AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS
AMENDING THE CITY OF ALLEN CODE OF ORDINANCES, CHAPTER 6,
"HEALTH AND ENVIRONMENT," ARTICLE III, "SOLID WASTE," SECTION
6-51, "DEFINITIONS," SECTION 6-57, "RESIDENTIAL COLLECTION -
GENERALLY," SECTION 6-58, "SAME-FESS,"AND SECTION 6-60, "SAME -
FEES," BY APPROVING RATE INCREASES AND ADOPTING AN EXHIBIT
"A" AND ATTACHING TO AND MADE A PART OF SAID ORDINANCE; AND
PROVIDING FOR AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS, THAT:
SECTION 1. From and after the effective date of this Ordinance, Chapter 6, "Health
and Environment," Article III, "Solid Waste," Section 6-51, "Definitions," of the City
of Allen Code of Ordinances is hereby amended by adding the following definitions,
which shall read:
"'District' shall mean the North Texas Municipal Water District.
'Recyclable Materials' shall mean post -consumer products that are not
landfilled or incinerated, but diverted from the waste stream for reuse or
renrocessinLT as another Aroduct.
'Solid Wastes' shall mean garbage, refuse, decayed wood, sawdust,
shavings, bark, sand, lime, cinders, ashes, offal, tar, or any other solid or
semi-solid substance that may cause impairment of the quality of water. The term
is intended to mean and include only those substances which are normally
expected to be collected as garbage by cities, and does not include recyclable
materials, hazardous waste or other materials that are not readily and legally
subiect to ordinary landfill disposal."
SECTION 2. That from and after the effective date of this Ordinance, Chapter 6,
"Health and Environment," Article III, "Solid Waste," Section 6-58, "Same -Fees," of the
City of Allen Code of Ordinances is hereby amended in the following manner and shall
read as follows, to -wit:
"See. 6-58. Same -Fees.
The collection and removal of garbage, rubbish and brush in
disposable bags from residential premises, two (2) times per week shall
be made for a fee charge of si e4oll<ars•an&Fif-ty--fout-een#-a{$-{r.64-) seven
dollars and twenty-four cents ( $7.24) per residential unit for each
calendar month. Multi -family dwellings (four (4) or more units) shall use
commercial containers provided the contractor. For partial months, said
charges shall be pro -rated for each day of the month during which such
service is available and provided to the customers. There shall be a fee
charge for extra collections necessary for the collection of unusual
accumulations. An increase in monthly fees may be made upon approval
of the City Council. The charges for collection service shall be included
on the monthly utility bill of the occupant. All utility customers shall

receive solid waste collection service. Rates and charges shall be due
and payable on the date so indicated on the utility and solid waste bill.
Should the amount due on the date so indicated not be paid in full, a ten
percent penalty shall be added to the amount due and unpaid. A
customer's utility deposit shall be applied for payment of the customer's
final solid waste bill only after satisfying all amounts owing for water and
sewer s
SECTION 3. That from and after the effective date of this Ordinance, Chapter 6,
"Health and Environment," Article III, "Solid Waste," Section 6-60, "Same -Fees,"
of the City of Allen Code of Ordinances is hereby amended in the following manner
and shall read as follows, to -wit:
"Sec. 6-60. Same -Fees.
The service charge for commercial and institutional collections
shall be based on the frequency of collection necessary in the amount
regularly collected. The minimum charge shall be twelve dollars and fifty
cents ($12.50) per month.
There shall be a fee charge for extra collections necessary for the
collection of unusual accumulations. The Contractor will provide service
for categories of collection for which fees are established. The rates
charged and collected by the City shall be in accordance with the rate or
fee schedule attached to the Ordinance from which this section is derived
as Exhibit "A" and made a part hereof for all purposes . "
SECTION 4. That all Ordinances of the City of Allen in conflict with the provisions
of this Ordinance shall be, and the same are hereby, repealed; provided, however,
all other provisions of said Ordinances not in conflict here with shall remain in full
force and effect.
SECTION 5. That this Ordinance shall take effect February 1, 1991.
