A RESOLUTION OF THE CITY OF ALLEN, TEXAS, AUTHORIZING THE
CITY OF PLANO, TEXAS, TO ACQUIRE UNDER THE POWER OF EMINENT
DOMAIN OR THROUGH PURCHASE OR BY DONATION FEE SIMPLE TITLE
AND WHERE APPLICABLE UTILITY, SLOPE AND DRAINAGE EASEMENTS
FOR THE CUSTER ROAD PROJECT WHERE SUCH PROPERTY LIES WITHIN
THE LIMITS OF THE CITY OF ALLEN OR ITS EXTRATERRITORIAL
JURISDICTION.
WHEREAS, the Cities of Allen and Plano have agreed to acquire certain needed rights -
of -way for Custer Road from McDermott to S. H. 121 ( called the "Custer Road Project") ,
and the City of Plano has been delegated the authority to acquire such right-of-way and
easements in connection with the Custer Road Project; and,
WHEREAS, Section 273.001 of the Local Government Code of the State of Texas
authorizes a municipality to acquire property separately or jointly with another
municipality or other governmental entity with or without condemnation; and,
WHEREAS, the City of Allen desires to grant to the City of Plano authorization to
acquire property by eminent domain where such property is needed for the Custer Road
Project and where located within the limits of the City of Allen or its extraterritorial
jurisdiction ("ETJ") ;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS THAT: f
SECTION 1: That the City of Allen, Texas, does hereby grant and authorize the City
of Plano, Texas, the authority to acquire under the power of eminent domain, by
purchase or donation fee simple title and where applicable utility, slope and drainage
easements needed and necessary for the Custer Road Project or any portion of the
hereinafter described properties located within the city limits of the City of Allen or its
ETJ. The properties to be acquired by the City of Plano for the Custer Road Project
are described in Exhibit "A" attached hereto and made a part hereof by reference (the
"Property").
SECTION 2: That this resolution shall take effect immediately from and after its
adoption.

TEXAS, ON THE 18TH DAY OF APRIL , 1991.

C014MENCING at the southeast corner of the 2.00 -acre Malcom Tract recorded in
Volume 799, Page 469, D.R.C.C.T., at the southeast corner of the 10.00 -acre
Bolin Tract recorded in Volume 555, Page 592, D.R.C.C.T.; and the north line
