May 5, 1977
The meeting was called to order by the City Secretary, in the absence of
the Mayor, and the oath of office was given to the incumbent council member
M.B. Pierson.
Present: Councilpersons: H.C. Brooks, Eileen Tollett, Joe Farmer, Mickey
Pierson, and Charles Chandler
A Motion was made by Farmer and Second by Chandler to elect Mickey Pierson
Mayor ProTem. Motion carried unanamously.
After the reading of the minutes, a request was made that they be amended
to reflect that the Mayor had promised the group for the housing, that they
would be first on the agenda and that they would have an executive session
at 6:00 P.M. Mr. Pierson explained that our attorney was contacted and
that the matters to be discussed could not be discussed in executive
session and should be taken up in regular meeting. Motion Farmer second
Tollett to amend the minutes. Motion carried 4 For 0 Against. Motion
Brooks Second Farmer to approve the minutes as corrected. Motion carried
4 For 0 Against.
The request for a zoning change on property at Boyd and Allen Drive, from
R-16 to LR was approved by a motion from Brooks Second Chandler. Carried

Roger Power introduced Sam Wyse, the City Planning Consultant, who gave
a progress report on the land use study, as the first year contract
with the State Dept. of Community Affairs is coming to an end. He advised
that the application for the second year funding is being completed, which
Will focus on zoning ordinances and sub division control ordinances. Mr.
Wyse presented his study of population projection, housing and environment
which will all work together for the future development of Allen to the
year 2000. His study shows that by the permits issued, we are where
Piano was in 1967 and that our population in the Allen City Limits is 5061.
He emphasized that we should plan now and program the improvements when
needed.
Bill Day, of the Parks and Recreation Sub Committee requested that they
be able to come before the council and present their proposal regarding
their portion of the study, which will furnish the guidelines toward
building the Park & Recreation program to what it should be. Mr. Farmer
requested a synopsis of their presentation beforehand.
Various homeowners presented their housing construction problems, with
the major complaints being against their builders and what some felt was
lack of code enforcement. Mr. Seglem stated that his house was built on
the wrong lot and that he had only 7' on 1 side and 5' on the other. He
was advised that deed restrictions are out of the hands of the city's
governing body; however, we are to confer with our attorney as to where
we stand with our ordinance, as to over building a lot, without exception.
Most of the other homeowners had the same builder, with a variety of
problems, from no clean outs, no air flow from beating,broken lights,
no air flow from heating, cook stove not hooked up, to lights blinking
off and on. Joe Bishop, a local electrician 'brought it to the attention
of the council, that some of the electrical problems could not have been
readily noticeable, unless the building inspector had gone thru the insulation
in the attic, and that no other inspector would find it either. He said

that if substandard work does occur it is coveredup between the electrical
rough inspection and the electrical final, the inspection which allows for
the power to be turned on. The council advised that we would get a copy
of Plano's sub contractors ordinance and consider licensing them; however,
they felt that the builder was still accountable for all the problems that
had occured. Mr. R.P. Cain spoke very favorably for our inspector, as
he had worked with him for several years, in Allen and other towns, and
felt that he knew what he was doing and was stricter than the inspectors
in other towns.
Pete Yurgenson, as a committe of 1, of the Volunteer Water Study Committee,
asked to speak concerning the anomalies of the 8 month financial and budget
report. He advised the council that the city was negligent in their
operations and not running its business as it should and not as the council
is paid to do. Mr. Pierson advised him that all of the Volunteer Water
Committee would be notifed by us, and they as a committee would be heard
on May 19.
Motion by Tollett Second Brooks to pay bills. Motion carried 4 For 0 Against.
Police Chief Hancock presented his request to initiate a lease purchase
agreement for a radar unit, wtich would be received during this fiscal
year. but the lease naynenls probably r -t begin u -,til the next fiscal year.
Motion Farmer Second Brooks to allow him to do so. Motion carried L For 0
Against.
Wendell Housley, C'.-.,il Defense Director, requested that he be a" m ed to
attend the Civil Prepardness School in Austin, the week of May 16. Motion
Chandler, Second Brooks to cover all expenses not covered by the Civil
Defense. Motion carried 4 For 0 Against. They also allowed Bob Acker,
Fire Marshall, to attend the Fire Marshall's of Texas meeting, at an
expense of $20.00
Tbuasday, May 12, was set as a Budget Work Shop for hearing budget requests
of the Police and Fire Marshall.
Motion Brooks Second Chandler to adjourn. Motion carried 4 For 0 Against.
