Home My WebLink AboutO-921-5-89ORDINANCE NO. 921-5-89 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 829-11-87, AS PREVIOUSLY AMENDED, AND ORDINANCE NO. 802-8-87 AS DELINEATED ON THE OFFICIAL ZONING MAP AS PLANNED DEVELOPMENT NO. 46, SO AS TO CHANGE TRACTS 1, 2 AND 3 BY INCREASING THE COMMUNITY FACILITIES ZONING AS DESCRIBED IN EXHIBIT "C" ATTACHED HERETO, SAID TRACT OF LAND BEING DESCRIBED AS APPROXIMATELY 33.60 ACRES LYING IN THE WILLIAM PERRIN SURVEY, ABSTRACT NO. 708, AND THE GEORGE W. FORD SURVEY, ABSTRACT NO. 328, COLLIN COUNTY, TEXAS; PROVIDING FOR AN AMENDED LAND USE PLAN; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notices by publication and otherwise; and, WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen have held due hearings and afforded a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in the exercise of its legislative discretion, have concluded that the Land Use Plan of Ordinance No. 802-8-87 shall be amended to allow an increase in the Community Facilities zoning by decreasing Multi -Family and Garden Office tracts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That from and after the effective date of this Ordinance, the the Land Use Plan attached as Exhibit "A" to Ordinance No. 802-8-87 is hereby amended to reflect the Land Use Plan in Exhibit "C" attached hereto. SECTION 2. That all ordinances of the City of Allen in conflict with the Ordinance No. 921-5-89 - Page 1 provisions of this ordinance shall be, and the same hereby are, repealed; provided, however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 3. That the Land Use Plan described as Exhibit "C" shall remain the governing plan for PD No. 46, being Ordinance No. 802-8-87. SECTION 4. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Ordinance No. 802-8-87 and Comprehensive Zoning Ordinance No. 829-11-87, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense.
