AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, AMENDING CHAPTER 14, ARTICLE I,
SECTIONS 14-3 (1),14-3 (4)[DELETED], 14-4 (7),14-5 (3)[NEW] AND
14-9 (A)(1) OF THE CODE OF ORDINANCES; PROVIDING FOR AN
AMENDED FEE SCHEDULE FOR SOME WATER AND SEWER
SERVICES; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, new bids have been accepted for water meters, resulting in a need to change meter
set and tap fees to reflect the actual cost of the meters; and,
WHEREAS, the charge for NSF checks has in the past not covered the costs involved in processing
these checks; and,
WHEREAS, the City Council recognizes the need to set a Large Volume User rate;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS THAT:
SECTION 1: Chapter 14, Article I, Sections 14-3 (1), 14-3 (4)[deleted], 14-4 (7), 14-5 (3)[new]
and 14-9 (a)(1) of the Code of Ordinances of the City of Allen, Texas, are hereby amended to read
in their entirety as follows:
"Sec 14-3. Tap Fee and meter setting charges.
The tapping fee and meter setting charge applicable to users of the city's waterworks and
sanitary sewer system shall be as follows:

"Sec. 14-4 Billings and Adjustments.
(7) A fee of fifteen dollars ($15.00) shall apply to any returned check given to the city
in payment of services.
"Sec. 14-5 Water service charges.
[NEW](3) For large volume users (defined as having a meter of 4" or larger, and needing a
minimum of thirty million gallons per year), the rate shall be billed as follows: one
dollar and fifty-two cents ($1.52) per thousand gallons for each thousand gallons of
water or fraction thereof used above that included in the minimum bill (one thousand
five hundred (1,500) gallons). If actual usage by year end is less than thirty million
gallons, the user will be billed the difference up to thirty million gallons, at the $1.52
rate. If usage is above the thirty million gallons, the $1.52 rate will apply for the
overage. Customer must request this rate treatment.
"Sec. 14-9 Fire Hydrant meters.
(A)-(1) A deposit with the city of six hundred fifty dollars ($650.00) for a stationary meter
will be made. Such deposit will be returned upon payment of all charges for water
used, and upon return of the meter, fittings, and wrench in their original condition.
No interest will be computed on the amount of the deposit to be paid to the customer.
SECTION 2: All ordinances of the City of Allen in conflict with the provision of this ordinance
shall be, and same are hereby, repealed; provided, however, that all other provisions of said
ordinances not in conflict herewith shall remain in full force and effect.
SECTION 3: It is the intenion of the City Council that this Ordinance, and every provision thereof,
shall be considered severable, and the invalidity or unconstitutionality of any section, clause,
provision or portion of this Ordinance shall not affect the validity or constitutionality of any other
portion of this Ordinance.
SECTION 4: This Ordinance, and all rates established herein, shall become effective on June 6,
1996.
