A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, FINDING THAT AN OUTDOOR PRODUCE MARKET IS
A NEW AND UNLISTED USE; PROVIDING A DEFINITION; AND DECLARING
THE APPROPRIATE DISTRICTS FOR SUCH USE.
WHEREAS, the City of Allen has been requested to interpret whether an "Outdoor
Product Market" is a new and unlisted use within the definitions and schedule of uses
of the City's Comprehensive Zoning Ordinance; and,
WHEREAS, Section 2.08 of the Comprehensive Zoning Ordinance of the City of Allen
delineates the appropriate procedure regarding new and unlisted uses; and,
WHEREAS, the Planning and Zoning Commission in the following those procedures, finds
that an Outdoor Produce Market is a new and unlisted use and is recommending that the
City Council declare the appropriate districts for this use.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION 1: For purposes of interpretation and finding, the term "Outdoor Produce
Market" shall have the following definition:
"Business which sells fresh fruit, vegetables, small plants, flowers, and related
perishable food products. Restrictions would be: 1( no trees, shrubs, or other
large vegetation is to be sold; 2) outdoor sales display shall only be allowed
during business operating hours; 3) permanent outdoor storage shall only be
allowed if suitably screened from view from all directions ( screening shall meet
all City of Allen standards; 4) permanent outdoor storage shall not be allowed in
the front half of the property; 5) outdoor products shall be displayed only under
a permanent, approved, roof structure, conforming with the City's building
codes, during the hours of operation. "
SECTION 2: The Allen Planning and Zoning Commission and City Council agree that
this is a new and unlisted use.
SECTION 3: The City Council finds this use shall be allowed by Specific Use Permit in
the Central Business District (CBD), and by right in the following districts:
Shopping Center
Light Commercial
General Business
Corridor Commercial
Planned Development
