R-2094-9-02RESOLUTION NO. 2094-9-02(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING THE ESTABLISHMENT OF A FEDERAL COURT HOUSE AND RELATED FACILITIES IN COLLIN COUNTY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, for all federal civil and criminal matters that have federal jurisdiction, cities such as Allen are assigned a specific division within each federal trial district where their matters are adjudicated; and, WHEREAS, Allen and cities such as Frisco, McKinney and Plano are included in the United States District Court for the Easter District of Texas and the Federal Court House is located in Sherman, Grayson County, Texas, which is approximately fifty miles from Plano; and, WHEREAS, Collin County has experienced a 43 percent growth in population in the last decade; and, WHEREAS, according to the United States Attorney's Office, the number of federal cases filed for actions arising out of Plano exceeded those arising out of Sherman by approximately 80%; and, WHEREAS, any actions related to these federal proceedings, including those actions that occur prior to a trial, must be accomplished at the Federal Court House in Sherman which requires all witnesses, jurors, attorneys, and federal agency representatives who testify or meet with a federal prosecutor to prepare for a case to travel to Sherman to conduct all aspects related to their federal judicial proceedings; and, ' WHEREAS, the extensive travel to Sherman for matters that primarily occur or arise out of Collin County results in an undue burden on fiscal and personal resources for all persons involved in a federal judicial proceeding; and, WHEREAS, Congress has recognized that there is a need to establish an additional federal court facility in Plano by the introduction of H.R. 4125, Section 102 of the Federal Court Improvement Act; and, WHEREAS, having a second Federal Court House in Collin County for the United States District Court for the Easter District of Texas will improve the fiscal and operational efficiencies in handling cases and eliminate extensive travel and related expenses to citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. In order to improve the efficiency in adjudicating federal matters in the United States District Court for the Easter District of Texas, the Council supports that a Federal Court House and related facilities should be located in Collin County in accordance with H.R. 4125, Section 102 of the Federal Court Improvement Act, as a second court in the United States District Court for the Easter District of Texas. SECTION 2. The City Secretary shall forward a copy of this Resolution to the local federal elected officials. SECTION 3.
