RESOLUTION NO. 530-7-84(R)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS,
SUSPENDING THE OPERATION OF PROPOSED RATE INCREASE SCHEDULES
FILED BY LONE STAR GAS COMPANY, A DIVISION OF ENSERCH CORPORATION,
FOR A PERIOD OF NINETY (90) DAYS BEYOND THE DATE OF WHICH SUCH
SCHEDULES WOULD OTHERWISE GO INTO EFFECT AND DENYING INTERIM
RATE RELIEF.
WHEREAS, Lone Star Gas Company, a Public Utility under
Article 6050, et. seq. V.A.C.S. and Article 1446C of Vernon's
Annotated Civil Statutes (.Supplement 1976) did on July 11, 1984,
file a schedule of rates for gas service within the City of
Allen to become effective August 16, 1984; and,
WHEREAS, The City of Allen acting under the Constitution
and Laws of the State of Texas and under the Charter of the
City does have authority to regulate public utility rate
requests; and,
WHEREAS, after having reviewed the materials presented to
the City and having heard the presentation of Lone Star Gas
Company, it is the opinion of the City Council of the City of
Allen, that such schedule of rates should be suspended for a
period of ninety (90) days from August 16, 1984, for further
study, investigation, presentation of evidence, and public
hearing; and,
WHEREAS, Section 43(d) of Article 1446C of the Public
Utility Regulatory Act of 1975 allows the City Council at its
discretion to establish temporary rates for the period of sus-
pension which would operate in lieu of the present rates now
in force until such time as final rates are determined; and,
WHEREAS, it is the opinion of the Allen City Council that
the temporary rate relief request is not in the best interest
of the citizens of Allen.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ALLEN, TEXAS, THAT:
Section 1. Pursuant to Section 43(d) of the Public
Utility Regulatory Act of 1975, the operation of the Lone Star
Gas Company's proposed rate schedules filed with the City of
Resolution No. 530-7-84(R)

Allen, July 11, 1984, is hereby suspended for a period of
ninety (90) days from August 16, 1984, for further study,
investigation, presentation of evidence, and public hearing.
Section 2. The request by Lone Star Gas Company for
temporary rate relief during the suspension period is hereby
denied.
Section 3. The City Secretary is directed to provide
a copy of this resolution to Lone Star Gas Company upon passage.
