SPEED ZONE ORDINANCE
AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS
nr. SECTION 169a of ARTICLE 6701d OF VERNON'S TEXAS
CIV. STAT., UPON F. M. HIGHWAY NO. 2170 WIIICB IS
LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY
OF ALLEN, AS SET OUT IN THIS ORDINANCE; AND PROVIDING
A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE
VIOLATION OF THIS ORDINANCE.
WHEREAS, Section 169a of Article 67014 of Vernon's
Texas Civil Statutes provides that whenever the governing
body of the City shall determine upon the basis of an
engineering and traffic investigation that prima facie
speed therein set forth is greater or less than is reasonable
or safe under the conditions found to exist at any inter-
section or other place or upon any part of a street or
highway within the City, taking into consideration the
width and condition of the pavement and other circumstances
on such portion of said street or highway, as well as the
usual traffic thereon, said governing body may determine
and declare a reasonable and safe prima facie speed limit
thereat or thereon by the passage of an ordinance, which
shall be effective when appropriate signs giving notice
thereof are erected at such intersection or other place
or part of the street or highway; NOW THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALIEN, TEXAS:
SECTION ONE:
Upon the basis of an engineering and traffic investi-
gation heretofore made as required and authorized by the
provisions of Section 169a of Article 6701d, Vernon's
Texas Civil Statutes, the following speed districts are
established and the following prima facie speed limits
for vehicles are hereby declared to be reasonable and
safe and such speed limits are hereby fixed at the rate
of speed hereinafter set forth below:
A. F.M. #2170 Eastbound traffic

4 Beginning at the East boundary 30 PDH

for .665 of a mile.
5 Beginning at the East boundary of 35 MPII
District No. 4; Thence East
for .768 of a mile.
6 Beginning at the East boundary of 40 MPH
District No. 5; Thence East for
.647 of a mile.
7 Beginning at the East boundary of 50 MPH
District No. 6; Thence East for
.2 of a mile.
8 Beginning at the East boundary of
District No. 7; Thence East for
1.351 miles to a point which is
the East corporate limits of the
City of Allen.

SECTION TWO:
That from and after the date of the passage of this
speed zone Ordinance, no motor vehicle shall be operated
along F.M. #2170 within the corporate limits of the City
of Allen in excess of the speeds set forth above as applicable
to each District.
SECTION THREE:
Any City Official or employee is authorized, upon
the direction of the Mayor, to cause to be erected
appropriate signs indicating such speed zones.
SECTION FOUR:
Any person, firm or corporation which violates any of
the provisions of this Ordinance shall be guilty of a
misdemeanor and upon conviction, may be fined any sum not
to exceed two hundred dollars ($200.00).
SECTION FIVE:
The Caption of this Ordinance shall be published one
time in a weekly newspaper published in the City of Allen and
said Ordinance shall be effective immediately upon its passage
and such publication.
