.T_..__..�.,_._ AN ORDINANCE CREATING A PLANNED DEVELOPMENT FOR
THE PURPOSE. OF CONTROLLING THE DEVELOPMENT OF
I LAND SURROUNDING ALLEN; PROVIDING FOR ZONING
` ACCORDING TO TRACTS WITHIN THE PLANNED DEVELOP-
MENT AREA; A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE; AN EFFECTIVE DATE OF THIS ORDINANCE;
AND PUBLICATION OF THE CAPTION HEREOF:
WHEREAS, the City Council of Allen, Texas, is
charged with the responsibility of providing for the
public health, safety, and welfare of the people of the
community, and
WHEREAS, planned development areas offer a reasonable
method for a city to provide control over traffic, sewage,
water, and other factors vitally connected to the public
health, safety and welfare; and
WHEREAS, the below described land has been lawfully
incorporated into the City of Allen, Texas; and
WHEREAS, the legal notices required for zoning have
been given in the manner and form set forth by law and a
public hearing has been held on the proposed zoning
classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ALLEN, TEXAS:
SECTION ONE: That the following described property,
to -wit:
BEING a tract situated in Collin County, Texas, being
a part of the PETER WETSEL SURVEY, Abstract No. 990, and
the LEWIS WEISEL SURVEY, Abstract No. 978, and described
by metes and bound, ea follows:
BEGINNING at the Southeast corner of a 12.0 acre
tract conveyed to Allen Independent School District by
Sidney Eros Brown and filed in Volume 553, Page 307 of
• the Deed Records of Collin County, Texas;
THENCE NORTH 1 degree 00 minutes East, a distance
of 2,193.58 feet to a rod for corner; and said line also
being parallel to the East line of State Highway No. 6,
a 60 foot wide road; and in the East line of State Highway
No. 6;
THENCE NORTH 30 degrees 52 minutes East, and with the
said right of way line of State Highway No. 5, and 48
feet Southeasterly of and parallel to the center line of
a 24 foot wide concrete slab in place; a distance of
1,091.30 feet to a concrete right of way marker for
corner; the beginning of a curve to the left which has
an angle of intersection in said right of way line of
6 degrees 17 minutes 15 seconds.and a radius of 2,977.85
feet; continuing with said curve on said right of way
line, a distance of 326.8 feet to a rod for corner in
the intersection of said right of way line with an old
fence on the agreed boundary line as described in
Volume 280, Page 605 between S. M. Brown and H. H. Compton;
THENCE NORTH 89 degrees 53 minutes East and with said
fence on agreed boundary line, a distance of 2,720.3
feet to a rod for corner in the East line of said LEWIS
WETSEL SURVEY, Abstract No. 978;
THENCE SOUTH 0 degrees 20 minutes West, and with the
old hedge and fence on the East line of said Lewis Wetsel
Survey and also continuing on the said fence and hedge
on East line of said Pater Wetsel Survey, in all a
distance of 3,496.7 feet to a point for corner in the
intersection of the northerly right of way line of Farm
Market Road No. 2170, as conveyed to State of Texas by
S. E. Brown and recorded in Volume 515, Page 176 of the
Deed Records of Collin County, Texas, and as shown more
particularly by right of way map recorded in Volume 416
Pages 211-212 and 213 of said Deed Records and the East
line of said Peter Wetzel Survey;
THENCE WESTERLY and with the said Northerly right of
way line as shown in said right of way map the following:
North 86 degrees 59 minutes West; 435.5 feet to a rod as
beginning of curve to the left which has an angle of
intersection of 2 degrees 09 minutes and a radius of
5,774.65 feet;
THENCE with said curve a distance of 216.7 feet,
a rod; continuing with said right of way; North 89
degrees 08 minutes West, a distance of 1,094.9 feet to
arod for corner at an angle to the left of 00 degrees
end 17 minutes; continuing with said right of way North
• 89 degrees 25 minutes West, a distance of 1,707.9 feet
to the place of BEGINNING.
is hereby placed in a planned development area and is
zoned according to the uses as shown on the map attached
to this Ordinance, which map is incorporated in this
ordinance as though written herein. It is specifically
Provided, however, that all blocks of land on the attached
map which are not designated to fall within a particular
use are hereby placed in Zone A.
SECTION TWO: It Shall be unlawful for any person,
firm or corporation to make use of said premises in some
manner other than as authorized by this Ordinance, and it
shall be unlawful for any person, firm or corporation
to construct on said premises any building that is not
in substantial conformity with the plot plan attached
hereto.
SECTION THREE: Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
guilty of a misdemeanor, and upon a conviction therefor
shall be fined any sum not exceeding $200.00, and each and
every day that such violation continues shall be considered
a separate offense provided, however, that such penal

SECTION FOUR: The caption of this Ordinance shall

upon its passag, and such publication.
