ORDINANCE NO.
AN ORDINANCE AMENDING THE GENERAL ZONING ORDINANCE
OF THE CITY OF ALLEN, TEXAS, WHEREBY 22.363 ACRES IN
THE DAVID WETSEL SURVEY, ABSTRACT NO. 977, WHICH HAS
A PRESENT ZONE CLASSIFICATION OF"A"(SINGLE FAMILY
DWELLING) IS REZONED AND PLACED IN ZONE C -D -E (APARTMENT);
PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE;
AN EFFECTIVE DATE OF THIS ORDINANCE; AND PUBLICATION
OF THE CAPTION HEREOF.
WHEREAS, the legal and equitable owners of 22.363
acres of land in the David Wetsel Survey, Abstract No. 977,
have petitioned the City Council of the City of Allen,
Texas, for rezoning said property, and
WHEREAS, the City Council of the City of Allen,
Texas, is charged with a responsibility for providing
for the public health, safety, and welfare of the people
in their community, and
WHEREAS, the property described in this Ordinance
has been duly and lawfully incorporated into the City of
Allen, Texas, and
WHEREAS, all legal notices and public hearings required
for rezoning by the laws of the State of Texas, and the
Ordinance of the City of Allen, Texas, have been given in
the manner and the form set forth by said Statutes and a
public hearing has been hid on the proposed zoning
classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ALLEN, TEXAS:
SECTION I: That the following described property,
to -wit:
BEING a tract of land situated in the David Wetsel
Survey,, Abstract No. 977, Collin County, Texas, and being
a part of a 100.100 acre tract of land conveyed to Allen
Land Company, recorded in Volume 683 at Page 784 of the
Deed Records of Collin County, Texas, and being more
particularly described as follows:
COMMENCING at a point on the South line of Farm to
Market Road No. 2170, said point being the Northwest
corner of HILLSIDE VILLAGE NO. 1, an Addition to the City
of Allen, Thence, N. 89 deg 10130"W, along the said South
line of Farm to Market Road No. 2170 a distance of 465.39
feet. Thence, N. 89 deg 251W, continuing
along the said South line of Farm to Market Road No. 2170
a distance of 724.81 feet. Thence, S. 0 deg 351W, leaving
the said South line of Farm to Market Road No. 2170 a
distance of 430.00 feet to the PLACE OF BEGINNING, a
point for corner;
THENCE, S. 0 deg 35'W, a distance of 250.02 feet to
the beginning of a curve to the Right, having a central
angle of 84 deg 41'54" and a radius of 50.00 feet, a point
for corner;
THENCE, around said curve a distance of 73.91 feet to
the beginning of a curve to the Left, having a central
angle of 38 deg 09154" and a radius of 1175.18 feet, a
point for corner;
THENCE, around said curve a distance of 782.79 feet
to the end of said curve, a point for corner;
THENCE, S. 47 deg 071W, a distance of 1100.00 feet to
a point for corner;
THENCE, N. 42 deg 531W, a distance of 124.56 feet to
a point for corner;
THENCE, N. 52 deg 291W, a distance of 294.96 feet to
a point for corner;
THENCE, N. 30 deg 57'30" E, a distance of 428.63
feet to a point for corner;
THENCE, N. 25 deg 28130" E, a distance of 116.35
feet to a point for corner;
THENCE, S. 86 deg 461E, a distance of 427.78 feet to
a point for corner;
THENCE, N. 3 deg 14'E, a distance of 651.27 feet to
a point for corner;
THENCE, S. 89 deg 251E, a distance of 1141.90 feet to
the PLACE OF BEGINNING and containing 22.363 acres of land
is hereby rezoned from its present Zone A (Single family
dwelling) to Zone C -D -E (Apartment) according to the uses
of property allowd by Zone C -D -E (Apartment) in the general
zoning ordiance of the City of Allen, Texas.
SECTION II: It shall be unlawful for any person,
firm or corporation to make use of the hereinabove
described premises in any manner other than is authorized
by this Ordinance.
SECTION III: Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction therefor,
shall be fined any sum not exceeding $200.00, and each
and every day that such violation continues shall be
considered a separate offense; provided, however, that
such penal provision shall not preclude a suit to enjoin
such violation.
SECTION IV: The Caption of this Ordinance shall be
published one time in a weekly newspaper published in
the City of Allen and shall be effective immediately
upon its passage and such publication.
