R-2185-7-03RESOLUTION NO. 2185-7-03(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS (THE "CITY"), REGISTERING THE CITY'S OPPOSITION TO THE CREATION OF COLLIN COUNTY MUNICIPAL UTILITY DISTRICT NO. 1, AND THE NEED FOR A PUBLIC HEARING TO DELIBERATE THE MATTER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City has been advised of the contents of the preliminary engineering report prepared in March of 2003 for MUD No. 1; and, WHEREAS, the engineering report describes a 1,200 acre master planned community to be known as Light Ranch, of which approximately 521 acres will be within the boundaries of the proposed MUD No. 1; and, WHEREAS, the 521 acres are proposed to contain 443 acres of residential lots, with the remaining 78 acres in floodplain; and, WHEREAS, the proposal is 1,318 — 50 X 110 foot residential lots, and 585 — 60 X 110 foot lots, for a total of 1,903 residential amts on the 443 acres; and, WHEREAS, the engineering report projects a population on 443 acres of over 6,600 people; and, ' WHEREAS, the size and density proposed for MUD No. 1 creates the demand for full scope of city services, including fire, police, ambulance, street and road installation and maintenance, mks, building permits and inspection, and other services necessary to protect the health, safety and welfare of the citizens purchasing residences in MUD No. 1; and, WHEREAS, the MUD district, as proposed, will provide only water, sewer, and storm drainage; and, WHEREAS, the MUD district, as proposed, is not authorized to provide fire, police, ambulance, parks, road maintenance, or other essential services; and, WHEREAS, the proposed tax rate of 5.91 debt service and $.05 operating tax rate will not include essential city services, except water, sewer, and storm drainage; and, WHEREAS, no city has evidenced a current intent to annex the property in MUD No. 1; and, WHEREAS, while the demands for city services in the 443 acres of MUD No. 1 alone are significant, even greater challenges are created when the additional 800 acres of mixed used of residential, commercial and/or industrial are developed; and, WHEREAS, the burdens an schools, traffic, crime prevention and control, fire protection, ambulance services, and the impact on local school districts, will, without question, fall to Collin County, and the taxpayers of neighboring cities. ' NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The City of Allen, and the taxpayers within the City of Allen, will be both legally and ' economically impacted by unregulated growth in a 1,200 acre development in Waal Collin County. SECTION 2. The economic impact on the City of Allen will include higher taxes to be paid to Collin County to provide additional Sheriffs Deputies, roads and bridges, fire protection, ambulance services, and other services which a town, but not a MUD, provides. SECTION 3. Insufficient detail has been provided in the Petition for the creation of MUD No. 1, and the engineering report, to fully explain the additional and significant impact that the remainder of the 1,200 acre total project will have on this City. SECTION 4. The City therefore does request the Texas Commission on Environmental Quality to order a public hearing to be held regarding the petition for the creation of MUD No. 1. SECTION 5. The City does, pending the outcome of the hearing, register its vigorous opposition to the creation of Collin County MUD No. 1. SECTION 6: The City Secretary shall forward a certified copy of this Resolution to Commissioner Joe Jaynes, Collin County Courthouse, 210 South McDonald Street, 3626, McKinney, Texas 75069. SECTION 7. This Resolution shall take effect immediately from and after its passage, and it is accordingly so resolved.
