AN ORDINANCE AMENDING ORDINANCE NO. Ordinance , OF
THE CITY OF ALLEN, TEXAS, WHEREBY p1RT-6F=E A
IS REZONED TO THE CLASSIFICATION SHOWN IN THE
ATTACHED MAP, WHICH SAID MAP IS MADE A PART HEREOF;
PROVIDING A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE
HEREOF.
THAT WHEREAS, the legal and equitable owners of
approximately Five Hundred Thirty -Two (532) acres have
petitioned the City Council of the City of Allen, Texas,
for the rezoning of said property; and,
WHEREAS, after due notice in the manner and for the
length of time required by law, a public hearing was
held, and the City Council of the City of Allen, Texas,
has determined that the public welfare of the people of
this Community demand that such rezoning be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ALLEN, TEXAS:
SECTION ONE: That the existing zoning ordinance of
the City of Allen, Texas, is hereby amended so that the
property shown in the attached map is rezoned from its
present classification of A to the various classifications
shown on said map, and the general zoning map of the City
of Allen, Texas, is hereby amended as shown herein.
SECTION TWO: No oil drilling, oil development operation,
oil refining, quarrying or mining operation of any kind shall
be permitted upon or in any lot, nor shall oil wells, tanks,
tunnels, mineral excavations or shafts be permitted upon
or in any lot. No derrick or other structure designed for
use in boring for oil or natural gas shall be erected,
maintained or permitted upon any lot.
SECTION THREE: It shall be unlawful for any person,
firm or corporation to make use of said premises in some
manner other than as authorized by this Ordinance, and it
shall be unlawful for any person, firm or corporation to
construct on said premises any building that is not in
conformity with the permissible use under this Zoning
Ordinance.
SECTION FOUR: Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
quilty of a misdemeanor, and upon a conviction therefor,
shall be fined any sum not exceeding $200.00, and each
and every day that such violation continues shall be con-
sidered a separate offense; provided, however, that such
penal provision shall not preclude a suit to enjoin such
violation.
SECTION FIVE: The caption of this Ordinance shall be
published one (1) time in a weekly newspaper published
in the City of Allen, and shall be effective immediately
upon its passage and such publication.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, on this the 2nd day of December, 1971.
