AN ORDINANCE OF THE CITY OF ALLIIN, COLLIN COUNTY, TEXAS,
ESTABLISHING A MUNICIPAL COURT BUILDING SECURITY FUND AND
REQUIRING EACH DEFENDANT CONVICTED IN A TRIAL FOR A
MISDEMEANOR OFFENSE IN THE MUNICIPAL COURT OF THE CITY OF
ALLEN, TEXAS, TO PAY A THREE DOLLAR ($3.00) SECURITY FEE AS A
COST OF COURT.
WHEREAS, pursuant to Article 102.017 of the Texas Code of Criminal Procedure, the City Council of
the City of Allen, Texas, has authorized the creation of a Municipal Court Building Security Fund to
finance certain security services for the Municipal Court through the imposition of a $3.00 security fee
to be paid as a court cost by each defendant convicted in a trial for a misdemeanor offense in the
Municipal Court;
NOW, I UEFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT:
SECTION 1: There is hereby established a Municipal Court Building Security Fund for use only to
finance the following items when used for the purpose of providing security services for buildings
housing a municipal court:
(a)
The purchase or repair of X-ray machines and conveying systems;
(b)
Handheld metal detectors;
(c)
Walkthrough metal detectors;
(d)
Identification cards and systems;
(e)
Electronic locking and surveillance equipment;
(f)
Bailiffs, deputy sheriffs, deputy constables, or contract security personnel during times
when they are providing appropriate security services;
(g)
Signage;
(h)
Confiscated weapon inventory and tracking systems;
(i)
Locks, chains, or other security hardware; or
(j)
Any other items or for any other purpose as may be authorized from time to time by
the amendment of Article 102.017 of the Texas Code of Criminal Procedure.
SECTION 2.
Each defendant convicted in a trial for a misdemeanor offense in the Municipal Court
of the City of
Allen shall pay a Three Dollar ($3.00) security fee as a cost of court. A person is
considered convicted if:
(a)
A sentence is imposed on the person;
(b)
The person receives community supervision, including deferred adjudication; or,
(c)
The court defers final disposition of the person's case.
The Clerk of the Municipal Court shall collect the costs and pay them to the Finance Department of
the City of Allen for deposit into the Municipal Court Building Security Fund.
SECTION 3: All ordinances of the City of Allen in conflict with the provisions of this ordinance be,
and the same are hereby repealed; provided, however, that all other provisions of said ordinances not
in conflict herewith shall remain in full force and effect.
SECTION 4: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause,
sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or
decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any
other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had known the affected parts
would be held unconstitutional.
