HomeMy WebLinkAboutMin - City Council - 1995 - 08/29 - Public HearingBill Petty, Director of Community Development Connie Schofield, Secretary to City Secretary In accordance with V T.C.A., Local Government Code, Chapters 42 and 43, the Allen City Council requested a public hearing to he held on Tuesday, August 29, 1995 at 1:00 p.m. The public hearing was called to order by Director of Community Development, Bill Petty, at 1:00 p.m. on Tuesday, August 29, 1995, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Bill Petty, Director of Community Development, advised that an Annexation Petition had been submitted by landowner Emajean Haggard Hall, Trustee, Kenneth O. Bolin and family, and landowner Allen Land Joint Venture on August 10, 1995 requesting the City of Allen to annex approximately 477.245 acres of land located mostly east of Allen Heights Road, west of Malone Road and mostly north of the proposed alignment of Chaparral Road. More specifically, Bolin's property defined as Tract A -- approximately 116.096 acres in the John Snider Survey, Abstract No. 848, Collin County, Texas; Hall's property defined as Tract B -- approximately 312.84 acres in the James S. Bradley Survey, Abstract No. 89, Collin County, Texas; and Allen Land Joint Venture's property defined as Tract C -- approximately 48.315 acres in the F C. Whisenant Survey, Abstract No. 1012, Collin County, Texas. Mr. Petty read the request into the record as follows: "Public Hearing on the Proposed Annexation of Approximately 477.245 Acres Located Generally East of Allen Heights Drive and South of Bethany Drive." Mr. Petty opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Mr. Benny Bolin, Rt. #I Box 331 B, Allen, Texas, spoke in favor of the annexation due to the lack of services being provided by the City of Parker -- police protection, fire, medical services and water services. He feels that the City of Allen would offer better representation of these services. Mr. Leonard Stanislaw, 4403 Sycamore, Parker, Texas, stated that he would make his comments at the 7:30 p.m. public hearing. CITY OF ALLEN ANNEXATION PUBLIC HEARING AUGUST 29, 1995 - 1:00 P.M. I City of Allen Annexation Public Hearing Page 2 Mr. Kenneth Bolin, Rt. #1 Box 332, Allen, Texas, spoke in favor of the annexation stating that he feels the City of Allen would provide better services to the property owners and to please consider the annexation as soon as possible. Ms. Eleanor Evans, 3507 Hogge Road, Parker, Texas, did not wish to speak at the public hearing but did want to record her opposition to the annexation. Mr. Tom Evans, 3507 Hogge Road, Parker, Texas, asked why were the public hearings being held so close together -- in the same day? Other property owners would have attended if there had been more time. Mr. Evans wanted to state that he was opposed to the annexation. Mr. Bill Wade, 4710 E. Parker Road, Parker, Texas, stated that he would make his comments at the 7:30 p.m. public hearing. Mr. C. R. "Dick" Saunders, 4201 Countryside Drive, Parker, Texas, asked why was the City of Allen rushing to a conclusion regarding this annexation and why were two (2) public hearings held in one day? This appears that the City of Allen is trying to "push something through" as quickly as possible. The property owners live in Parker for a reason -- or they would live in Allen. Why not honor and stand-by the written agreement between the two (2) cities -- Allen and Parker -- that was signed by both mayors in 1971 that set the boundaries where they currently me? He also stated that he did not understand the accusations of inadequate services in Parker. There is no record of this. Mr. Saunders wanted to know (1) Should we (cities), for whatever reason, abort an existing contract and (2) What is the City of Allen's reason for taking a large parcel of land from another city and quickly annexing it into their own city? This creates animosity and is not ethical. Council needs to review this situation. Give both cities time to work the situation out -- not push it through. Mr. Petty responded to Mr. Saunders question by stating that the input today would be recorded and presented to the City Council for their review at the 7:30 p.m. public hearing tonight. The only action that has been taken by the City Council at this time is to schedule the public hearings. The purpose of the public hearings is to give an opportunity to interested individuals to express their opinions either "for" or "against' the item. Ms. Donna Saunders, 4201 Countryside Drive, Parker, Texas, did not wish to speak at the public hearing but did want to record her opposition to the annexation. Ms. Barbara Edmonson, P.O. Box 861797, Plano, Texas, stated that she would make her comments at the 7:30 p.m. public hearing. Mr. James W Cason, 2604 Dublin Road, Plano, Texas, stated that he was in favor of the iiiYYY annexation due to the increasing amount of restrictions "to limit, to prohibit and to deny" water services to ETJ (Extra -territorial Jurisdiction) residents. E City of Allen Annexation Public Hearing Page 3 Mr. Leonard Eisenstein, 1510 Evergreen Drive, Allen, Texas, stated that he was opposed to the annexation. He did not understand how the City of Allen could or would consider extending the medical, police and fire services when the police and fire departments are already short-handed? He understands a new fire station will be built, but when? However, the City park is being built now -- which items get preference? The postal service now is extremely slow and unreliable due to the increased size of Allen. Allen used to be a nice place to live -- low-key Now the traffic is horrendous -- bumper to bumper. The City's priority should be to help those residents already in Allen and have helped Allen become what it is now before adding on more land and build again. Mr. George Taylor, property owner of 48 -acres, Parker, Texas, stated that he was in favor of the annexation. At the present time, Mr. Taylor's property does not have water and/or sewer services from the City of Parker and was told that the fire department and police department cannot service his area. Mr. Jack Albritton, Mayor of the City of Parker, 5110 Old Gate Lane, Parker, Texas, stated that the City of Parker recognizes the 1971 boundary agreement between the municipalities of Parker and Allen, both mayors signed the agreement and a district court judge also signed the agreement. The City of Parker would like the City of Allen to also recognize and respect this agreement. Mr. Albritton hopes the City of Allen will not disregard the contract as this sends a "negative" signal to their "next-door neighbor." Mr. Albritton also stated that some of the Bolin property is now in the City of Parker and that request was made by the property owner after the City was incorporated. Mr. Albritton assured the audience that fire, police and municipal water services were provided to all areas of Parker. Mr. Albritton gave the analogy that "if the City of Allen were in jeopardy of their boundary being taken over by a larger city, then the City of Allen would be taking whatever steps possible to keep this from happening." The City of Parker is going to do the same. The City of Parker strongly opposes the annexation by the City of Allen. Mr. Robert Montgomery, Councilmember, City of Parker, 4111 Pecan Orchard Drive, Parker, Texas, stated that all cities have problems providing services to the capacity that they would like. Mr. Montgomery stated in reference to the "lack of services" that the properties in question are all located in the ETJ of Parker and the property owners have not paid taxes to the City of Parker for the vast majority of their property -- these property owners are not contributing to the "cost" of the services. He suggested that the property owners address their City (Parker) and let the City address all of the needs rather than cause of state of conflict. Mr. James L. Carson, 2604 Dublin Road, Plano, Texas, presented two (2) exhibits to Mr. Petty as rebuttal to the Mayor and Council of the City of Parker -- a letter from Mr. Don W LI Seale to the residents of the City of Parker dated March 5, 1983 and a memo from Mayor Frank Tucker and the City Council to the residents of the City of Parker dated July 1986. I City of Allen Annexation Public Hearing Page 4 Mr. Jack Albritton, Mayor of the City of Parker, 5110 Old Gate Lane, Parker, Texas, stated that the City of Parker had never denied water to anyone. Police services are provided in and out of the city limits of Parker. Ms. Barbara Edmondson, P.O. Box 861797, Plano, Texas, told the audience that she had to go to the Texas Water Commission and fight for their water because the Mayor of Parker threatened to close off the water. Also through her research, Ms. Edmonson found out that the City of Parker had quietly "taken" in a section of land through annexation. More information regarding this would be expressed next week. Ms. Pat Moorer, 4902 Hackbeny Lane, Parker, Texas, did not wish to speak at the public hearing but did want to record her opposition to the annexation. Ms. Lynne Rahakis, 4511 Pecan Orchard, Parker, Texas, did not wish to speak at the public hearing but did want to record her opposition to the annexation. Mr. Petty addressed the audience and wanted to again impress that the public hearing is only a means to provide input either "for" or "against" to the request at hand. With no one else speaking either for or against the request, Mr. Petty closed the public hearing. The public hearing was closed at 1.38 p.m. These minutes reviewed and approved on the 29th day of August, 1995.
