ORDINANCE NO. 132
AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON
TO PARK OR LEAVE ANY VEHICLE FOR A PERIOD OF 24
CONTINUOUS HOURS ON ANY STREET OR ALLEY IN THE
CITY OF ALLEN; PROVIDING FOR A PENALTY FOR THE
VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE
IMPOUNDMENT AND ULTIMATE DISPOSAL OF ANY SUCH
VEHICLE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING
FOR THE PUBLICATION OF THE CAPTION HEREOF AND AN
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of Allen, Texas, is
charged with the responsibility of providing for free
and unfettered traffic flow on all streets and alleys
in the
community;

IT ORDAINED BY THE
CITY COUNCIL OF
THE CITY OF
ALLEN, TEXAS:
SECTION I - UNLAWFUL PARKING - That from and after
the effective date of this Ordinance, it shall be unlawful
for any person to park or leave any vehicle for a period
of 24 continuous hours on any street or alley in the City
of Allen, Texas. As used in this Ordinance, the word
"person" means any natural or legal person, firm,
corporation, business, company, or other legal entity,
incorporated or unincorporated.
SECTION II - IMPOUNDMENT AND SALE - That it shall be
the duty of the Chief of Police of the City of Allen or
his Assistants to cause to be taken up and impounded, any
vehicle which is parked or left in violation of this
Ordinance, and for that purpose the Chief of Police or
his duly designated Assistants are given the right to
remove and impound such vehicle from a street or alley
and store such vehicle in a place suitable for that
purpose and a charge shall be made against the Owner
thereof for the removal of such vehicle at the rate of
$ 10.00 and for the storage of such vehicle at
the rate of one dollar ($1.00) per day for each and every
day that such vehicle shall be impounded and after the
expiration of sixty (60) days from the date of such
impoundment, the Chief of Police shall proceed to auction
off the same to the highest bidder in order to satisfy
the accrued removal and storage charges as provided for
herein. The Chief of Police shall give notice of such
sale by posting notice thereof in at least three (3)
public places in the City of Allen at least ten (10)
days prior to the date of sale, which notice shall
briefly describe the vehicle, the place where the same
was parked or left, and shall give the time and place
of such sale.
SECTION III - PENALTY - Any person who is found to
be guilty of the violation of a provision of this
Ordinance shall be guilty of a misdemeanor and upon
conviction shall be fined a sum not to exceed $200.00,
and each and every day such violation continues shall be
considered a separate offense.
SECTION IV - SAVINGS CLAUSE - That should any part
or portion of this Ordinance be declared unconstitutional
by a Court of competent jurisdiction, it is expressly
provided that the remaining portion of this Ordinance
shall remain in full force and effect.
SECTION V - PUBLICATION - The caption of this
Ordinance shall be published one (1) time in a weekly
newspaper having general publication in the City of
Allen, Texas, and said Ordinance shall be effective
immediately upon its adoption and publication and it
is so ordered.
DULY PASSED AND APPROVED BY THE CITY CONCIL OF THE
CITY OF ALLEN, TEXAS, on this the day of
