HomeMy WebLinkAboutO-1474-11-96ORDINANCE NO. 1474-11-96 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING ORDINANCE NO. 1189-7-93 BY OPENING A WINDOW FOR THE NO MEREST PERIOD ENDING JANUARY 31, 1997 FOR THE PRO -RATA CHARGE FOR WATER AND SANITARY SEWER UTII,PTIES LOCATED IN BUCKINGHAM ESTATES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE. WHEREAS, the City of Allen, Texas (hereinafter called "City"), is a Home Rule City with its Charter approved by the voters of the City pursuant to Article II, Section S of the Texas Constitution; and, WHEREAS, the City has all the powers of a local self-government contained in its Charter and in the applicable state statutes; and, WHEREAS, the City Council of the City of Allen finds cause to extend the no -interest period on the pro rata charges for construction of water and sanitary sewer lines and a lift station for the Buckingham Polo Estates. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1: The compound interest which has accrued on the pro rata charge established by Ordinance No. 1189-7-93 of the City of Allen, Texas, is hereby waived for any pro rata charges paid by homeowners in the Buckingham Polo Estates during the period of time from June 21, 1996 through January 31, 1997. Interest will continue to accrue and be compounded annually, including during the period from the effective date of this Ordinance through January 31, 1997, pursuant to Ordinance No. 1189-7-93 on all pro rata charges not paid prior to January 31, 1997. SECTION 2: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 3: This ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
