AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 1425-8-96, AS
PREVIOUSLY AMENDED, TO ESTABLISH PERMANENT ZONING ON THE
FOLLOWING -DESCRIBED TRACT OF LAND: 163.08 ACRES OF LAND
LOCATED IN THE JOHN SNIDER SURVEY, ABSTRACT NO. 848, CITY OF
ALLEN, COLLIN COUN'T'Y, TEXAS, AS FOLLOWS: "R -5(C)" ON 112.51 -
ACRES OF LAND, "R -7(C)" ON 25.0 ACRES OF LAND, FLOOD
PLAIN/SHOPPING CENTER (FP/SC) ON 20.69 ACRES OF LAND, AND
COMMUNITY FACILITIES (CF) ON 4.6 ACRES OF LAND; PROVIDING FOR
EXHIBIT "A" LAND USE PLAN; PROVIDING FOR EXHIBIT "B"
DEVELOPMENT STANDARDS; PROVIDING FOR EXHIBIT "C" LEGAL
DESCRIPTION; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED
THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE;
PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the Planning and Zoning Commission of the City of Allen, and the governing body of the
City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen,
have given the requisite notices by publication and otherwise, and after holding due hearings and
affording full and fair hearing to all the property owners generally and to all persons interested and
situated in the affected area and in the vicinity thereof, and in the exercise of its legislative discretion,
have concluded that Comprehensive Zoning Ordinance No. 1425-8-96 should be changed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT.
SECTION 1: Comprehensive Zoning Ordinance No. 1425-8-96 of the City of Allen, Texas, as
previously amended, be and the same is hereby amended by revising the Zoning Map of the City of
Allen to establish permanent zoning on 163.08 acres of land located in the John Snider Survey, Abstract
No. 848, City of Allen, Collin County, Texas, with the following zoning classifications, to -wit:
"R -5(C)" on 112.51 acres of land, 'R -7(C)" on 25.0 acres of land, "FP/SC" on 20.69 acres
of land, and "C -F" on 4.6 acres of land.
SECTION 2: The land use plan attached hereto as Exhibit "A" and the development standards
attached hereto as Exhibit 'B" are made a part hereof for all purposes and shall be adhered to in their
entirety.
SECTION 3: The property described in Exhibit "C," attached hereto and made a part hereof for all
purposes, shall be used in the manner and for the purposes provided for as approved herein.
SECTION 4: All ordinances of the City of Allen in conflict with the provisions of this ordinance be,
and the same are hereby repealed; provided, however, that all other provisions of said ordinances not
in conflict herewith shall remain in full force and effect.
SECTION 5: Any person, firm, or corporation violating any of the provisions or terms of this
ordinance shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No.
1425-5-96 of the City of Allen, as previously amended, and upon conviction shall be punished by a fine
not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense.
SECTION 6: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause,
sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or
decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any
other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had known the affected parts
would be held unconstitutional.
SECTION 7: This ordinance shall take effect immediately from and after its passage and publication
in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.

ALLEN, TEXAS
1. The City of Allen will waive any future park fees in lieu of the developer's dedication of
the 4.6 -acre park site. The depth of this park site shall be a minimum of 400 feet south
of the future Bethany Drive right-of-way.
2. The Shopping Center tract will be repsonsible for construction of a public access drive,
at the time of final platting and site planning of the property (inclusive of all drainage and
utility requirements), extending through the park from Bethany Drive to Allen Heights
Drive meandering along the flood plain. The drive width shall be a minimum of 24' face
to face and a maximum of 31' face to face. This road will meet the City of Allen
standards and the design and location will be approved by the Parks and Recreation
Department, along with the City's traffic consultant and City Engineer.
3. The Shopping Center Tract will be required to construct the eastern half of Allen Heights
Drive as it pertains to the frontage of the shopping center and to community facilities/flood
plain frontage. The residential development shall be responsible for Bethany Drive
construction from its eastern boundary of development to the intersection of Allen Heights.
They will have this responsibility with platting of the first phase of development.
4. The .48 acres at the corner will be restricted to signage use only for the Shopping Center
and will comply with City of Allen sign regulations.
5. The residential R-5 property shall be restricted to a maximum of 403 units, and the R-7
property shall be restricted to a maximum of 120 units.
6. The right-of-way for Bethany Drive and Allen Heights shall be platted and dedicated to
the City of Allen within thirty (30) days after zoning is effective. The park will be platted
and dedicated with the first phase of residential development
