lane divided thoroughfare and on the West side
of same mentioned thoroughfare. --The property. is directly
accessible to F.M. 2170 an eventual six -lane divided thoroughfare
that transports a direct feed to S.H. 75.

COMPREHENSIVE LAND PLAN ANALYSIS
As stipulated in the newly approved City of Allen Comprehensive Plan, the
following quidelines are encouraged for this district.
A. This land use category is intended for development of mixed density
residential neighborhoods. It provides for flexibility of specific
locations and uses within the neighborhood provided tract design
principles and development policies of the City are maintained and
provided uses fall within the maximum 1 ev el s of the control totals and
as acceptable density 1 ev el s to the City.

A. Residential development in Allen should continue to be based on the
neighborhood concept. In this concept a residential neighborhood is
assumed to be bounded by major arterial streets, and may consist of a
number of properties or subdivisions. Development should occur as
follows: retail, commercial or office at the intersections of the
major streets, based on economic need to serve the neighborhood, and
multi -family units, retirement housing or housing for the elderly in
close proximity to the ccu mercial area where services and facilities
are conveniently available. School/park facilities should be centrally
located to the neighborhood, with residential uses designed around the
facilities. Both medium density and high-density uses should be
carefully located in groupings along the major thoroughfare and
adjacent to commercial or office uses. For each neighborhood, public
and semi-public uses such as churches would locate along the major
thoroughf ares.
A. The property falls within planning area No. 25 and 26, approximately 11
acres being located in Area No. 25, which involves 1.4% of that
district and approximately 92 acres in District No. 26 which involves
10.3% of that district.

The proposed land plan provides for low density residential
neighborhood development with the flexibility of product use.
The dominance of the open space amenity allows for the scenic
drive development along its corridor which encourages community
accessibility and use. The major thoroughfare of Allen Heights
and its transportation characteristics encourage_ small pockets of
neighborhood oriented garden office uses with the natural
division of the property by the open space feature and limited
depth and area from Allen Heights Drive further encourages this
design philosophy.

1. PURPOSE
LAND USE REGULATIONS
Zhis district is intended for low density residential uses. Planning
techniques will involve traditional single family detached, residential
designs with variations of lot sizes ranging from 5000 S.F. to 9000
S.F.. This district wi11 allow a maximum of 373 units.
2. Side Yards
A side yard provided whereas a separation of ten (10') feet is always
maintained between structures. A side yard adjacent to a side street
shall not be less than fifteen (15) feet, even when a side yard is
across frau a front yard, the side yard shall be f if teen (15) feet.

3. Use Regulations
Single family detached units and accessory uses custcmarily incidental
to the use. Churches and Church related uses as permitted by special
use permit.
4. Height Regulations
No building shall exceed thirty (30) feet or two and one-half (2 1/2)
stories in height.

7. Lot Coverage
In no case shall more than fifty-five (55) percent of the total lot
area be covered by the combined area of the main buildings and
accessory buildings.
8. Building Regulations
All main buildings shall have exterior construction of a minimum of 75%
brick, tiles, cement, concrete, stone, or similar materials.
1. Purpose
This district is intended for office uses not dependent upon retail
trade or retail traffic for their operation. This district is designed
to permit the location of offices of any profession, trade, or service
near their clients and minimize the effect upon residential and
commercial areas. The heights setback, sign controls, and parking
regulations are intended to allow flexibility in design and maintain
aesthetics and neighborhood quality.

2.' Use Regulations
a. Professional Administrative Offices where services are provided
only and no chattels or goods are offered for sale on the premises,
including, but not limited to doctors, dentists, attorneys,
architects, engineers, insurance, real estate, and similar offices.

d. Restaurants: Development of attached and free standing quality
restaurant facilities with NO ERIVE THROLEH OR FAST FOOD FACILITIES
to be allowed All architectural design of office and restaurants
to be consistent in character and flavor. City of Allen site plan
approval will be required prior to obtaining building permits. All
free standing restaurants will require Specific Use Permits and
site plan approval.
e. Accessory buildings and uses customarily incident to any of the
above uses.
f. Such uses may be permitted under provisions of Section 2.06,
Specific Use Permits.
3. Height Regulations
The maximum height for the main building shall be two (2) standard
stories, but shall not exceed thirty (30) feet in height, provided that
any building or portion thereof may be erected above said limit if
setback frau all street lines and required yard lines is one (1) foot
for each one (1) foot of its height above such limit. In no event,
however, shall any building exceed one (1) standard story when located
within fifty (50) feet of any property zoned for residential purposes.
4. Area Regulations
a. Size of Yards:

(a) There shall be a minimum front yard having a depth of not less
than one hundred (100) feet adjacent to any street with a
right-of-way of one hundred (100) feet or more.
(b) There shall be a minimum front yard having a depth of not less
than twenty-five (25)' feet adjacent to any street with a

Development of the Shadow Lakes Community is a long term developer
com dttment for a total buildout and development. Below are the policies and
ccnmittments for initial construction and future phases.
I. Construction to begin on Allen Heights Road from the existing
conditions on the east side of the property to Park Place Drive
eighteen (18) months after Ordinance Adoption, or when first phase
of development commences which ever occurs f i rst.
II. Construction to begin on two lanes of Allen Heights Drive on the
eastern boundary of our property frau Park Place Drive to Bethany
Road. Construction to commence thirty six (36) months after
ordinance adoption.
III. Development of open space to commence in conj unction with first

OONCLUSIONS
Based on the results of this traffic study for the planned development,
the following conclusions can be drawn:
-- The proposed development will generate an estimated -6991 vehicle trips
per day, but due to the mixed-use nature of the development, an
estimated 10 percent (10%) of the site generated traffic will be
internally satisfied and will not impact the proposed thoroughfare
system.
-- The proposed thoroughfare system will accommodate, at better than LOS
"C" conditions, the projected traffic generated by the proposed
development as well as the traffic projected to occur after build -out
of neighborhood districts 25 and 26.
-- The projected traffic conditions expected to exist in the year 2010
(build -out condition) indicates that there will be additional LOS "C'
capacity available on the proposed thoroughfare system ranging from
13,776 to 28,896 vehicles per day.

''p�THIS ROAD AND OPEN SPACE AGREEMENT is entered into as of the
� day of February, 1987, by 2170 South -Development Co., a Texas
Ji t
oVenture (the "Developer") for the benefit of the City of
Allen, Texas (the "City"), on the terms and conditions hereinafter
set forth.
The following Recitals of fact are true and correct:
RECITAL A. Developer is the owner of that certain undeveloped
tract of land located in the City of Allen, Collin County, Texas,
as more particularly described in Exhibit "A" attached hereto and
made a part hereof for all purposes a Developer's Tract").
RECITAL B. Attached hereto and made a part hereof for all
purposes" a plat (the "Plat") showing the general location of
Developer's Tract and the proposed improvement and extension of
Allen Heights Drive from the most northeasterly corner of
Developer's Tract extending to its intersection with existing
Bethany Drive. Portions of such improved Allen Heights Drive will,
it is contemplated, be completed and developed over a period of
years.
RECITAL C. City, as a condition to granting certain pending
zoning applications made by Developer, has required that the
Developer give assurances to the City, as represented by this
Agreement, concerning: (i) the construction and payment for both
sides (together with related water lines and grading) of Allen
Heights Drive from the existing conditions on the east side of
Developer's Tract to Park Place Drive ("Allen Heights - First
Phase"); (ii) the construction and payment for that portion of
Hillside Drive lying north of Allen Heights Drive to the extent it
is adjacent to Developer's Tract ("Hillside Drive") and (iii) the
dedication and development of the open space as set out in the
zoning application (the "Open Space"). (All of the obligations
described in this Recital are herein referred to as "Developer's
Obligations").
RECITAL D. In order to insure the City that Developer's
Obligations will be performed and paid for, Developer has agreed to
enter into this Agreement and to subject Developer's Tract to the
terms and provisions hereof.
NOW, THEREFORE, for and in consideration of the premises,
Developer hereby covenants and agrees with the City as follows:
1. Developer agrees that it will commence the on-site work
for: (i) Allen Heights - Phase One on or before the earlier of
eighteen (18) months from the date the City adopts the final zoning
ordinance referred to in Recital C or when the development of the
first phase of Developer's Tract commences; (ii) Hillside Drive on
or before thirty-six (36) months from the date the City adopts the
final zoning ordinance referred to in Recital C; and (iii) Open
Space on or before the development of the First Phase of
Developer's Tract. After commencement of each such project,
Developer will prosecute such work to conclusion in a good and
workmanlike and timely manner (subject to delays beyond Developer's
control) and will pay for the cost of such work and improvements.
2. Developer hereby covenants and agrees that Developer's
Tract is and shall be subject to the perpetual and continuing
obligation for the performance and payment of Developer's
Obligations. The terms and provisions of this continuing Agreement
which burden and affect Developer's Tract shall be covenants
running with Developer's Tract and shall be binding upon any and
all successors, assigns and transferees of all or any part of
Developer's Tract.
3. Notwithstanding any provision hereof to the contrary,
this Agreement and the rights and benefits herein created or
granted to the iCity are and shall be expressly subject and
subordinate to any first lien financing which the Developer, or its
successors or assigns, may now have or hereafter obtain for the
acquisition, development or improvement of all or any part of
Developer's Tract, including but not limited to, the first lien
position of The First State Bank, Abilene, Texas. It is expressly
agreed by and between the City and Developer that the rights and
obligations created under this Agreement are not, and shall not, be
binding on The First State Bank, Abilene, Texas. However, nothing
contained herein shall be construed to limit and/or subordinate any
statutory assessment rights of the City.
4. Developer's Obligations shall be completed and con-
structed in accordance with the applicable ordinances, statutes,
rules, codes and regulations of the City of Allen.
5. The improvements shall be deemed to be completed for
purposes of thislAgreement upon the issuance of the City of Allen
of its letter accepting the improvements for maintenance.
6. Any reblates or pro-ratas attributable to the Developer's
Obligations shall belong to and be paid over to Developer or the
successor party performing Developer's Obligations.
7. The terms and conditions of this Agreement shall be
binding upon and inure to the benefit of the successors and assigns
of the parties hereto.
8. Any notice required or permitted to be given hereunder
shall be deemed to be delivered, whether actually received or not,
when hand -delivered or when deposited in the United States mail,
postage fully prepaid, registered or certified mail, addressed to
the intended recipient at the address on the signature page of this
Agreement. Any address for notice may be changed by written notice
so given, provided that any such change of address shall be
effective only upon receipt thereof by the recipient.

9. Upon the performance in full of Developer's Obligations,
the City will execute a recordable release of this Agreement.
