August 21, 1980
Present: Mayor M.B. Pierson
Councilmen: Rex Womack, Glenn Andrew, Richard Chumbley,
Joe Farmer, H.R. Daugherty and J.M. McClure
Meeting called to order by Mayor M.B. Pierson.
Motion Chumbley Second Daugherty to approve the minutes of the
Aubust 7 meeting. Motion carried 7 for 0 against.
A Public Hearing was held on a request to appeal the Planning and
Zoning decision to deny the request to change the zoning on
approximately 71 acres in the Willima Perrin Survey, Abstract
#708, from its present R-3, R-16PD and LP. -PD to R-16 and Gi. After
hearing several homeowners in that area speak against the request
for rezoning, Del Morton withdrew his request to appeal; however,
the Mayor called for a vote. Motion Farmer Second Daugherty to
deny the request to change zoning. Motion carried 7 for 0 against.
Bill Beatty, representing homeowners in High Point Addition, came
to discuss the water problems for homeowners on Malone Rd. Ron
Fix's estimate for installing a water line to serve that area
was $37,000; however, homeowners could reduce that amount by
performing some of that work themselves. If further information
is required, their representative will return to the council.
Motion Daugherty Second Andrew to hold a Public Hearing September
18on a request from Power, Inc. to change the zoning on a 1 acre
tract at 104-106 N. Cedar, from its present R-16 to CF. Motion
carried 7 for 0 against.
Motion Daugherty Second Andrew to hold a Public Hearing September
4 on a Special Exception Use request to construct a subdivision
advertising sign in OakHillAddition. Motion carried 7 -for 0
against.
The preliminary and final plats of Cottonwood Creek Shopping SPO
Center and Wal-Mart were presented for approval. These plats
had not be n Presented for approval at the time the property was
developed "and�if"iequired that they be filed. Motion Farmer
Second Daugherty to approve the preliminary and final plats
subject to the changes recommended by the staff. Motion carried
7 for 0 against.
Ordinance #309, amending the speed limits on 2170 was presented
for the council's adoption. Motion Farmer to adopt Ord. #309.
Motion died for lack of a second. After further discussion
regarding the opposition to the change in speed limits from 25
to 20 m.p.h. another motion was made by Farmer Second Daugherty
to adopt Ord. #309 and Resolution 4311 (maintenance agreement)
AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING ARTICLE VI,
DIVISION 2, "SPEED REGULATIONS", SECTION 1-40, "STREETS OTHER
THAN EXPRESSWAYS AND FREEWAYS", AND SECTION 1-46, "SPEED IN
SCHOOL ZONES; SIGNS IN SCHOOL ZONES", OF ATHE ALLEN VEHICLE AND
TRAFFIC CODE, ORDINANCE 259 OF THE CITY OF ALLEN, TEXAS; ALTERING
PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PRO-
VISIONS OF SECTION 169(b) OF ARTICLE 6701d, VERNON'S TEXAS CIVIL
STATUTES, UPON FARM ROAD HIGHWAY NO.2170 OR PARTS THEREOF, WITHIN
THE INCORPORATE LIMITS OF THE CITY OF ALLEN, AS SET OUT IN THIS
ORDINANCE; ALTERING ESTABLISHED ZONES; ALTERING PRIMA FACIE
MAXIMUM SPEED LIMITS ESTABLISHED IN SUCH ZONES DURING CERTAIN
PERIODS ON SCHOOL DAYS; DEFINING SUCH PERIODS AND "SCHOOL DAYS",
MAKING IT UNLAWFUL TO PASS WITHIN SCHOOL ZONES; PROVIDING
PENALTY CLAUSES;SEVERABILITY CLAUSES AND AN EFFECTIVE DATE,
and additionally directing the City Manager to forward a letter
to the Highway Department protesting the speed limit being raised
from 20 to 25 m.p.h. and to request flashing lights during
the lunch hour.. Motion carried 7 for 0 against.
Motion Farmer Second Womack that the council propose to set
the maximum of $.43 per $100 valuation for the tax rate, which
would result in a 10% increase and set a Public Hearing for
September 8. Motion carried 7 for 0 against.
Motion Daugherty Second Chumbley to authorize the architects to
begin design work for the service center and City Hall. Motion
carried 7 for 0 against.
Motion Chumbley Second Daugherty to adopt Ord. #310, AN ORDINANCE
PROVIDING FOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIREMENT
SYSTEM BY THE CITY OF ALLEN, TEXAS; PROVIDING FOR PARTICIPATION
IN THE SUPPLEMENTAL BENEFITS FUND OF THE TEXAS MUNICIPAL
RETIREMENT SYSTEM BY ALL DEPARTMENTS OF THE CITY GOVERNMENT;
PROVIDING FOR PAYMENT OF THE CITY'S CONTRIBUTIONS ON ACCOUNT OF
SUCH PARTICIPATION; AND PROVIDING FOR PARTICIPATION OF THE CITY
IN THE SUPPLEMENTAL DEATH BENEFITS FUND OF THE TEXAS MUNICIPAL
RETIREMENT SYSTEM TO PROVIDE CERTAIN IN-SERVICE DEATH BENEFITS
FOR EMPLOYEES AND DEATH BENEFITS FOR ANNUITANTS WHOSE LAST EMPLOY-
MENT BEFORE RETIREMENT WAS WITH THE CITY OF ALLEN, TEXAS. Motion
carried 7 for 0 against.
Joe Farmer, H.R. Daugherty and Jim McClure were appointed to form
a committee to select the Park Board by the September 18th meeting.
Motion Farmer Second Womack to set a workshop for Sept. 4, prior
to the regular meeting time, to consider the electrical ordinance
and the ordinance prohibiting the use of wood shingles. Motion
carried 7 for 0 against.
Motion Daugherty Second Andrew to adjourn. Motion carried 7 for
0 against.
