ORDINANCE NO. 1037-6-91 03 1 1 5 5
AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
ACCEPTING THE IMPROVEMENTS ON A PORTION OF F.M. 2170, FURTHER
DESCRIBED AS BEING PORTIONS OF F.M. 2170 FROM U.S. 75 TO ALLEN
DRIVE, MCDERMOTT DRIVE FROM ALLEN DRIVE TO A POINT 360 FEET
EAST OF THE RIGHT-OF-WAY LINE OF DOGWOOD DRIVE, DOGWOOD DRIVE
FROM MAIN STREET TO MCDERMOTT DRIVE, AND MAIN STREET FROM
DOGWOOD DRIVE TO S.H. 5, IN THE CITY OF ALLEN, COLLIN COUNTY,
TEXAS; PROVIDING FOR THE ATTACHMENT OF EXHIBIT "A" CORRECTING
THE ROLLS AND ESTIMATES THEREOF; DECLARING AN EMERGENCY; AND
PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY
UPON ITS PASSAGE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
SECTION 1: That a portion of F.M. 2170, further described as being portions of F.M. 2170 from
U.S. 75 to Allen Drive, McDermott Drive from Allen Drive to a point 360 feet east of the right-of-
way line of Dogwood Drive, Dogwood Drive from Main Street to McDermott Drive, and Main Street
from Dogwood Drive to S.H. 5, in the City of Allen, Collin County, Texas, has been improved in
accordance with the plans and specifications thereof and as required by contract. The Department of
Engineering has examined and inspected the completed improvements and it is hereby found that said
work and improvements have been performed and completed in compliance with the terms of said
contract and are hereby accepted and approved by said City Council.
SECTION 2: . That the City of Allen hereby approves the corrected Engineer's Roll and completes
the.levying of assessments as described in Schedule "A" attached hereto and made a part hereof.
SECTION 3: That from and after the effective date of this ordinance, the time and manner
proposed for payments shall be in accordance with City of Allen Ordinance No. 897-1-89.
SECTION 4: That the City Manager is hereby authorized and directed to initiate or cause to be
initiated procedures to collect the first and subsequent installments in accordance with the terms of
Ordinance No. 897-1-89, Section 7, with regard to the prescribed assessments.
SECTION 5: That in order to protect the public interest, comfort and general welfare of the City
of Allen, the adoption of this ordinance creates an urgency and an emergency for the preservation of
the public health, safety and welfare, and requires that this ordinance shall take effect immediately
from and after its passage and the publication of the caption of said ordinance as the law in such cases
provides.
