R-2056-6-02RESOLUTION NO. 2056-6-02(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING THE LOCAL OPTION EXEMPTION FROM AD VALOREM TAXATION FOR ORGANIZATIONS PRIMARILY ENGAGED IN PERFORMING CHARITABLE FUNCTIONS UNDER THE PROVISIONS OF SECTION 11.184 OF THE TAX CODE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 77th Texas Legislature approved House Bill 1689 amending Chapter 11 of the Tax Code to add Section 11.184 to provide for the local option exemption from ad valorem taxation for certain organizations engaged primarily in performing charitable fimctions; and, WHEREAS, the City Council of the City of Allen, Collin County, Texas, desires to provide for the exemption of certain organizations engaged primarily in performing charitable functions pursuant to Section 11.184 of the Tax Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1: Pursuant to Section 11.184(6)(1), beginning tax year 2001, the City of Allen, Collin County, Texas, hereby adopts the local option exemption for organizations engaged primarily in charitable functions pursuant to Section 11.184(6)(1) of the Tax Code. ' SECTION 2: Should any word, sentence, paragraph, subdivision, clause, phrase or section of this resolution, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said resolution, as amended hereby, which shall remain in full force and effect. SECTION 3: This resolution shall become effective immediately from and after its passage. SECTION 4: The City Secretary is hereby directed to send a certified copy of this Resolution to the Collin County Central Appraisal District.
