Home My WebLink AboutR-609-5-85RESOLUTION NO. 609-5-85(R) A RESOLUTION ordering a bond election to be held within the City of Allen, Texas, making provision for the conduct of the election and resolving other matters incident and related to such election. WHEREAS, the City Council of the City of Allen, Texas, hereby finds that an election should be held to determine whether said governing body shall be authorized to issue bonds of said City in the amounts and for the purposes hereinafter identified; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: An election shall be held on the 22nd day of June, 1985, in the City of Allen, Texas, which date is not less than fifteen (15) nor more than ninety (90) days from the date of the adoption hereof; for the purpose of submitting the following propositions: PROPOSITION NUMBER 1 "SHALL the City Council of the City of Allen, Texas, be authorized to issue bonds of the City in the principal amount of $2,050,000 for the purpose of making permanent public improvements and public purposes, to wit: constructing and equipping a police and courts facility; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 2 "SHALL the City Council of the City of Allen, Texas, be authorized to issue bonds of the City in the principal amount of $785,000 for the purpose of making permanent public improvements and public purposes, to wit: constructing and equipping fire station facilities, including the purchase of land and fire- fighting equipment therefor; such bonds to mature serially or otherwise over a period not to exceed RESOLUTION NO. 609-5-85(R) FORTY (40) years from their date, to be issued and sold in one or more series, at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 3 "SHALL the City Council of the City of Allen, Texas, be authorized to issue bonds of the City in the principal amount of $5,065,000 for the purpose of making permanent public improvements and public purposes, to wit: acquire or improve, or both, land for parks; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 4 "SHALL the City Council of the City of Allen, Texas, be authorized to issue bonds of the City in the principal amount of $9,970,000 for making permanent public improvements and public purposes, to wit: street improvements, including drainage incident thereto, the purchase of equipment and machinery for making such improvements and the acquisition of land and right-of-way therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" -2- RESOLUTION NO. 609-5-85(R) PROPOSITION NUMBER 5 "SHALL the City Council of the City of Allen, Texas, be authorized to issue bonds of the City in the principal amount of $2,525,000 for the purpose of making permanent public improvements and public purposes, to wit: constructing and equipping library facilities; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 6 "SHALL the City Council of the City of Allen, Texas, be authorized to issue revenue bonds of the City in the principal amount of $3,840,000 for constructing improvements and extensions to the City's Waterworks System; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined with the discretion of the City Council at the time of issuance or sale of the bonds and to be payable from and secured by a pledge of the net revenues of the City's combined Waterworks and Sanitary Sewer System, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation from funds raised or to be raised by taxation?" PROPOSITION NUMBER 7 "SHALL the City Council of the City of Allen, Texas, be authorized to issue revenue bonds of the City in the principal amount of $900,000 for constructing improvements and extensions to the City's Sanitary Sewer System; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear -3- RESOLUTION NO. 609-5-85(R) interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined with the discretion of the City Council at the time of issuance or sale of the bonds and to be payable from and secured by a pledge of the net revenues of the City's combined Waterworks and Sanitary Sewer System, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation from funds raised or to be raised by taxation?" SECTION 2: Paper ballots shall be used in this election, which ballots shall be prepared in accordance with V.A.T.S., Election Code, and permit electors to vote "FOR" or "AGAINST" the aforesaid propositions. Said propositions shall appear on the ballot substantially as follows: PROPOSITION NUMBER 1 "THE ISSUANCE OF $2,050,000 GENERAL OBLIGATION BONDS FOR A POLICE AND COURTS FACILITY" PROPOSITION NUMBER 2 "THE ISSUANCE OF $785,000 GENERAL OBLIGATION BONDS FOR FIRE FIGHTING FACILITIES AND EQUIPMENT" PROPOSITION NUMBER 3 "THE ISSUANCE OF $5,065,000 GENERAL OBLIGATION BONDS FOR PARKS" PROPOSITION NUMBER 4 "THE ISSUANCE OF $9,970,000 GENERAL OBLIGATION BONDS FOR STREET IMPROVEMENTS" PROPOSITION NUMBER 5 "THE ISSUANCE OF $2,525,000 GENERAL OBLIGATION BONDS FOR LIBRARY FACILITIES" PROPOSITION NUMBER 6 "THE ISSUANCE OF $3,840,000 REVENUE BONDS FOR IMPROVEMENTS AND EXTENSIONS TO THE WATERWORKS SYSTEM" -4- RESOLUTION NO. 609-5-85(R) PROPOSITION NUMBER 7 "THE ISSUANCE OF $900,000 REVENUE BONDS FOR IMPROVEMENTS AND EXTENSIONS TO THE SANITARY SEWER SYSTEM" SECTION 3: The entire City of Allen, Texas, shall constitute one election precinct for this election and the Rountree Elementary School, 800 East Main is hereby designated the polling place. The persons hereby appointed to serve as the election officers at said polling place are as follows: Margaret Armand Carol Baugh Presiding Judge Alternate Presiding Judge The Presiding Judge shall appoint not less than two (2) nor more than four (4) qualified clerks to serve and assist in holding said election; provided that if the Presiding Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the clerks. On election day, the polls shall be open from 7:00 A.M. to 7:00 P.M. Absentee voting shall be conducted at the City Secretary's office in the City Hall Annex, in accordance with the provisions of V.A.T.S. Election Code, Chapter 5. SECTION 4: All resident qualified electors of the City shall be permitted to vote at such election. This election shall be held and conducted in accordance with the Texas Election Code, except as modified by Chapter 1 of Title 22, V.A.T.C.S., and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 5: A substantial copy of this resolution shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted at three (3) public places within the City and at the City Hall not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in a newspaper of general -5- RESOLUTION NO. 609-5-85(R) circulation in said City, the first of said publications to be made not less than fourteen (14) full days prior to the date set for said election.
