Adjourn to Regular Meeting With no further discussion, Mayor Brooks adjourned the Workshop of the Allen City Council at 6:47 p.m. on Tuesday, January 23, 2024, in the Basement Meeting Rooms of Allen City Hall, 305 Century Parkway,Allen,Texas. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 23,2024 Regular Meeting 1. Call to Order and Announce a Quorum is Present With a quorum of the Allen City Council present,the Regular Meeting of the Allen City Council was called to order by Mayor Brooks at 7:00 p.m. on Tuesday,January 23,2024,in the Council Chambers of Allen City Hall, 305 Century Parkway,Allen,Texas. 2. Pledge of Allegiance Mayor Brooks asked everyone to join him and the Allen City Council in a moment of silence. 3. Public Recognition 4. Citizens' Comments 5. Consent Agenda MOTION: Upon a motion made by Councilmember Shafer and a second by Councilmember Cornette,the Council voted seven(7)for and none(0)opposed to approve the Consent Agenda as follows: 5.1 Approve minutes from the January 9,2024,Regular City Council Meeting. 5.2 Adopt a Resolution amending Chapter 9, "Leave," Section 9.03A, "Official Holidays,"of the City of Allen Personnel Policies and Procedures Manual. RESOLUTION NO. 4058-1-24(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CITY OF ALLEN PERSONNEL POLICIES AND PROCEDURES MANUAL BY AMENDING CHAPTER NINE, SECTION 9.03A "OFFICIAL HOLIDAYS," AND PROVIDING AN EFFECTIVE DATE. 5.3 Adopt a Resolution adopting the Americans with Disabilities Act Self Evaluation and Transition Plan. RESOLUTION NO. 4059-1-24(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING THE AMERICANS WITH DISABILITIES ACT SELF EVALUATION & TRANSITION PLAN; AND PROVIDING FOR AN EFFECTIVE DATE. 5.4 Award bid and authorize the City Manager to execute an agreement with Criterion Contractors,Inc.,for the City Hall Generator Project for$640,326. 5.5 Authorize the City Manager to execute an amendment to the Group Policy with UnitedHealthcare Insurance Company for Stop-Loss services. 5.6 Authorize the City Manager to execute an agreement with Allen Sports Association,Inc., for Co-Sponsored Youth Sports Programs for a period of six years with three successive terms of five years each. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 23,2024 5.7 Authorize the City Manager to purchase a wireless internet(Wi-Fi) system replacement from Presidio Network Solutions Group for Credit Union of Texas Event Center for $108,242. 5.8 Authorize the purchase of night vision equipment from TNVC,Inc.,through the State of Texas Urban Area Security Initiative(UASI)Grant program for$182,046. - 5.9 Authorize the'City Manager to execute an agreement with CI Pavement for On-Call Concrete standard and emergency street, sidewalk, alley, and trail repairs for up to $1,325,000 annually,with the option for four(4)one-year renewals. 5.10 Accept a resignation from Michael Schaeffer and declare a vacancy in Place No.2 on the Allen Economic Development Corporation. 5.11 Accept a resignation from Veronica Yost and declare a vacancy in Place No. 5 on the Community Engagement Advisory Board. 5.12 Accept a resignation from John Holley and declare a vacancy in Place No.6 on the Parks and Recreation Board. The motion carried. 6. Regular Agenda 6.1 Conduct a Public Hearing and adopt an Ordinance to amend and restate the development regulations of Specific Use Permit No. 156 for an Automotive Repair,Minor use relating to the use of a 4,7441 square foot portion of a building located on Lot 3, William F. Chester Addition, commonly known as 600 Central Expressway North. [Allen Car Care Center] Mayor Brooks opened the public hearing. With no one speaking,Mayor Brooks closed the public hearing. ORDINANCE NO.4060-1-24: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED BY, AMENDING AND RESTATING THE DEVELOPMENT REGULATIONS OF SPECIFIC USE PERMIT NO. 156 FOR AN AUTOMOTIVE REPAIR, MINOR USE SET FORTH IN ORDINANCE NO. 3525-10-17 RELATING TO THE USE AND DEVELOPMENT OF 4,744±SQUARE FOOT PORTION OF A BUILDING LOCATED ON LOT 3,WILLIAM F. CHESTER ADDITION; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000)FOR EACH OFFENSE;AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Shafer and a second by Councilmember Baril, the Council voted seven(7)for and none opposed to adopt Ordinance No.4060-1-24,as previously captioned,to amend Specific Use Permit No. 156. The motion carried. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 23,2024 7. Other Business 7.1 Calendar. 7.2 Items of Interest. • Councilmember Trahan announced that Allen ISD Board of Trustees recognized Head Coach Lee Wiggington as one of five national coaches to be named a finalist for the 2023 Power of Influence Award by the American Football Coaches Association and American Football Coaches Foundation. • Council wished happy birthday to Councilmember Cornette. • As a member of Congressman Self's Veterans Advisory Board, Councilmember Cornette encouraged Veterans to reach out to him if they have concerns to share with the Congressman. • Mayor Brooks shared that Stephen G. Terrell Recreation Center was open for tours with staff and enrollment in General Memberships. Beginning January 29,the Center opens for General Membership and Day Pass access. • Mayor Brooks invited the community to the Swearing-In Ceremony for new Chief of Police Steve Dye on February 1 at the Allen Senior Center. • Mayor Brooks invited residents to cheer on the Dallas Sidekicks at Allen Community Development Corporation's Community Night on February 15. Mayor Brooks announced the Executive Session and then recessed the Regular Agenda at 7:12 p.m. 8. Executive Session In accordance with the Texas Government Code, the Allen City Council convened into Executive Session at 7:20 p.m. on Tuesday, January 23, 2024, in the Basement Meeting Rooms A and B of the Allen City Hall, 305 Century Parkway,Allen,Texas,to discuss matters pertaining to: 8.1 Pursuant to Section 551.074 of the Texas Government Code-Personnel. • Annual Performance Evaluation of the City Manager. The Executive Session adjourned at 8:30 p.m. on Tuesday, January 23,2024. 8.2 Reconvene and Consider Action on Items Resulting from Executive Session. The Allen City Council reconvened into the Regular Meeting at 8:34 p.m. on Tuesday, January 23, 2024,in the Council Chambers of Allen City Hall, 305 Century Parkway,Allen,Texas. The following action was taken on items discussed during the Executive Session. MOTION: Upon a motion made by Mayor Pro Tern Schulmeister and a second by Councilmember Shafer, the Council voted seven(7) for and none (0) opposed authorizing Mayor Brooks to negotiate and execute an amendment to the City Manager's employment agreement to increase the City Manager's base salary by 4% and benefits by 4.5% consistent with discussion held in the Executive Session.The motion carried. ALLEN CITY COUNCIL REGULAR MEETING JANUARY 23,2024 9. Adjournment Mayor Brooks adjourned the Regular Meeting of the Allen City Council at 8:35 p.m. on Tuesday, January 23,2024.
