R-2161-5-03RESOLUTION NO. 2161-5-03(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ORDERING A RUNOFF ELECTION TO BE HELD ON MAY 31, 2003, FOR THE PURPOSE OF ELECTING THE CITY COUNCILMEMBER FOR PLACE NO. 3; DESIGNATING LOCATION OF POLLING PLACE; ORDERING NOTICES OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN SUCH ELECTION; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. A municipal runoff election is hereby ordered for May 31, 2003, for the purpose of electing the City Councilmember for Place No. 3. City Councilmember for Place No. 3 shall be elected to hold office for a period of three years. SECTION 2. Paper ballots shall be used in this election and such ballots shall be prepared in accordance with the applicable provisions of the Texas Election Code. The order in which the names of the candidates are to be printed on the ballot shall be determined by a drawing by the City Secretary, as provided by Section 52.094 of the Texas Election Code. ' SECTION 3. The entire City shall constitute one election precinct for this election and the Allen City Hall, 305 Century Parkway, Allen,Texas, is hereby designated the polling place. The persons hereby appointed to serve as the election officers at said polling place we as follows: PRESIDING JUDGE -CAROLYN BARNES, 308 ALLENWOOD DR, ALLEN, TX 75002 ALTERNATE PRESIDING JUDGE — RUTH SHIVELY, 1407 FLAMELEAF, ALLEN, TX 75002 The Presiding Judge shall appoint not less than two (2) nor more than five (5) qualified clerks to serve and assist in holding said election; provided that, if the Presiding Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the clerks. The City shall compensate each election judge and worker. Eachjudge shall receive $10.00 per hour for services rendered. Each alternate judge and clerk shall receive $8.00 per how for services rendered. Electionjudges shall be responsible for picking up from and returning election supplies to the City Secretary's Office located in the Allen City Hall. Compensation for this pickup and delivery of supplies will be $25.00. On election day, the polls shall be open from 7:00 A.M. to 7:00 P.M. Earlyvoting shall be conducted by the City Secretary at the Allen City Hall, 305 Century Parkway, Allen, Texas, in accordance with the provisions of the Texas Election Code. Early voting for this election shall begin Monday, May 19, 2003, and end Tuesday, May 27, 2003, and the hours designated for early voting bypersonal appearance shall be from 8:00 A.M. to 5:00 P.M. on each weekday, except on Tuesday, May 20, 2003, and Thursday, May 22, 2003, the hours for early voting by personal appearance shall be extended to 7:00 P.M. Additionally, ' early voting by personal appearance will be closed on Monday, May 26, 2003, in observance of the Memorial Day Holiday. ' An early voting ballot board shall be created to process early voting results in accordance with Section 87.007 of the Texas Election Code. For purposes of processing ballots cast in early voting, the precinct election officers serving at the aforesaid polling place shall serve as the early voting ballot board for this election. 1 SECTION 4. All resident qualified electors of the City shall be permitted to vote at said election. This election shall be held and conducted in accordance with the provisions of Texas Election Code, and as maybe required by law, all election materials and proceedings shall be punted in both English and Spamsh. SECTION 5. The City Secretary is hereby directed to cause notice of said election to be published at least once, not earlier than the 30th day nor later than the 10th day, before election day as provided in Section 4.003(a) (1) of the Texas Election Code; and shall be posted on the bulletin board used for posting notices of the City Council meetings not later than the 15th day before election day. A copy of the published notice that contains the name of the newspaper and the date of publication shall be retained as a record of such notice, and the person posting the notice shall make a record at the time of posting stating the date and place of posting in accordance with Texas Election Code Section 4.005. SECTION 6. This resolution shall take effect immediately upon its passage. DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, ON THE 6TH DAY OF MAY, 2003.
