RESOLUTION NO. 1427-5-96(R)
A RESOLUTION canvassing the returns and declaring the
results of the municipal sales and use tax election
held May 4, 1996, on the adoption of an additional
sales and use tax pursuant to the provisions of
Section 4B of Article 5190.6, V.A.T.C.S.
WHEREAS, an election was held in the City of Allen, Texas on
the 4th day of May, 1996, for the purpose of submitting a certain
proposition on the question of the adoption of a sales and use tax
to the resident electors of the City pursuant to the provisions of
Section 4B of Article 5190.6, V.A.T.C.S.; and
WHEREAS, it is hereby found and determined that notice of the
election was duly given in the form, manner and time required by
law, and said election was in all respects legally held and
conducted in accordance with applicable laws of the State of Texas
and the proceedings calling and governing the holding of such
election; and
WHEREAS, the returns of said election have been duly and
legally made and submitted to the City Council for canvassing, and
a tabulation of the returns for the polling place and for early
voting, as canvassed and tabulated by this governing body and
shown in Exhibit A attached hereto, reflect that the total sum of
votes counted "FOR" and "AGAINST" the measure submitted are as
follows:
"THE ADOPTION OF AN ADDITIONAL ONE-HALF OF ONE
PERCENT SALES AND USE TAX FOR PROJECTS
AUTHORIZED BY SECTION 4B, ARTICLE 5190.6,
VERNON'S TEXAS CIVIL STATUTES, AS AMENDED,
INCLUDING THE PAYMENT OF MAINTENANCE AND
OPERATING EXPENSES OF PUBLICLY OWNED AND
OPERATED PROJECTS"
"FOR" 763 votes
"AGAINST" 511 votes
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:

All of the recitals contained in the preamble of
are found to be true and are adopted as findings
governing body and as part of its judgment.
SECTION 2: It is further found and determined that the
results of the election are as canvassed and tabulated in the
preamble hereof and in Exhibit A attached hereto, and, a majority
of the electors voting at said election having voted in favor of
the proposition, the City Council is hereby declared to be
authorized and empowered to levy an additional one-half of one
percent sales and use tax for authorized projects; all as more
fully set forth and identified above and in the proceedings
ordering said election.
SECTION 3: The City Secretary is hereby authorized and
directed to make the appropriate entries of information appearing
in the tabulation of precinct results shown in Exhibit A attached
hereto in the election register maintained by the City in
accordance with provisions of Section 67.006 of the Election Code.

This refers to three annexations (Ordinance Nos. 1406-3-96,
1407-3-96, and 1413-3-96) to the City of Allen in Collin County,
Texas, submitted to the Attorney General pursuant to Section 5 of
the Voting Rights Act, 42 U.S.C. 1973c. We received your
submission on April 10, 1996.
The Attorney General does not interpose any objection to the
specified changes. However, we note that Section 5 expressly
provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the
changes. See the Procedures for the Administration of Section 5
(28 C.F.R. 51.41).
