AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND
ZONING MAP AS PREVIOUSLY AMENDED BY AMENDING THE REGULATIONS
RELATING TO THE USE AND DEVELOPMENT OF LOT 2, BLOCK A, HONDA OF
ALLEN, LOCATED WITHIN TRACT 7 OF PLANNED DEVELOPMENT “PD” NO. 55
FOR COMMERCIAL/OFFICE “C/O” BY GRANTING SPECIFIC USE PERMIT NO. 189
FOR AN AUTOMOTIVE REPAIR, MAJOR USE; PROVIDING A CONFLICTS
RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM
OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission of the City of Allen, Texas and the governing body of the City
of Allen, Texas, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, Texas,
have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full
and fair hearing to all the property owners generally and to all persons interested and situated in the affected area,
and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Allen Land
Development Code Zoning Regulations and Zoning Map of the City of Allen, Texas, as previously adopted, should
be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Allen Land Development Code (“ALDC”) Zoning Regulations and Zoning Map of the City
of Allen, Collin County, Texas, be amended, and is hereby further amended by amending the regulations relating
to the use and development of Lot 2, Block A, Honda of Allen, an Addition to the City of Allen, Collin County,
Texas, according to the Plat recorded in Volume R, Page 164, Map Records, Collin County, Texas, (“the
Property”), which is presently zoned for and located in Tract 7 of Planned Development “PD” No. 55
Commercial/Office “C/O” by granting Specific Use Permit No. 189 for an Automotive Repair, Major use subject
to Section 2, below.
SECTION 2. The Property shall be used only in the manner and for the purposes provided for in the Allen
Land Development Code Zoning Regulations, as heretofore amended, and the use and development regulations
of Tract 7 of Planned Development “PD” No. 55, as amended, and, if developed and used for Automotive
Repair, Major purposes, such use shall be further subject to the following:
A. The Property shall be developed and used only in accordance with the SUP Site Plan, Landscape Plan,
and Building Elevations, attached hereto as Exhibit “A,” “B,” and “C,” respectively, and incorporated
herein by reference.
B. Outdoor storage of vehicles located on the Property while awaiting, during, or following the performance
of repairs shall be permitted in the area of the front yard depicted on the SUP Site Plan; provided, however,
no such outdoor storage of vehicles shall be permitted prior to the completion of construction of the eight-
foot (8.0’) tall masonry screening wall and landscaping depicted on the SUP Site Plan and the Landscape
Plan, respectively.
C. This Specific Use Permit No. 189 shall be subject to termination in accordance with Section 6.01.4 of the
ALDC.
