REXGUTAR SESSION
Allen City Council
October 2, 1980
Present: Mayor M.B. Pierson
Councilmen: Rex Wanack, Glenn Andra, Joe Fanner, H.R. Daugherty,
Jim McClure, and Richard Chumbley
Absent; None
Meeting of the Allen City Council was called to order by Mayor M.B. Pierson.
Motion Womack Second Daugherty to approve the minutes of the September 18
meeting with an amendment regarding the second to the motion on Ordinance #314,
which was made by McClure rather than Chumbley. Motion carried 7 for 0 against.
A Public Hearing was held on a request for variance to the minimum lot area
per dwelling in R-16 zoning, which would allow him to constuct a four family
dwelling if approved. Objections were voiced by 3 have owners present and
two objections were received by phone. Motion Andrew Second McClure to
reject the request for variance to the minimum lot area per dwelling. Motion
carried 6 for 1 abstaining. Richard Chumbley abstained frau discussion and vote
because of a conflict of interest.
A Public Hearing was held on an annexation request on approximately 16 acres
east of 75 and west of the railroad. No one spoke against this request and
the annexation ordinance will be presented at the next meeting providing that
the City of Plano releases their portion of the overlapping ETJ at their next
meeting.
A letter of resignation frau Roger Powell, P & Z member, was received. Mr.
Powell was not able to cauplete his third term because of being relocated with
his tawny. Motion Daugherty Second Chumbley to accept his resignation. Motion
carried 7 for 0 against. Chairman of the Interview Ccmnittee, Joe Farmer, made
the recomendation frau the ccmnitte to appoint Tan Inkman to fill this vacancy.
Motion Chumbley Second Andrea to accept by acclaimation this nomination, appointing
Tan Inlmian to the Planning and Zoning Comission, to cauplete the term of this place
on the Camiission. Motion carried 7 for 0 against.
Having ccnpleted the interview process, this same comiittee submitted the
following names for the Park Board:

Place 2. Ron Workman
Place 3. Wendell Housley
Place 4. Jerry Owen
Place 5. Helen Johnson
Motion Wanack Second Chumbley to appoint these by acclaimation. Motion carried
7 for 0 against. Motion Chumbley Second Farmer to set the terns of Place 1,3,and 5
as 2 year terns, and Place 2 and 4 as 1 year terns, beginning October 1. Motion
carried 7 for 0 against.
Pat Vick, of vick's Trucking Co., hadiequested to appear regarding his request for
another special use to allow his mobil hone in GI zoning; however, he did not appear.
Motion Daugherty Second Wanack to table until next meeting. Motion carried 6 for
0 against. Chumbley out of roan.
Motion Farmer Second McClure to adopt Ordinance #317, AN ORDINANCE OF THE CITY OF
ALLEN, OOLLIN OXWrY, TEXAS, REPEALING SECTION III OF ORDNIANCE NO. 1B6 AND SECTION
I AND SECTION III, SECTION I OF ORDINANCE NO. 251 OF THE CITY OF ALLEN, TEXAS, AND
AMENDING AND SUPPLEMENTING SECTION II, SECTION I - "ADOPTION OF BUILDING CODES",
C., BY ADOPTING THE 1978 EDITION OF THE NATIONAL, ELECTRICAL CODE OF THE NATIONAL
FIRE PROTECTION ASSOCIATION, AND FUTURE AMENDMENTS THERETO, AND FURTHER AMENDING
ORDINANCE NO. 290 OF THE CITY OF ALLEN, TEXAS, BY NIr=G IT UNiAWFVL TO UNDERTAKE
THE INSTALLATION OF ELECTRICAL EOUIPMENT WITHOUT A PERMIT THEREFOR, EXCEPT AS OTHER-
WISE PROVIDED; ESTABLISHING INSPECTION DUTIES AND AUTHORITY; ADOPTING CERTAIN OTHER
REGULATIONS; AND FURTHER AMENDING SECTION VII OF ORDINANCE NO 290 OF THE CITY OF
ALLEN, TEXAS, BY ADOPTING ADDITIONAL PENALTIES FOR VIOLATION OF THE ORDINANCE, PRO-
VIDING FOR READOPTION; PROVIDING FOR TETE PUBLICATION OF THE CAPTION HEREOF'; AND
PROVIDING FOR AN EFFECTIVE DATE. Notion carried 6 for 0 against. Daugherty out
of room.
Motion Fanner Second McClure to adopt Ordinance #318, AN ORDINANCE OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, CREATING A PROCESS FOR TETE REGISTRATION AND LICENSING
OF ELECTRICIANS; ORDAINING OTHER M1T'1'ERS ON THE SUAIELT; PROVIDING RULES AND REG-
ULATIONS PERTAINING TO THE REGISTRATION AND LICENSING PROCESS; PF07IDING PENALTIES
FOR VIOLATION OF THE ORDINANCE; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF;
AND PROVIDING FOR AN EFFECTIVE DATE. Notion carried 6 for 0 against. Daugherty out
of the roan.

AND REGULATIONS PERTAINING TO THE REGISTRATION AND LICENSING PRK)CESS; PROVIDING
PENALTIES FOR VIOLATION OF TETE ORDINANCE; PROVIDING FOR THE PUBLICATION OF THE
CAPTION HEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. Notion carried 6 for 0
against. Notion carried 6 for 0 against. Daugherty out of the roan.
Notion Chunbley Second Fanner to grant authorization to the City Manager to execute
an easement contract with Southern Pacific Railroad Company. Motion carried 7 for
0 against. This contract will provide an easement at the railroad tracks on Bethany
Drive for the west side suer line project.
Motion Daugherty Second Chunbley to authorize the Police Chief to send request for
bids for two 1981 Chevrolet Mailibus. Notion carried 7 for 0 against. These bids
will be opened October 20.
Notion Daugherty Second Andrew to authorize the Librarian to solicit bids on library
shelving. Motion carried 7 for 0 against.

Revenue Bonds
Walter Curtis, Tax Assessor, reported that the 1980 tax statements had been mailed
and that some court cases had been filed against some delinquent tax payers.
Notion Andrew Second Fanner to set a council workshop on October 11, 7:30 A.M.,
to review the second year Capital Improve eats Projects. Motion carried 7 for
0 against.

Motion Daugherty Second Andrew to adjourn into Executive Session.
Motion Carried 7 for 0 against. This session was to discuss property.
Motion Famer Second Chumbley to reconvene into regular session. Motion
carried 7 for 0 against.
Motion Daugherty Second Fanner to resolve that the staff finalize purchase
of fire substation site. Motion carried 7 for 0 against.
Motu Daugherty Second Chumbley to adjourn. Motion carried 7 for 0
against.
