AN ORDINANCE DEFINING AND PROHIBITING THE OPERATION
OF A MOBILE SERVICE UNIT WITHIN THE CORPORATE LIMITS
OF THE CITY OF ALLEN; PROVIDING A PENALTY FOR THE
VIOLATION HEREOF, SETTING FORTH PUBLICATION REQUIRE-
MENTS; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Allen, Texas,
after due hearing, has determined that the transportation
and dispensing of flammable liquid used as motor fuels
from mobile service units, constitute a danger and hazard
to the public health and safety of residents of this City.
WHEREAS, the City Council of the City of Allen, Texas,
is charged with the responsibility of providing for their
citizens' welfare and the prohibiting of hazardous or danger-
ous conditions constitutes a reasonable method of providing
for said general welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ALLEN, TEXAS:
SECTION ONE: Mobile Service Unit as used in this
Ordinance is defined as a vehicle, a tank truck, or other
mobile device from which flammable liquids, used as motor
fuels, may as an act of retail sale, be dispensed into the
fuel tank of a motor vehicle parked on an off-street parking
facility.
SECTION TWO: That from and after the effective date
of this Ordinance, described below, it shall be unlawful
to operate a mobile service unit within the corporate limits
of the City of Allen, Texas, said operation of a mobile
service unit being hereby prohibited.
SECTION THREE: Any person, firm, corporation or other
entity who operates a mobile service unit within the
corporate limits of the City of Allen, Texas, or permits
such operation, after the effective date of this Ordinance,
described below, shall be guilty of a misdemeanor and may
be fined any sum, not to exceed two hundred ($200.00)
dollars.
SECTION FOUR: That the caption of this Ordinance
shall be published at least one time in a weekly newspaper
of general circulation in the City of Allen, upon completion
of which, this Ordinance shall be effective.
DULY PASSED AND APPROVED by the City Council of the
City of Allen, Texas, on this the lf� day of
1971.
