Present: Mayor Frank Dugger
Councilpersons: Mickey Pierson, Joe Farmer, Eileen Tollett,
H.C. Brooks, Jr. and Charles Chandler
Motion Pierson Second Farmer to adopt minutes as read. Motion carried
5 For 0 Against.
Norman Luterman, along with Buddy Shepard of Starnes & Associates,
appeared seeking information regarding the development of Fountain Park
They requested that they be allowed to develop 98 lots rather than the
202, and also if they would be required to use concrete streets, as
specified in the ordinance which had been drawn up since the platting
of that section. Motion Pierson Second Brooks that they be required
to go with the concrete ordinance and that we take under advisement
the determination of thoroughfares and secondary streets. A meeting
was set for Wednesday night, July 27, between the council, Walter
Hicks and Roger Powell to decide and study this matter. Mr. Luterman
also requested a reduction in his taxes for 1975 and 76 on the 104
lots that will not be developed. Walter Curtis advised that the
1976 Equalization Board had already met and the taxes were set, and
could not be changed. Frank advised that this would also be discussed
Wednesday night, after the council had had time to consult with the
tax attorney and Walter Curtis, Tax Assessor.
August 4 was set as the date for a Public Hearing on Lot 4B Block R
Old Donation, £er a Special Exception request from Duke Robertson
to allow for a used car sales. Motion Pierson Second Chandler to set
that date. Motion carried 5 For 0 Against.
The Mayor advised of the meeting held the previous Wednesday between
Cody Sherman and Chuck Frisk, of the County, Tom Wise of Fox and Jacobs
along with Jimmy Eaton and the Mayor, to discuss the improvements to
Jupiter Road, from Chapparal to 2170. The County advised that they
would furnish the rock, base and dirt work ( approximate cost422,000�
Fox and Jacobs had set aside $7,000 and we would pay the difference
of approximately $1.1,000 for the 2.1 mile of double coat penetration,
which should last approximately 5 years. Farmer and Pierson are to go
to the next school board meeting to request their help as well as
well as help from other property owners along Jupiter Road. Motion
Pierson to move ahead Second Tollett. Motion carried 5 For 0 Against.
The Council has talked to Roger Powell about hiring him as a pro.
fessional Consultant for the City. Motion Tollett that the City enter
into a contract with Roger Powell under the terms of the agreement.
Second Pierson. Motion carried 5 For 0 Against.
A Public Hearing was held to certify our population. Sam Wyse, the
City Planning Consultant, presented his testimony regarding his
opinion of the current population. He had figured by 4 different
methodologies and each formula brought our population well over the
5000 mark. When asked if these were conservative figures, be said
they definitely were and felt that a house to house census would
probably bring It closer to 6000. He, recommended the egos'-enlistic

figures which show us with 1660 rccunied dwellings, with fami17, size

against. The Mayor felt that we should piblicly present the pros and
cons of becoming a Pcme Rule City. 4,* -Z20
Anthony Hancock presented the clans for jury trial set for August 9th and
discussed the rate for the jury panel to be paid. Motion Brooks Second
Farmer to pay $6. Motion carried 5 For 0 Against.
Charles Baker, 536 Old Bridge, appeared concerning his water being turned
off for non payment. Council explaned to Mr. Baker the reasons for this
policy and felt that this was the only way to handle those who had not
Paid.
Walter Curtis informed the councilof a Problem at the Baptist Church in
Fairview, which is in our extra territorial jurisdiction. The City of
Fairview had turned off the water to the pastor's trailer, which is
parked by the church, and he requested that they be allowed to tie onto
Lucas line. Council agreed to this.

Farmer _:ade motion to pay bills as presented. Second Pierson. Mott on carried
5 For 0 Against. Brooks made motion to approve the umbrella liability
Policy on all employees, payable 1 year at a time. Second Pierson. Motion
carried 5 For 0 Against.
Council advised Jimmy to get bids on sewer cleaning machine.
J.D. Goodman presented a check to the Fire Department for bringing out
fire truck to put out a fire close to his Fire Works Stand.
Motion Pierini to approve the Fire Marshall's expense to school. Second
Chandler. Motion carried 5 For 0 Against.
Motion Brooks Second Farmer to adjourn. Motioncarried5 For 0 Aga et.
