WHEREAS, the City of Allen is increasing m population and urbanization; and, WHEREAS, the City of Allen is required to conform to the Clean Water Act and apply for a National Pollution Discharge Elimination Systems (NPDES) permit through the TCEQ; and WHEREAS, the permit requires development of a plan that includes six control measures identified by the TCEQ. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. City Council approves the Storm Water Management Program Summary (attached) and authorizes the submittal of the Draft Storm Water Management Program Summary as the imtial submittal to TCEQ as part of the NPDES permitting process. EXECUTIVE SUMMARY The City of Allen has been designated by the U.S. Environmental Protection Agency (EPA) as a Phase II municipal separate storm sewer system (MS4), and is federally mandated under the Clean Water Act to apply for a permit to discharge storm water to Waters of the United States. The EPA granted the Phase II permitting authority for the State of Texas to the Texas Commission on Environmental Quality (TCEQ). The TCEQ requires that regulated MS4s seek authorization to discharge storm water under a Texas Pollutant Discharge Elimination System (TPDES) General Permit TXR040000. This . TPDES permit will authorize the City of Allen to discharge storm water to Waters of the United States over a five-year permit term. is The City of Allen Storm Water Management Program (SWMP) has been prepared to meet the requirements for the TPDES General Permit TXR040000. The SWMP is a comprehensive storm water quality program developed with the goal of minimizing pollution in storm water to the maximum extent practicable and effectively prohibiting illicit discharges to the storm sewer system. The program incorporates a variety of best management practices (BMPs) that have been selected to provide specific storm water quality improvements and satisfy the six Minimum Control Measures (MCMs) that are required in the SWMP. The program provides a description of the selected BMPs, a schedule for implementation of the BMPs and measurable goals to evaluate and track the implementation process. The City of Allen has actively participated in storm water quality improvement measures and seeks to continue that trend through the continued development and implementation of this Storm Water Management Program. DEFINITIONS ■ Best Management Practices (BMPs) - schedules of activities, prohibitions of practices, ■ maintenance procedures, and other management practices to prevent or reduce the pollution. BMPs also include treatment requirements, operating procedures, and ■ practices to control runoff, spillage or leaks, sludge or waste disposal, or drainage from raw material storage. ■ Illicit Connection - any man-made conveyance connecting an illicit discharge directly to ■ a municipal separate storm sewer. ■ Illicit Discharge - any discharge to a municipal separate storm sewer that is not entirely ■ composed of storm water, except discharges authorized under this general permit or a separate TPDES permit and discharges resulting from fire fighting activities. ■ Large Construction Activity - Construction activities including clearing, grading, and ■ excavating that result in land disturbance of equal to or greater than five (5) acres of land. Large construction activity also includes the disturbance of less than five (5) acres ■ of total land area that is part of a larger common plan of development or sale if the larger common plan will ultimately disturb equal to or greater than five (5) acres of land. Large ■ construction activity does not include routine maintenance that is performed to maintain the original line and grade, hydraulic capacity, and original purpose of a ditch, channel, ■ or other similar storm water conveyance. ■ Malor Outfall - an outfall that discharges from a single pipe with an inside diameter of 36 inches or more or its equivalent (discharge from a single conveyance other than ■ circular pipe which is associated with a drainage area of more than 50 acres); or for municipal separate storm sewers that receive storm water from lands zoned for industrial ■ activity (based on comprehensive zoning plans or the equivalent), an outfall that discharges from a single pipe with an inside diameter of 12 inches or more or from its ■ equivalent (discharge from other than a circular pipe associated with a drainage area of ■ 2 acres or more). ■ Maximum Extent Practicable (MEP) - the technology-based discharge standard for municipal separate storm sewer systems to reduce pollutants in storm water discharges ■ that was established by CWA §402(p). A discussion of MEP as it applies to small MS4s is found at 40 CFR 122.34. ■ Notice of Intent (NOI) - A written submission to the executive director from an applicant ■ requesting coverage under TPDES General Permit TXR040000. ■ MS4 Operator - the owner or public entity that is responsible for the management and operation of the municipal separate storm sewer system and is subject to the provisions ■ of this general permit. ■ Permittee - the MS4 operator authorized under this general permit, the City of Allen. ■ Permitting Authority - for the purposes of this general permit, the TCEQ. ■ ■ C= O ■ II -, ■ X!TEAGUE NALL AND PERKINS Redevelopment - alterations of a property that changes the "footprint" of a site or building in such a way that there is a disturbance of equal to or greater than 1 acre of land. This term does not include such activities as exterior remodeling. Small Construction Activity - Construction activities including clearing, grading, and excavating that result in land disturbance of equal to or greater than one (1) acre and less than five (5) acres of land. Small construction activity also includes the disturbance of less than one (1) acre of total land area that is part of a larger common plan of development or sale if the larger common plan will ultimately disturb equal to or greater than one (1) and less than five (5) acres of land. Small construction activity does not include routine maintenance that is performed to maintain the original line and grade, hydraulic capacity, and original purpose of a ditch, channel, or other similar storm water conveyance. Small Municipal Separate Storm Sewer System (small MS4 or MS41 - a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains): (a) Owned or operated by the United States, a state, city, town, borough, county, district, association, or other public body (created by or pursuant to State law) having jurisdiction over disposal of sewage, industrial wastes, storm water, or other wastes, including special districts under State law such as a sewer district, flood control district or drainage district, or similar entity, or an Indian tribe or an authorized Indian tribal organization, or a designated and approved management agency under Section 208 of the CWA; (b) Designed or used for collecting or conveying storm water; (c) Which is not a combined sewer; and (d) Which is not part of a publicly owned treatment works (POTW) as defined at 40 CFR Section 122.2; (e) Which was not previously authorized under a NPDES or TPDES individual permit as a medium or large municipal separate storm sewer system; (f) Which does not include very discrete systems such as those serving individual buildings. ■ Storm Water - storm water runoff, snow melt runoff, and surface runoff and drainage. Storm Water Associated with Construction Activity - Storm water runoff from an area where there is either a large construction activity or a small construction activity. Storm Water Management Prooram (SWMP) - a comprehensive program to manage the quality of storm water discharged from the municipal separate storm sewer system. Surface Water in the State - Lakes, bays, ponds, impounding reservoirs, springs, rivers, streams, creeks, estuaries, wetlands, marshes, inlets, canals, the Gulf of Mexico inside the territorial limits of the state (from the mean high water mark (MHWM) out 10.36 miles into the Gulf), and all other bodies of surface water, natural or artificial, inland or coastal, fresh or salt, navigable or nonnavigable, and including the beds and banks of all watercourses and bodies of surface water, that are wholly or partially inside or bordering the state or subject to the jurisdiction of the state; except that waters in treatment systems which are authorized by state or federal law, regulation, or permit, and which are created for the purpose of waste treatment are not considered to be water ■ in the state. /cA'- CM1 N II -2 is is is II -3 IN ROAM TEAGUE NALL AND PERKINS ■ Waters of the United States - (from 40 CFR Section 122.2) Waters of the United States or waters of the U.S. means: (a) all waters which are currently used, were used in the past, or may be susceptible to use in interstate or foreign commerce, including all waters which are subject to the ebb and flow of the tide; (b) all interstate waters, including interstate wetlands; (c) all other waters such as intrastate lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, or natural ponds that the use, degradation, or destruction of which would affect or could affect interstate or foreign commerce including any such waters: (1) which are or could be used by interstate or foreign travelers for recreational or other purposes; (2) from which fish or shellfish are or could be taken and sold in interstate ■ or foreign commerce; or ■ (3) which are used or could be used for industrial purposes by industries in interstate commerce; . (d) all impoundments of waters otherwise defined as waters of the United States under this definition; (e) tributaries of waters identified in paragraphs (a) through (d) of this definition; (f) the territorial sea; and (g) wetlands adjacent to waters (other than waters that are themselves wetlands) identified in paragraphs (a) through (f) of this definition. is is is II -3 IN ROAM ■ ■ TEAGUE NALL AND PERKINS ■ III. PROGRAM RATIONALE ■ A. Regulatory Requirements ■ The TCEQ has issued a draft TPDES General Permit Number TXR040000, requiring ■ small MS4s to apply for authorization to discharge storm water to surface waters in the State of Texas, defined as Waters of the United States. This new general permit is ■ issued pursuant to Section 26.040 of the Texas Water Code and Section 402 of the Clean Water Act. ■ The City of Allen meets the definition of a small MS4 as defined in the permit ■ document and must therefore make application to the TCEQ for authorization to ■ discharge storm water to surface waters in the state. Application for coverage under this permit includes the submittal of a Notice of Intent (NOI) form and preparation of a ■ Storm Water Management Program (SWMP). The permit provides coverage for a five- year period, and requires an annual update and status report submittal to TCEQ. The ■ document contained herein serves as the SWMP for the City of Allen. ■ The SWMP must provide a listing and description of programs, activities and physical features, known as best management practices (BMPs) developed to prevent pollution ■ in the storm water to the maximum extent practicable (MEP). BMPs are required to be developed for six storm water quality focus areas, known as minimum control ■ measures (MCMs). The six MCMs are: ■ 1. Public Education and Outreach on Storm Water Impacts 2. Public Involvement/Participation ■ 3. Illicit Discharge Detection and Elimination 4. Pollution Prevention/Good Housekeeping for Municipal Operations ■ 5. Construction Site Storm Water Runoff Control 6. Post -Construction Storm Water Management in New Development and ■ Redevelopment ■ Each MCM must contain an appropriate number and type of BMPs to satisfy the permit ■ requirements to the maximum extent practicable. The permit regulations state that existing programs or BMPs may be used to satisfy the requirements of this SWMP. ■ BMPs must include a schedule of implementation during the five-year permit period and a determination of measurable goals to evaluate the effectiveness of the BMP. A ■ description of how each measurable goal will be evaluated must also be provided. ■ It was the intent of the TCEQ to provide a general permit for small MS4s with enough flexibility to create a storm water program to meet the unique, individual needs of ■ smaller systems. The program is to be developed by the MS4 operator (in this case the City of Allen) such that it effectively reduces pollutants to the receiving Waters of ■ the United States. crry IFAR . X�11TEAGUE NALL AND PERKINS B. Storm Water Management Program Development On August 12, 2002, the Allen City Council voted to retain Teague Nall and Perkins, Inc, (TNP) a municipal consulting firm to assist with the preparation of the City's Storm Water Management Program. TNP performed the steps described in this section to determine the most appropriate BMPs for the City of Allen 1. BMP SELECTION PROCESS A comprehensive BMP Inventory was developed using various BMP resources including the EPA's National Menu of BMPs and the North Central Texas Council of Governments Menu of Management Plan Options for Small MS4s in North Central Texas. The BMP Inventory provided an inclusive list of BMPs for each MCM. City of Allen personnel reviewed the list and indicated the BMPs that were in existence in the City, and also identified potential future BMPs that could best ■ achieve the goal of improved storm water quality. Existing BMPs were reviewed ■ and compared with regulatory requirements in the draft permit for each MCM. Where existing programs and regulatory authority were incomplete, additional BMPs were recommended. TNP met with City of Allen personnel for a final selection of BMPs to reduce pollutants to the MEP. Public informational meetings and public hearings were held at Allen City Hall to inform the public about the program and to invite the public to help in the development process. A list of selected BMPs for each MCM was developed and is provided in Section IV, Storm Water Management Program. 2. SELECTION OF MEASURABLE GOALS The TPDES permit stipulates the development of measurable goals for each BMP, with a description of how the measurable goal will be evaluated. Measurable goals were selected to assess the appropriateness of the identified BMP, provide progress towards achieving the statutory goal of reducing the discharge of pollutants to the MEP, and evaluate the success of implementation of the BMP. Effort was made to select measurable goals that provide specific information documented at the time a BMP is implemented. A description of the measurable goal and implementation schedule for each BMP is provided in the SWMP Summary in Section IV. 3. IMPLEMENTATION SCHEDULE The TPDES permit language indicates that BMPs may be performed or phased into the program over the five-year period of permit coverage, such that the program is completely implemented by the permit expiration date. The City of Allen has historically been proactive in protecting the quality of its storm water runoff. Consequently many of the BMPs required are already being practiced in the City and will continue to be practiced or will be improved upon over the permit term. The implementation schedule attempts to phase in BMPs such that all BMPs for Year 1 take credit for existing programs. This will allow the City to implement additional BMPs in the following years in a fiscally responsible manner, with adequate planning to ensure their success. The progression of implementation aims to continually increase storm water quality in the City of Allen to the MEP over ■ the five-year permit term. CnT OF ALLEN III - 2 TEAGUE NALL AND PERKINS 4. ANNUAL REPORTING AND TRACKING TNP has provided the City of Allen with specific forms and documentation needed to prepare concise annual reports to the TCEQ. The documents include the SWMP Summary and Master Tracking Table that identifies each BMP and the schedule for implementation. In addition, a BMP Annual Report Form was developed to provide a method of evaluation for each BMP as required in the General Permit. rim CITY OF ALLEN III - 3 TEAGUE NALL AND PERKINS IV. STORM WATER MANAGEMENT PROGRAM The City of Allen's Storm Water Management Program (SWMP) contains a listing of BMPs to meet the requirements for each minimum control measure (MCM) to the maximum extent practicable. The following program is organized according to the six MCMs. Under each MCM heading the TPDES regulatory text is stated, followed by a listing of the proposed BMPs being implemented to meet the requirements, and a SWMP Summary and Master Tracking Table that describes the BMPs and the proposed schedule for implementation. The following SWMP identifies some BMPs under more than one MCM. The selection of BMPs that attain multiple storm water quality benefits is more beneficial to the City of Allen and their SWMP, and is also recommended by the permitting authority. For example, the BMP entitled Household Hazardous Waste Program satisfies two MCMs. The program educates the community about hazards associated with improper disposal of hazardous waste and directly involves the community with pollution prevention measures. The dual purpose of the Household Hazardous Waste Program therefore fulfills the requirements of both the Public Education and Outreach MCM and the Public Involvement and Participation MCM. r® CnY OF ALLEN IV -1 TEAGUE NALL AND PERKINS Minimum Control Measure: PUBLIC EDUCATION AND OUTREACH ON STORM WATER IMPACTS TPDES Permit Regulatory Text Part III.A.1 (a) A public education program to distribute educational materials to the community or conduct equivalent outreach activities that will be used to inform the following groups within the MS4 area: (1) residents; (2) visitors; (3) public service employees; (4) businesses; (5) commercial and industrial facilities; and (6) construction site personnel. A section within the SEMP must be developed to include procedures for the proper disposal of waste. ■ (e) Municipal Operations and Industrial Activities, The SWMP must include a list of all municipal operations that are subject to the operation, maintenance, or training program developed under the conditions of this section; and municipally owned or operated industrial activities that are subject to TPDES storm water regulations.
