AN ORDINANCE OF THIN CITY OF ALLEN, COLLIN COUNTY, TEXAS,
DECLARING AN EMERGENCY AND AMENDING THE CITY OF ALLEN
FISCAL YEAR 1993-94 OPERATING BUDGET BY INCREASING GENERAL
FUND REVENUES FROM UNANTICIPATED ROLLBACK TAXES,
AUTHORIZING AN INCREASE IN EXPENDITURES IN THE COA04UNITY
DEVELOPMENT DEPARTMENT' BUDGET TO FACILITATE AN INCREASE IN
THE NUMBER OF CODE ENFORCEMENT OFFICERS FROM TWO TO THREE
IN ACCORDANCE WITH ARTICLE IV, SECTION 4.08, OF THE ALLEN CITY
CHARTER; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR
TBEEFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the City Council of the City of Allen, Texas, has found and determined that the
tremendous increase in residential and commercial construction could not reasonably have been foreseen
in the normal process of planning the budget; and,
WHEREAS, the City Council has determined that extreme emergency conditions exist because of the
limited number of code enforcement officers available to provide building inspections for the increased
construction; and,
VAHERF.AS, the City Council has determined that additional code enforcement personnel will assist and
benefit the general welfare of the citizenry; and,
WHEREAS, the City Council has determined that the City of Allen has benefitted from an additional
$160,595 in unanticipated rollback taxes; and,
VIIIEREAS, the City Council of the City of Allen, Texas, has determined that its action to amend the
budget is in accordance with Article IV, Section 4.08, of the Allen City Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT:
SECTION 1: The 1993-94 Operating Budget of the City of Allen, Texas, be, and hereby is, amended
by increasing general fund revenues by adding unanticipated rollback taxes in the amount of $160,595.
SECTION 2: Additional expenditures be authorized in the Department of Community Development
budget in the amount of $19,335.
SECTION 3: Additional personnel be authorized in the Department of Community Development by
increasing the number of code enforcement officers from two to three.
SECTION 4: An emergency exists for the purpose of amending the 1993-94 Operating Budget in
accordance with Article IV, Section 4.08, of the Allen City Charter, in order to benefit the general
welfare of the citizenry.
SECTION 5: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause,
sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or
decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any
other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had known the affected parts
would be held unconstitutional.
SECTION 6: This ordinance, upon its passage, shall become an attachment to the City of Allen 1993-
94 Operating Budget.
SECTION 7: This ordinance shall take effect from and after its passage.
