AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
AMENDING THE CODE OF ORDINANCES, BY AMENDING CHAPTER 9,
"MOTOR VEHICLES AND TRAFFIC," ARTICLE V, "OPERATION OF
VEHICLES," DIVISION 2, "SPEED REGULATIONS," SECTION 9-137(b) TO ADD
SUBSECTION (13) TO ESTABLISH SCHOOL ZONES AND THE MAXIMUM
PRIMA FACIE SPEED LI IIT OF TWENTY (20) MILES PER HOUR DURING
CERTAIN PERIODS FOR CERTAIN PORTIONS OF DUCHESS DRIVE,
CASTLEFORT DRIVE, NEEDHAM DRIVE AND PALACE WAY; PROVIDING FOR
A SAVINGS CLAUSE; PROVIDING FOR A REPEALING CLAUSE; PROVIDING
FOR A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT
TO EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 545.356 of the Transportation Code, Vernon's Texas Codes Annotated, provides that
whenever the governing body of the City shall determine upon the basis of an engineering and traffic
investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the
conditions found to exist at any intersection or other place or upon any part of a street or highway within the
City, taking into consideration the width and condition of the pavement and other circumstances on such
portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and
declare a reasonable and safety prima facie speed limit thereat or thereon by the passage of an ordinance,
which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other
place or part of the street or highway; and,
WHEREAS, the City Council of the City of Allen, Texas, upon the basis of an engineering and traffic
investigation, finds it necessary to alter prima facie maximum speed limits established by Section 545.352 of
the Transportation Code, V.T.C.A., and by certain ordinances of the City of Allen, within the areas and at the
locations named and designated in the body of this Ordinance, all within the corporate limits of the City of
Allen, Collin County, Texas, and in some instances, in the immediate vicinity of school areas, during periods
of time when schools are in session and school children are going to and from schools and playgrounds; and,
WHEREAS, the governing body finds it necessary for the protection and safety of pedestrians crossing the

streets within such areas to prohibit the overtaking and passing of motor vehicles by other motor vehicles
within the school zones;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT:
SECTION 1: Chapter 9, "Motor Vehicles and Traffic," Article V, "Operation of Vehicles," Division 2,
"Speed Regulations," Section 9-137(b), "School Zones" of the Allen Code of Ordinances be and the same is
hereby amended to add subsection (13) to establish certain portions of Duchess Drive, Castlefort Drive,
Needham Drive and Palace Way as school zones and to establish the maximum prima facie speed limit of
twenty (20) miles per hour when such zones are in effect to read as follows:
"Sec. 9-137. School Zones; signs.
(13) Beverly Elementary: Twenty (20) miles per hour
a. Beginning at a point on Duchess Drive, seventy-five (75) feet north
of the intersection of Duchess Drive and Hedgecoxe Road and
continuing north along Duchess Drive to the intersection of Duchess
Drive and Needham Drive.
b. Beginning at the intersection of Duchess Drive and Needham Drive
and continuing south along Duchess Drive to a point seventy-five
(75) feet north of the intersection of Duchess Drive and Hedgecoxe
Road.
C. Beginning at a point on Castlefort Drive one hundred twenty (120)
feet north of the intersection of Castlefort Drive and Needham Drive
and continuing along Castlefort Drive south to the intersection of
Castlefort Drive and Needham Drive.
d. Beginning at the intersection of Castlefort Drive and Needham Drive
and continuing along Castlefort Drive north to a point one hundred
(100) feet north of the intersection of Castlefort Drive and Needham
Drive.
e. Beginning at a point on Needham Drive, one hundred fifty (150) feet
west of the intersection of Needham Drive and Duchess Drive and
continuing east along Needham Drive to a point six hundred forty
(640) feet east of the intersection of Needham Drive and Duchess
Drive.
f. Beginning at the intersection of Needham Drive and Castlefort Drive
and continuing west along Needham Drive to a point one hundred
twenty (120) feet west of the intersection of Duchess Drive and
Needham Drive.
g. Beginning at a point on Palace Way, one hundred fifty (150) feet
west of the intersection of Duchess Drive and Palace Way and
continuing east along Palace Way to the intersection of Duchess
Drive and Palace Way.
h. Beginning at the intersection of Duchess Drive and Palace Way and
continuing west along Palace Way to a point one hundred fifty (150)
feet west of the intersection of Duchess Drive and Palace Way."
SECTION 2. The Traffic Engineer shall erect appropriate signage giving notice of the school zones and the
maximum prima facie speed limit established herein.

SECTION 3. That all ordinances of the City of Allen in conflict with the provisions of this ordinance shall
be, and the same are hereby, repealed; provided, however, that all other provisions of said ordinances not in
conflict herewith shall remain in full force and effect.
SECTION 4. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this
ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or
unconstitutional,. the same shall not affect the validity of the remaining portions of said ordinance or the Code
of Ordinances, as amended hereby, which shall remain in full force and effect.
SECTION 5. An offense committed before the effective date of this ordinance is governed by prior law and
the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the
former law is continued in effect for this purpose.
SECTION 6. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be fined in the sum of not more than Two Hundred Dollars ($200.00) for
each such violation.
SECTION 7. That this ordinance shall take effect immediately from and after its passage and publication in
accordance with the provisions of the Charter of the City of Allen, however the school zones established
herein shall not take effect until the Traffic Engineer has erected appropriate signage giving notice of such
school zones and the maximum prima facie speed limits therefore and it is accordingly so ordained.

Judge Christiansen, one should be kept at City Hall, one to the Police Department, and the other three
should be returned to me, one of which I will forward to the District Attorney's Office.
Also included are four copies of the actual amendments to the Code, and these should be inserted
in the copies of the Traffic Code kept by various city departments, replacing or supplementing the page
indicated. In other words, one each of pages 17-17c to the Court Clerk, Judge Christiansen, the Police

and each of these needs to be signed by the Mayor and you at the places indicated. Once they
have been signed, please distribute them as follows: One should be given to the Court Clerk,
another to Judge Shapiro, one should be kept at City Hall, one should go to the Police
Department, and the other three should be returned to me, one of which I will forward to the
District Attorney's Office.
Also included herewith are four copies (designated Exhibit "B") of the actual amendments
to the Code, and these should be inserted in the copies of the Traffic Code kept by various city
departments, replacing or supplementing the pages indicated. In other words, of pages 19c and
19d, to the Court Clerk, Judge Shapiro, the Police Department and the City's master Traffic
Code.
