Home My WebLink AboutR-961-12-89RESOLUTION NO. 961-12-89 (R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING AN APPLICATION TO THE TEXAS DEPARTMENT OF COMMERCE FOR FUNDS UNDER THE TEXAS CAPITAL FUND ON BEHALF OF PAYCOM, INC. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS: SECTION 1. The City Council has reviewed and hereby approves an application to the Texas Department of Commerce for a grant in the amount of $500,000, to be applied to the General Administration of the grant by the City of Allen and in a loan to Paycom, Inc. SECTION 2. The City Council has reviewed and hereby agrees to comply with all assurances executed in connection with the application and, if awarded, the grant. SECTION 3. The City Manager is hereby authorized and directed to act on the City's behalf in all matters pertaining to this application. SECTION 4. The City Council has reviewed and hereby agrees not to participate in program income recapture and will return all program income to the state to be placed in a statewide Revolving Loan Fund to be used by the state to fund future Texas Capital Fund awards. By agreeing to this measure, the city understands that it will be eligible to receive as many Texas Capital Fund awards per program year as it has eligible projects. This determination must be made at the time the original award is made and cannot be changed with subsequent awards or in subsequent program years. This Environmental Review Record is on file at the above address and is available for public examination and copying, upon request, in the City Secretary's office between the hours of 8:00 a.m. and 5:00 p.m. The City of Allen will undertake the project described above with Texas Community Development Program funds from the Texas Depart- ment of Commerce (TDOC) under Title I of the Housing and Com- munity Development Act of 1974, as amended. The City of Allen is certifying to the Texas Department of Commerce that the City of Allen and Jon McCarty, in his official capacity as City Manager, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental assessments, decision-making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the City of Allen Vevelopment may use the Texas Community Program funds, and the Texas Department of Commerce have satisfied its responsibilities under the National Environmental Policy Act of 1969 and 24 CFR Part 58. The Texas Department of Commerce will accept an objection to its approval of the release of funds and acceptance of the certifica- tion only if it is on one of the following bases: (a) that the certification was not in fact executed by the chief executive officer or other certifying officer of the Contractor approved by the TDOC; or (b) that the Contractor's environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review required procedure (24 CFR 58), and may be addressed to the Texas Department of Commerce, Community Development Division, P.O.
