' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN
INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS,
AND TEXOMA AREA PARATRANSIT SYSTEM; AUTHORIZING THE PROVISION
OF TRANSIT SERVICES BETWEEN LOCATIONS WITHIN THE CITY'S
INCORPORATED LIMITS AND OTHER LOCATIONS WITHIN COLLIN COUNTY,
TEXAS; AUTHORIZING ITS EXECUTION BY THE CITY MANAGER OR
DESIGNEE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Allen, Texas, has been presented a proposed Interlocal Agreement
by and between the City of Allen, Texas, and Texoma Area Pamtransit System, a copy of which is attached
hereto and incorporated herein by reference (herein called "Agreement"); and,
WHEREAS, the City of Allen ("City") is a home rule municipality and local governmental entity located
within Collin County, Texas; and,
WHEREAS, on or about December 21, 2010, City received approval by the Regional Transportation Council
("RTC"), the regional transportation policy board of the North Central Texas Council of Governments
("NCl'COG"), to receive federal grant funding under the Job Access/Reverse Commute Program, found at 49
U.S.C. § 5316 ("JA/RC"), for the implementation of a JA/RC Project to provide round-trip commuter shuttle
bus service between locations within City's incorporated limits and other locations within Collin County,
Texas; and,
WHEREAS, Texoma Area Paratransit System ("TAPS") is a mral transit district established pursuant to the
authority of Chapter 458, Texas Transportation Code, as amended, that provides transit services within the
State of Texas in the counties of Clay, Collin, Cooke, Fannin, Grayson, Montague, and Wise; and,
WHEREAS, City seeks to implement a JA/RC Project to provide round-trip commuter shuttle bus service
between locations within City's incorporated limits and other locations within Collin County, Texas; and,
WHEREAS, City has requested transit services from TAPS, and TAPS agrees to provide the requested
transit services pursuant to this Agreement, to support the JA/RC Project; and,
WHEREAS, the Parties acknowledge and find that it will increase the efficiency and effectiveness of their
respective entities by entering into an interlocal cooperation agreement pursuant to Chapter 791 of the Texas
Government Code, as amended (also known as the "Texas Interlocal Cooperation Act" ("the Act"), and will
be in their best interests and the interest of the public to cooperate in the provision of transit services as set
forth in this Agreement; and,
WHEREAS, upon full review and consideration of the Agreement, and all matters related thereto, the City
Council is of the opinion and finds that the terms and conditions thereof should be approved, and that the City
Manager or designee should be authorized to execute the Agreement on behalf of the City of Allen, Texas.
' NOW, THEREFORE, BE rr RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The terms and conditions of the Agreement, having been reviewed by the City Council of the
City of Allen and found to be acceptable and in the best interests of the City of Allen and its citizens, be, and the
same is hereby, in all things approved.
SECTION 2. The City Manager or designee, under the direction of the City Council of the City of Allen, is
hereby designated as the official representative to act for the City in all matters relating to transit services
' pursuant to this Agreement.
SECTION 3. The City Manager or designee is hereby authorized to execute the Agreement and all other
documents in connection therewith on behalf of the City of Allen, substantially according to the terms and
conditions set forth in this Agreement.

SECTION 4. This Resolution shall take effect immediately from and after its passage, and it is accordingly so
resolved.
