R-2081-8-02RESOLUTION NO. 2081-&02(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ACCEPTING A PROPOSAL BY THE ARTS OF COLLIN COUNTY FOR A PERFORMING ARTS COMPLEX TO BE OWNED AND OPERATED BY THE CITIES OF ALLEN, FRISCO, McKINNEY AND PLANO; PROVIDING GUIDELINES FOR THE BUILDING AND OPERATION OF THE ARTS COMPLEX; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Arts of Collin County, hereafter sometimes referred to as "ACC," bas devoted significant time and effort to study the feasibility of locating an arts complex to be owned and operated by the Cities of Allen, Frisco, McKinney and Plano; and, WHEREAS, the demographics of the various communities, the concept of combining of fiscal resources, and public input evidence strong support fm an arts complex to support local arts organizations and to provide easily accessible and affordable arts to the citizens of the Cities of Allen, Frisco, McKinney and Plano; and, WHEREAS, the County is estimated to double in size in the foreseeable future and the educational and art institutions will continue to show strong growth, and, WHEREAS, based on a survey conducted by ACC, there are no adequate medium to large facilities in Collin County, other than the already utilized Charles W. Eisemann Center in Richardson, to support the enjoyment of the arts and arts organizations within Collin County; and, ' WHEREAS, there are several quality small theaters existing or in planning but as their patron arts organizations mature, the facilities will not support the continued growth of the arts groups; and, WHEREAS, a jointly owned and operated arts complex will provide better facility utilization and synergy of talents and resources; and, WHEREAS, the Arts of Collin County has shown that the capital and operation costs are less per city by combining the efforts of at least the Cities of Allen, Frisco, McKinney and Plano to build an arts complex that is convenient to all and that all may share; and, WHEREAS, such a complex as proposed will help retain local artists and arts programs and events within the County; and, WHEREAS, the Arts of Collin County has submitted a report that indicates a favorable economic impact on these cities with the development of the proposed perforating arts complex; and, WHEREAS, a performing arts complex will enhance the overall quality of life for each connnunity. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1: The City Council accepts the proposal by the Arts of Collin County far a performing arts complex with the following guidelines: A. The initial facilities for the proposed perforating arts complex should include a flexible, multipurpose theater with a seating capacity of 800 to 2100, a second multipurpose theater with a seating capacity of 350 to 600, and other public and support space in general conformance with the ACC's recommended building program. ' B. The proposed performing arts complex should be located in the general vicinity of the intersection of State Highway 121 and Custer Road on a site containing a minimum of 80 acres. The proposed performing arts complex should be master planned to create a park -like setting for the facilities and provide for future expansion and development of other complementary uses. As general guidance to this effort, the site and facilities should be of high quality and become a focal point for Collin County. The performing arts complex should support a wide variety of the arts for the benefit and enjoyment of the citizens, reflect the community's diversity, and support Allen local artists and arts organizations. It should be attractive to families and support our Allen and Collin County educational institutions. C. The primary source of proposed capital funding for the proposed performing arts complex is limited to $76,000,000 to be provided in equal amounts by the Cities of Allen, Frisco, McKinney and Plano by a means of their selection. The design, size, timing and phasing of the proposed performing arts complex program must be achieved within the total known financial resources available for such development. The ACC should continue to seek input from the community so the final product supports the needs of the Allen citizens. D. At the appropriate time and through a mutual agreement, the Cities of Allen, Frisco, McKinney and Plano may form a Local Government Corporation to develop, manage, and fund the proposed performing arts complex. In addition, an independent non-profit corporation should be established to seek further financial support and charitable contributions from the private sector for the proposed performing arts complex. E. The ACC should continue the planning and organizational efforts as prescribed by the terms ' of an agreement to be considered by the Cities of Allen, Frisco, McKinney and Plano and which agreement defines the ACC's authority, charges, and resources. I SECTION 2: This Resolution shall become effective from and after its passage.
