AN ORDINANCE AMENDING THE GENERAL ZONING ORDINANCE
OF THE CITY OF ALLEN, TERAS, WHEREBY 20 ACRES IN THE
DAVID WETSEL SURVEY, ABSTRACT NO. 977, WHICH HAS A
PRESENT ZONE CLASSIFICATION OF"A"(SINGLE FAMILY
DWELLING) IS REZONED AND PLACED IN ZONE F (LOCAL
RETAIL); PROVIDING A PENALTY FOR VIOLATION OF THIS
ORDINANCE; AN EFFECTIVE DATE OF THIS ORDINANCE; AND
PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the legal and equitable owners of 20 acres
of land in the David Weisel Survey, Abstract No. 977,
have petitioned the City Council of the City of Allen,
Texas, for rezoning said property, and
WHEREAS, the City Council of the City of Allen,
Texas, is charged with a responsibility for providing
for the public health, safety, and welfare of the people
in their community, and,
WHEREAS, the property described in this Ordinance
has been duly and lawfully incorporated into the City of
Allen, Texas, and
WHEREAS, all legal notices and public hearings required
for rezoning by the laws of the State of Texas, and the
Ordinsm of the City of Allen, Texas, have been given in
the manner and the form set forth by said Statutes and a
public hearing has been held on the proposed zoning
classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ALLEN, TEXAS:
SECTION I: That the following described property, to -wit:
BEING a tract of land situated in the David Wetsei Survey,
Abstract No. 977, Collin County, Texas, and being a part a
100.100 acre tract of land conveyed to Allen Land Company, recorded
in Vol. 683, at Page 784 of the Deed Records of Collin County,
Texas, and being more particularly described as follows:
COMMENCING at a point on the South line of Farm to
Market Road No. 2170, said point being the Northwest corner
of HILLSIDE VILLAGE NO. 1, an Addition to the City of
Allen, Thence N. 89 deg. 101 30" W, along the said South
line of Farm to Market Road No. 2170, a distance of
465.39 feet, Thence No. 89 deg. 25' W, Continuing along
the said South line of Farm to Market Road No. 2170 a
distance of 724.81 feet to the PLACE OF BEGINNING, said
point being the Northeast corner of said 100.100 acre
tract, a point for corner;
THENCE SO. 0 deg. 35' W, leaving the said South
line of Farm to Market Road No. 2170, a distance of 430.00
feet to a point for corner;
THENCE NO. 89 deg. 25' W, a distance of 1141.90 feet
to a point for corner;
THENCE SO. 3 deg. �41 W, a distance of 546.12 feet
to a point for corner;
THENCE NO. 86 deg. 46, W, a distance of 407.58 feet
to a point for corner;
THENCE NO. 8 deg. 59' 19" E, a distance of 75.63 feet
to a point for corner;
THENCE No. 3 deg. 14 1 E, a distance of 833.69 feet
to a point in the said South line of Farm to Market Road
No. 2170, a point for corner;
THENCE, along the said South line of Farm to Market
Road No. 2170, the following:
S. 86 deg. 50130" E. a distance of 30.00 feet
to a point for corner;
N. 46 deg 29" E, a distance of 72.45 feet to
a point for corner;
S. 89 deg 251 E, a distance of 1442.70 feet
to the PLACE OF BEGINNING and containing 20.00 acres of
land,
is hereby rezoned from its present Zone A (Single Family
Dwelling) to Zone F (Local Retail) according to the uses
of property allowed by Zone F (Local Retail) in the general
zoning ordinance of the City of Allen, Texas.
SECTION II: It shall be unlawful for any person, firm
or corporation to make use of the hereinabove described
premises in any manner other than is authorized by this
Ordinance.
SECTION III: Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction therefor,
shall be fined any sum not exceeding $200.00, and each
and every day that such violation continues shall be
considered a separate offense; provided, however that such
penal provision shall not preclude a suit to enjoin such
violation.
SECTION IV: The Caption of this Ordinance shall be
published one time in a weekly newspaper published in
the City of Allen and shall be effective ivmiediately
upon its passage and such publication.
