HomeMy WebLinkAboutO-2304-7-04WHEREAS, after notices were duly published, public hearings on the proposed annexation were held by the
City Council of Allen on lune 8, 2004, and lune 22, 2004, all in strict compliance with Local Government Code,
Chapter 43; and,
WHEREAS, the following described land is adjacent and contiguous to the present City limits of the City of
Allen and within its extraterritorial jurisdiction, and the members of the City Council of the City of Allen have
concluded that said area should be annexed and made a part of the City of Allen, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1: The following described territory be, and the same is hereby, annexed by the City of Allen,
Texas, and the same shall hereafter be included within the territorial limits of the said City, and the inhabitants
thereof shall hereafter be entitled to all rights and privileges of other citizens of the City and shall he bound by
the ordinances, acts, resolutions and regulations of said City of Allen, Texas, said property being described in
Exhibits "A-1," "A-2," "A-3," "A-4" and "A-5" attached hereto and made a part hereof, the same as if copied in
full herein.
SECTION 2: In accordance with Local Government Code §43.056, approved hereby and attached hereto as
Exhibit `B" and made a part hereof for all purposes, is the Service Plan providing for municipal services in the
newly annexed areas.

SECTION 3: It is not the intention of the City of Allen to annex any territory not legally subject to being
' annexed by the City, and should any portion of the described area not be subject to legal annexation by the City
of Allen, such fact shall not prevent the City from annexing such territory which is subject to legal annexation
by the City, and it is the intention of the City of Allen to annex only such territory as may be legally annexed by
it within the described areas.
SECTION 4: This ordinance shall take effect from and after its passage.

IT IS THE INTENT TO DESCRIBE FOR ANNEXATION PURPOSES THE LAND WHICH CURRENTLY
LIES ADJACENT TO THE CITY OF ALLEN, BEING BOUNDED ON THE EAST AND WEST BY THE

TEXAS (DRCCT), BEING BOUNDED ON THE SOUTH BY THE SOUTH LINE OF A 165 ACRE
TRACT OF LAND AS DESCRIBED IN A DEED TO EFFIE MENDENHALL AS RECORDED IN
VOLUME 27, PAGE 229, DRCCT, AND BEING BOUNDED ON THE NORTH BY THE SOUTH LINE
OF THE RIGHT OF WAY FOR STATE HIGHWAY NO. 121, AS SHOWN ON THE ATTACHED

The POINT OF BEGINNING is a northeast comer of the annexation described in Ordinance No. 684-3-86,
said point being on the west line of the H. Seaborn & R.F. Clements Survey, Abstract No. 879, being on the
east line of the John W. Roberts Survey, Abstract No. 762, and being on the south line of the Right of Way
for State Highway No. 121, said point being the northeast comer of tract 8 as described in said Ordinance;
THENCE North 64044'l 3" East, with the south line of the Right of Way for State Highway 121, a distance
of 362.25 feet to a point on the west line of the Annexation described in Ordinance No. 684-3-86, being on
the west line of tract 10 as described in said Ordinance;
THENCE South 00057'17" East, with said annexation line, a distance of 1331.74 feet to a point being the
southwest comer of tract 10 as described in said Annexation Ordinance;
THENCE South 89028'55" West, with the south line of the 165 acre tract of land as described in said
Annexation Ordinance, a distance of 330.15 feet to a point being the southeast comer of tract 8 as described
in said Ordinance;

In accordance with Section 43.056 of the TEXAS LOCAL GOVERNMENT CODE, municipal services to the
property described above will be furnished by or on behalf of the City of Allen, Texas, at the same level as is
provided similarly developed areas of the city as follows:
A. Services Available on the Effective Date of Annexation:
1. Police Service, including patrol, responses to calls, and other routine police services.
2. Fire Services including fire protection and emergency ambulance services.
3. Enforcement of the city's environmental health ordinances and regulations, including but not limited
' to weed and brush ordinances, junked and abandoned vehicle ordinances, and animal control
ordinances.
4. Enforcement of building, plumbing, electrical, gas, heating and air conditioning, and all other
construction codes and inspectional services.
5. Enforcement of zoning, subdivision, sign and other ordinances.
6. Park and recreational services, facilities, playgrounds and swimming pools.
7. Solid waste collection shall be provided through and in accordance with the terms of the city's
contract with a designated solid waste collection agency to the property in accordance with existing
city policies within 60 days of the effective date of the annexation unless the property owners
choose to maintain private collection services.
8. Street maintenance and street lighting.
B. Water Services
Water service is available to the properties at the time of annexation on the same basis and at the same
rates as similarly situated tracts within the City.
C. Wastewater Service
' Connections to existing city sanitary sewer mains for sanitary sewage service in this area will be
provided in accordance with existing city policies. Upon connection, sanitary sewage service will be
provided at rates established by city ordinances for such service throughout the city.

D. Capital Improvements
1. Any capital improvements required to serve the annexed area and fulfill this Service Plan will be

substantially completed within 2 '/2 years of the effective date of the ordinance, provided that if

the capital improvements are not substantially completed within such time, this Plan may be

amended to extend the period if the construction is proceeding with all deliberate speed.
2. Property within the annexed area is subject to adopted Impact Fees in a manner not inconsistent

with Chapter 395 of the TEXAS LOCAL GOVERNMENT CODE.

This plan further incorporates where applicable, as though fully written herein, all requirements of V.TC.A.,
Local Government Code §43.056 relating to the provision of municipal services to areas annexed by
municipalities.
This Service Plan is valid for a period of ten (10) years beginning on the 131h day of July, 2004.
