O-2206-9-03ORDINANCE NO. 2206-9-03 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 2 ARTICLE IV, SECTION 2-73 BY REPEALING SUBSECTION (1) OF THE CODE OF ORDINANCES, REMOVING THE TERMINATION DATE OF THE MUNICIPAL COURT TECHNOLOGY FUND; PROVIDING A REPEALING CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, the 76th Legislature of the State of Texas amended Chapter 102 of the Texas Code of Criminal Procedure by adding Article 102.0172 to allow a municipality by Ordinance to create a municipal court technology fund effective until September 1, 2005; and, WHEREAS, the City Council on September 2, 1999, passed Ordinance No. 1755-9-99 codified as Section 2- 73 in the Allen City Code of Ordinances which established the municipal court technology fund; and, WHEREAS, the 78th Legislature of the State of Texas amended Article 102.0172(d) of the Code of Criminal Procedure by repealing the provision that terminated the municipal court technology fund on September 1, 2005. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The City Council hereby effectively repeals as of September 1, 2003, Subsmtion(f) of ' Section 2-73 of Article IV, Courts, of the City of Allen Code of Ordinances. SECTION 2. All provisions of the ordinances of the City of Allen, codified or uncodified, in conflict with the provisions of the ordinance are hereby repealed, and all other provisions of the ordinances of the City of Allen, codified or uncodified, not in conflict with the provisions of this Ordinance, shall remain in full force and effect. SECTION 3. It is the intention of the City Council that this Ordinance, and every provision hereof, shall be considered severable, and the invalidity or unconstitutionality of any section, clause, provision or portion of this Ordinance shall not affect the validity or constitutionality of any other portion of this Ordinance. SECTION 4. This Ordinance shall take effect on September 1, 2003, from and after its passage, as the law and Charter in such cases provide, and it is accordingly so ordained.
