' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING
ARTICLE IV "COURTS" OF CHAPTER 2 "ADMINISTRATION" BY ADDING A
NEW SECTION 2-74 ESTABLISHING A JUVENILE CASE MANAGER FUND AND
AN ADDITIONAL COURT COST OF FIVE DOLLARS (55.00) TO FUND THE
JUVENILE CASE MANAGER FUND; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABH.ITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Code of Ordinances of the City of Allen, Texas, be and the same is hereby amended by
amending Chapter 2 "Administration' to add a new Section 2-74 to establish a Juvenile Case Manager Fund
which shall read as follows:
"CHAPTER2
ADMINISTRATION
ARTICLE 1Y. COURTS
' Sec. 2-74. Juvenile Case Manager Fund.
(a) There is hereby created ajuvenile case manager fund for the City of Allen, Texas.
(b) A defendant convicted of a misdemeanor offense in the Municipal Court in the City
shall pay a $5.00 Juvenile Case Manager Fund fee for each conviction as a cost of court.
(c) For purposes of this section, a defendant is considered convicted if:
(1) A sentence is imposed on the person, or
(2) the person receives deferred disposition, including deferred proceedings
under Article 45.052 or Article 45.053 of the Texas Code of Criminal
Procedure.
(d) The Judge of the Municipal Court may waive the fees of this section in the case of
financial hardship.
(e) The Clerks of the Municipal Court shall collect the additional court costs imposed
herein and pay them to the director of finance of the city, who discharges the duties delegated to the
municipal treasurer, for deposit in a fund to be known as the Juvenile Case Manager Fund.
(f) The Juvenile Case Manager Fund may be used only to finance the salary and benefits
of a juvenile case manager employed under Article 45.056 of the Texas Code of Criminal Procedure,
as amended.
Sec. 2-75. Finance Director to supervise administration of municipal court.
SECTION 1. All provisions of the ordinances of the City of Allen, Texas, in conflict with the provisions of
this ordinance be and the same are hereby repealed, and all other provisions of the Ordinances of the City not
' in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 3. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this
ordinance as a whole, or any part or provision hereof other than the part so decided to be invalid, illegal or
unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole.

SECTION 4. This ordinance shall take effect immediately from and after its passage and the publication of
the caption, as the law and Charter in such case provide.
