Items of Interest 2.1 Discuss Allen Land Development Code updates regarding the Central Business District. 2.2 Committee updates from City Council Liaisons. Regular Meeting 1. Call:to Order and Announce a Quorum is Present With a quorum of the Allen City Council present, the Regular Meeting of the Allen City Council was called to order by Mayor Fulk at 7:03 p.m.on Tuesday,October 25,2022,in the City Council Chambers of Allen City Hall, 305 Century Parkway,Allen,Texas. 2. Pledge of Allegiance 3. Citizens' Comments Mayor Fulk recognized a Boy Scout from Troop #131 in attendance for the Citizenship in the Community merit badge. 4. Public Recognition 4.1 Allen Economic Development Performance Overview and Update by Insight Research Corporation. 5. Consent Agenda MOTION: Upon a motion made by Councilmember Clemencich and .a second by Councilmember Corvette,:the Council voted seven (7) for and none (0) opposed, to approve all items on the Consent Agenda as follows: 5.1 Approve,minutes of the October 11,2022,Regular City Council Meeting. 5.2 Adopt an Ordinance amending Ordinance No. 3925-7-22 amending the appointment schedule for members of the Community Engagement Advisory Board and the date for the annual organization meeting of the board. ORDINANCE NO. 3963-10-22: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING.ORDINANCE NO. 3925-7- 22 AMENDING THE APPOINTMENT SCHEDULE FOR THE COMMUNITY ENGAGEMENT ADVISORY BOARD; AMENDING THE DATE FOR THE ANNUAL ORGANIZATION MEETING FOR THE COMMUNITY ENGAGEMENT ADVISORY BOARD; CLARIFYING AND AFFIRMING THE APPOINTMENTS TO THE COMMUNITY ENGAGEMENT ADVISORY BOARD; PROVIDING A SEVERABILITY CLAUSE;AND PROVIDING AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING OCTOBER 25,2022 PAGE 3 5.3 Award bid and authorize the City Manager to execute an agreement with J.R.Stelzer for Rowlett Water Tower.and Custer Ground#2 exterior repaint and minor tank repairs for $1,514,270. 5.4 Award bid and authorize the City Manager to execute agreements with Full Facilities Services, LLC, as the primary vendor of temporary personnel for building operations and conversions at Credit Union of Texas Event Center for$325,000 and D&A Building Services,Inc.,as the secondary vendor,each with options for two,one-year renewals. The motion carried. 6. Regular Agenda 6.1 Conduct a Public Hearing and adopt an Ordinance to amend the Development Regulations of Planned Development No. 54 with a base zoning of Community Facilities and adopt a Concept Plan, Building Elevations, and Landscape Plan for a Property generally located southwest of Exchange Parkway and Junction Drive. [Medical Offices —NTMWD] The applicant requested a continuance for this item. Mayor Fulk opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. There were no speakers. MOTION: Upon a motion made by Councilmember Shafer and a second by Mayor Pro Tem Schulmeister, the Council voted seven (7) for and none (0) opposed to continue the Public Hearing to 7:00 p.m. on November 8,2022. The motion carried. 6.2 Conduct a Public Hearing and adopt an Ordinance to amend the Allen Land Development Code by amending Section 8.02.1, "Jurisdiction" and by adding Section 8.03.9 "Conveyance Plats" to allow the processing of conveyance plats and establishing standards for conveyance plats. Mayor Fulk opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking,Mayor Fulk closed the Public Hearing. ORDINANCE NO. 3964-10-22: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING ARTICLE VIII "SUBDIVISION REGULATIONS" OF THE ALLEN LAND DEVELOPMENT CODE, AS AMENDED, BY AMENDING .IN ITS ENTIRETY SECTION 8.02.1 "JURISDICTION" AND ADDING SECTION 8.03.9 "CONVEYANCE PLATS" REGARDING THE PROCESSING AND ESTABLISHING OF STANDARDS FOR CONVEYANCE PLATS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO ALLEN CITY COUNCIL REGULAR MEETING OCTOBER 25,2022 PAGE 4 111 THOUSAND ($2,000) DOLLARS FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Shafer and a second by Councilmember Corneae,the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3964-10-22, as previously captioned, to amend the Allen Land Development Code to allow the processing of conveyance plants and establishing standards for conveyance plats. The motion carried. 6.3 Adopt a Resolution establishing an application fee for conveyance plat.applications. RESOLUTION NO.3965-10-22(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING A CONVEYANCE PLAT APPLICATION FEE PURSUANT TO ALLEN LAND DEVELOPMENT CODE SECTION 8.03;PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Meis and a second by Councilmember Trahan, the Council voted seven (7) for and none (0) opposed to adopt Resolution No. 3965-10-22(R), as previously captioned,to establish an application fee for conveyance plats. The motion carried. 6.4 Award bid and authorize the City Manager to execute a contract with A&C Construction, Inc.,for$358,830,and a contract with Phoenix I Restoration and Construction,LLC,for $1,161,900 for construction improvements at the Allen Heritage Village. Although not a public hearing,Mayor Fulk asked anyone wishing to speak regarding this item to do so at this time. Paula Ross spoke in support of this item. MOTION: Upon a motion made by Councilmember Clemencich and a second by Councilmember Corneae,the Council voted seven(7)for and none-(0)opposed to award bid and authorize the City Manager to execute a contract with A&C Construction, Inc., for the construction of the Allen Heritage Pavilion in an amount of$358,830, and to execute a 9ontract with Phoenix I Restoration and Construction, LLC, for the construction improvements of the Allen Heritage Village in an amount of$1,161,900. The motion carried. 7. Other Business 7.1 Calendar. • October 24—November 4—Early Voting Period for the November 8 Election. • October 27 — Joint Council Workshop with the Community Development Corporation, Allen Senior Center, 6 p.m. • November 2 — State of Allen Luncheon, Marriott Dallas I Allen Hotel and Convention Center, 11 a.m. • November 5—Allen Recycles Day,Allen City Hall, 8 a.m.— 12 p.m. • November 8—Election Day ALLEN CITY COUNCIL REGULAR MEETING OCTOBER 25,2022 PAGE 5 7.2 Items of Interest. • Councilmember Cornette invited the public to attend the Pat Rogers "Bad Boys, Desperados, and Outlaws of Collin County" program at the Allen Heritage Center at 6:30 p.m. on November 2. • Council wished happy birthday to Councilmember Shafer. • Mayor announced All Community Outreach as his Charity of the Month. • Councilmember Trahan congratulated City Secretary George as the recipient of the 2022 Texas Municipal Clerk of the Year and the Distinguished Service Award. 8. Executive Session (As needed). 8.1 Reconvene and consider action on items resulting from Executive Session. The Executive Session was not held.
