A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS
SUPPORTING THE CONCEPT AND THE LOCATION OF THE PROPOSED COLLIN
COUNTY FARMERS MARKET IN THE CITY OF ALLEN'S EXTRATERRITORIAL
JURISDICTION AND PROVIDING SPECIFIC REQUIREMENTS FOR THE OPERATION
OF SUCH A FACILITY WITHIN THE CITY OF ALLEN.
WHEREAS, the Collin County Commissioners Court has found and
determined that a Farmers Market will be desirable
to service all the residents in Collin County, and;
WHEREAS, the Commissioners Court has designated funds for the
construction of the facility and has organized support
within the County for such a facility, and;
WHEREAS, the Commissioners Court desires that the Farmers Market
be centrally located within the County with respect to
population, and;
WHEREAS, the City Council of the City of Allen, Texas, is desirous
that all of the property that is presently within the
City's extraterritorial jurisdiction be developed in a
planned orderly fashion, and;
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, IS SUPPORTIVE OF THE CONCEPT OF THE FARMERS
MARKET AND THE LOCATION OF THE FARMERS MARKET, BEING ONE MILE
WEST OF U. S. HIGHWAY 75, SOUTH OF F.M. 2170; PROVIDED THAT THE
COLLIN COUNTY COMMISSIONERS MEET ALL OF THE REQUIREMENTS SET
FORTH AS FOLLOWS:
Section 1. Voluntary annexation proceedings for the entire
tract of property owned by Collin County, selected
as the location for the Farmers Market, to be
initiated by the Collin County Commissioners in
the form of a resolution to the Allen City Council.
Section 2. Upon annexation of the property into the City of
Allen, the Collin County Commissioners will request
a Special Exception Zoning District Use to permit
operation of the Farmers Market within the appro-
priate Code requirements for a period of one year.
Section 3. Continued operation of the Farmers Market facility
will be on an annual basis, renewable by the Allen
City Council in November of each year.
Section 4. Upon sale of the property, discontinuance of the
Farmers Market by the Collin County Commissioners,
and/or non renewal of the Special Exception Zoning
Use, all structures on the site must be removed
from the property within a three (3) month period.
Section 5. Requirements for an appropriate sewer system would
be a septic tank system with permanent restroom
facilities or a package treatment plant.
