R-2082-8-02RESOLUTION NO. 2082-8-02(R) A RESOLUTION ordering a bond election to be held in the City of Allen, Texas, making provision for the conduct of the election and resolving other matters incident and related to such election. WHEREAS, the City Council of the City of Allen, Texas hereby finds that an election should be held to determine whether said governing body shall be authorized to issue bonds of said City in the amount and for the purposes hereinafter identified; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: An election shall be held on the 5th day of November, 2002 in the City of Allen, Texas, which date is not less than fifteen (15) nor more than ninety (90) days from the date of the adoption hereof and is a uniform election date pursuant to V.T.C.A., Election Code, Section 41.001, for the purpose of submitting the following measures shall be submitted: PROPOSITION NUMBER 1 "SHALL the City Council of the City of Allen, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $19,500,000 for permanent public improvements and public purposes, to wit: construct and equip a performing arts center, including the purchase of land; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be ' issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable orotherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" PROPOSITION NUMBER 2 "SHALL the City Council of the City of Allen, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $4,000,000 for permanent public improvements and public purposes, to wit: construct and equip A senior citizens recreational facility; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity?" SECTION 2: A punch card electronic voting system shall be used in this election, and each voter shall record his vote by marking a ballot to be counted by data processing machines. Ballots shall be prepared in accordance with the applicable provisions of the Election Code so the voters may cast their ballots either "FOR" or "AGAINST' the aforesaid measures which shall appear on the ' ballot in substantially as follows: PROPOSITION NUMBER 1 "THE ISSUANCE OF $19,500,000 GENERAL OBLIGATION BONDS FOR A PERFORMING ARTS CENTER" ALLEN CITY (M) ELECr10N-M. PROPOSITION NUMBER 2 "THE ISSUANCE OF $4,000,000 GENERAL OBLIGATION BONDS FOR A SENIOR CITIZENS RECREATIONAL FACILITY" The Central Counting Station for the tabulation and counting of ballots for this election and the Manager, Tabulation Supervisor, Presiding Judge and Alternate Presiding Judge at such Central Counting Station shall be determined, appointed and designated in accordance with the provisions of the election services contract with the Collin County Election Administrator. The Manager and Presiding Judge of the Central Counting Station may appoint clerks to serve at such Station, as provided by Section 127.006 of the Election Code. SECTION 3: The City shall divided into multiple election precincts for this election that correspond with the election precincts for the City used by Collin County in the general election for state and county officers on the election date, and the polling places designated for each election precinct shall be as shown in Exhibit "A", attached hereto and incorporated herein by reference as a part hereof for all purposes. The election officers for each polling place shall be appointed in accordance with the provisions of a joint elections contract to be executed with Collin County. Each Presiding Judge shall appoint not less than two (2) nor more than five (5) qualified clerks to serve and assist in holding said election; provided that if the Presiding Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the clerks. On Election Day the polls shall be open from 7:00 A.M. to 7:00 P.M. Early voting for this election shall be conducted jointly with Collin County and the eadyvoting clerk shall be the Collin County Elections Administrator in accordance with the provisions of V.T.C.A., Election Code, including Section 271.006. Applications for ballot by mail shall be received and processed by the Collin County Elections Administrator, 920 East Park, Suite 120, Plano, Texas 75074. Joint early voting by personal appearance for this election shall be conducted at the regular early voting place or places maintained by the County, and early voting by personal appearance at such locations shall occur during the early voting period on the days and during the hours, including any extended or weekend hours, the County Elections Administrator regularly conducts early voting at said locations for the general election for state and county officers. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the joint election contract with the Collin County. SECTION 4: All resident qualified electors of the City shall be permitted to vote at said election, and on the day of the election, such electors shall vote at the polling place designated for the election precinct in which they reside. This election shall be held and conducted in accordance with the provisions of V.T.C.A., Election Code and V.T.C.A., Government Code, Chapter 1251, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. The Mayor is hereby authorized to execute for and on behalf of the City a Joint Election Contract with Collin County for the conduct of this bond election to be held jointly with the ' general election for state and county officers, and to approve any amendments thereto. 20820802 AIdP.N= (2002)]=O[ON-RES.0 NG FdF.C1YON.DOC Resolution No. 2082442(R) — Page 2 SECTION 5: A substantial copy of this resolution shall serve as proper notice of said ' election.
